U.S. District Judge Kath-
leen Williams has tried to
prod the prosecutors to
make up their minds about
pursuing capital case,
ordering them in October
to "advise" the defendant
and his attorneys of their
plan to seek the death
penalty— or not.
If prosecutors do, they
would have to return to the
federal grand jury In Mia-
mi ask the secret panel
to add the charge of kid-
napping resulting in death
to an indictment. The
panel might add other
charges. Ultimately, the
U.S. Attorney's Office in
Miami would need the
final approval of the Justice
Department to add the
death penalty to the case.
The U.S. Attomey's
Office declined on Thurs-
day to comment on its next
move, which Is likely to
come this month.
At an Oct. 22 court hear-
ing, prosecutor Jessica
Obenauf told the judge
that the U.S. Attomey's
Office in Miami has been
in discussions with the
Justice Department in
Washington, regarding
bringing a potential death
penalty case.
"They are aware and we
are in constant contact
with them," Obenauf told
Williams.
Knezevich's main de-
fense attorney, Jayne
Weintraub, who has chal-
lenged prosecutors to pro-
duce evidence of an al-
leged murder, zeroed in on
that issue at last month's
hearing.
"We are all kind of
pussyfooting around this
word that l know the
Coot is well aware of, and
that word would he proto-
col," Weintraub said, re-
ferring to the process of
hiring a "learned counsel"
who specializes in death
penalty law to assist in
Knezevich's defense if he's
charged with killing his
wife.
"I'm sitting here just
hying to wrap my mind
around what is happening
here," said Weintraub,
adding that prosecutors
filed the original kidnap-
ping charge as "a book-
mark or a placeholder."
The issue of additionally
charging Knezevich with
both kidnapping and kill-
ing his wife runs parallel to
another high -profile case
in Miami: a Colomban
man was arrested last
month on the charge of
kidnapping his former
mistress and her 9-year-
old daughter, resulting in
their deaths eight years
ago.
Knezevich's case is strik-
ingly different because the
alleged crime involved his
traveling from Miami to
Serbia before prosecutors
and FBI agents say he
kidnapped his wife in
Spain. leading to her disap-
pearance in early February.
'CUNNING LEVEL OF
DECEPTION'
In two consecutive de-
tention herrings, a magist-
rate judge in Miami or-
dered that Knezevich re-
main in jail because he
considered him a "serious
flight risk."
After the second hear-
ing, Magistrate Judge Ed-
win Torres concluded
"there is ample evidence"
to support the kidnapping
case against Knezevich,
whose lawyers had asked
the judge to reconsider his
initial detention order.
"Indeed, the evidence
produced at the second
hearing supports the
Court's original finding
that [Knezevich) presents a
serious risk of flight given
the cunning level of decep-
tion that he has demon-
strated as part of the crime
he Is' alleged to have en-
gaged in," Torres ruled in a
17-page order in Septem-
ber.
Torres also rejected the
defense's "attack" that
prosecutors have no juris-
diction to bring the kid-
napping charge in Miami
because the crime alleged-
ly happened in Spain, say-
ing their initial evidence
supported the case.
After his arrest in May,
Knezevich faced intense
scrutiny during the two
detention hearings. An FBI
agent dug into a trove of
circumstantial evidence
suggesting he had the
means, opportunity and
motive to kidnap his es-
tranged wife front her
apartment in Madrid.

Knezevich, who oper-
ated a tech business,
owned millions of dollars
in Broward County resi-
dential real estate with his
wife, a native of Colombia.
They were fighting over
these and other assets
when she left for Spain in
late December of 2023.
He's accused of leaving
Miami the following
month with a plan to track
her down. She was report-
ed missing by authorities
on Feb. 2.

in a suitcase out of her
Madrid apartment building
that evening, citing securi-
ty -camera footage of him
exiting the elevator. In
August, the FBI joined
Spanish and Italian author-
ities in a search for her
corpse in the woods north
of the city of Vicenza in
Italy, where a GPS alert an
the husband's rented Peu-
geot 308 suggested he took
u detour there on his return
trip from Spain to Serbia.
NO BLOOD FOUND IN
MADRID APARTMENT
At the second detention
hearing, Knezevich's law-
yer, Weintraub, focused on
a Spanish police forensic
report that found "no
traces of blood" in the
wife's Madrid apartment,
contrary to what they ini-
tially claimed Citing no
signs ofstruggle, Rnezev-
ich's defense team sought
his release based on this
new piece of evidence.
"I agree with you that
some of their evidence is
challengeable," Torres said
at the end of the hearing,
pointing out the absence of
blood evidence in the
wife's Madrid apartment.
The judge also said he
could not detect a "suit-
case," as described by an
FBI agent during her testi-
mony, in the security cam-
era video of Knezevich at
the wife's apartment build-
ing. The FBI suspects Kne-
zevich carried out Ana, a
petite woman, in some-
thing that looks like a suit-
case, according to the
agent's testimony.

However, the judge cited
the strength of another
video showing Knezevich
purchasing materials such
as duct tape and spray
paint at a Madrid hardware
store that may have been
used to keep the front door
of the wife's apartment
building open during the
alleged kidnapping and to
coat over the security cam-
era In the lobby.
'Doesn't that make then
case stronger?' Torres
said, referring to the key
piece of evidence present-
ed by prosecutors.
"He was buying those
supplies in that hardware
store, including the can of
spray paint, to make sure
the video cameras did not
catch him moving her out
of the building," Tones
said.
'Pones further noted that

to Serbia, where he has
family, and then rented the
Peugeot to drive to Spain.
The judge noted he drove
the rental car for thou-
sands of miles from Bel-
grade to Madrid and back
to Belgrade, keeping the
car for 47 days. When he
returned it to the rental
agency, the windows had
been tinted, stickers
removed and license plates
swapped out.

The Board of Commissioners ("Board") of the Southeast Overtown/
Park West Community Redevelopment Agency ("SEOPW CRA"), will
hold a Public Hearing on Thursday, November 21si, 2024, at 10:00
a.m. or anytime thereafter In the City Commission chambers located
at Miami City Hall, 3500 Pan American Drive, Miami, FL 33133.
The Board will consider amending existing Resolution No.
CRA-R-23-0021 ("Resolution"), passed and adopted on May 25,
2023, to Girl Power Rocks, Inc., a Florida Not -For -Profit Corporation,
to incorporate soft costs that will support the development of Mama
Hattie's House, a five -story mixed -use facility with retail and public
spaces, as well as residential units for young women.
In accordance with the SEOPW CRA 2018 Redevelopment
Plan Update ("Plan") and Florida Statutes 163, the Board will
consider the amendment to the Resolution to further assist in
the development of the facility. This amendment will improve the
quality of life for residents within the redevelopment area, and Is

Park West Community Redevelopment Agency ("SEOPW CRA")
will hold a Public Hearing on Thursday, November 21st, 2024, at

The Board will consider the allocation of funding to Girl Power Rocks,
Inc., a Florida Not -For -Profit Corporation, to support the Summer STEAM
("Science, Technology, Engineering, Art, and Math") and Workforce
Training Program ("Program"). The seven -week Program aims to help
at -promise girls ages 11-17 years old within the redevelopment area
learn soft workforce skills for STEAM careers, as well as prepare them
for overall success In their middle school level courses.
In accordance with the SEOPW CRA 2018 Redevelopment Plan
Update ("Plan") and Florida Statutes 163, the Board will consider the
allocation of funding the Program In an amount not to exceed Sixty -
Eight Thousand Dollars and Zero Cents ($68,000.00). Thls allocation
will encourage youth programming within the redevelopment area and
Is consistent with the Plan.

Espinosa is married to
Justo Espinosa, Hialeah's
Transit Director, which

of interest. She told the
Herald that if appointed
as a council member, she
would ecuse herself
from voting on any mat-
ters that directly involve
her husband. She said
that her decisions would
be based on her own
independent views. "I
will always vete based on
what I believe is right,"
she said. "The fact that
the mayor is my hus-
band's boss will not influ-
ence my decisions."

an activist who frequently
speaks out at council
meetings about local
developments, rising fees
for water and trash serv-
ices and other issues
affecting long-time resi-
dents.
Santana is a farmer
three -time mayoral can-
didate and a former can-
didate for an interim
council seat in 2022 and
July 2024. Santana prom-
ises to foster greater
government transpar-
ency, provide affordable
housing for workers, and
reduce trash collection
fees and water bills.
Santana holds a high
school diploma and pur-
sued political science in
college, though he did
not complete his degree.
He is currently the vice
president of Positive Hits
Community Service
Group South, a nonprofit
organization dedicated to
supporting people in need
in Hialeah.
• Lawrence Jay Arther,
58, a military veteran,
attended the special
meeting on Nov. 4, when
the council discussed the
process to fill the vacant
seat. During the meeting,
he announced his in-
tention to apply for the
position. Archer urged the
"sncil and mayor to
top harming people,
especially veterans, with
fines." Hialeah records
shows that Arther resides
in a property that accu-
mulated fines in 2023 for
code compliance vio-
lations.
"I'm asking you to stop
harming people with
fines and other measures
you have in place. I'm
asking you to find in your
heart alternative ways...
and please consider me
for the city council,"
Arther said.
In his letter of intent,
Arther said he was apply-
ing because he has "the
interest of the communi-
ty not my own agenda —
working for the better-
ment of the community,
disabled veterans, and all
those who feel they don't
have a voice." However,
his application lacks a
resume and details about
his military service.
Espinosa and Montan-
don, the two female can-
didates, have expressed
interest in running for the
council seat in the 2025
election if appointed to
the interim position.
However, the council is
seeking a "placeholder"
to Serve for one year until
a decision is made about
who will ultimately nun
for the seat.
Next year, Hialeah will
have four of its seven
council seats on the bal-
lot, along with the may-
or's seat. Two of these
seats are up for reelec-
tion, while the other two
would be held by interim
council members. One of
the interim members,
Melinda De La Vega, was
appointed on July 16 to
fill Pacheco's vacancy.

an activist who frequently
speaks out at council
meetings about local
developments, rising fees
for water and trash serv-
ices and other Issues
affecting long-time resi-
dents.
Santana is a former
three -time mayoral can-
didate and a former can-
didate for an interim
council seat In 2022 and
July 2024. Santana prom-
ises to foster greater
government transpar-
ency, provide affordable
housing for workers, and
reduce trash collection
fees and water bills.
Santana holds a high
school diploma' and pur-
sued political science in
college, though he did
not complete his degree.
He is currently the vice
president of Positive Hits
Community Service
Group South, a nonprofit
organization dedicated to
supporting people in need
in Hialeah.
• Lawrence Jay Arther,
58, a military veteran,
attended the special
meeting on Nov. 4, when
the council discussed the
process to fill the vacant
seat. During the meeting,
he announced his in-
tention to apply for the
position. Arther urged the
council and mayor to
"stop harming people,
especially veterans, with
tines." Hialeah records
shows that Arther resides
in a property that accu-
mulated fines in 2023 for
code compliance vio-
lations.
"I'm asking you to stop
harming people with
fines and other measures
you have in place. I'm
asking you to find in your
heart alternative ways...
and please consider me
for the city council,"
Arther said.
In his letter of intent,
Arther said he was apply-
ing because he has "the
interest of the communi-
ty not my own agenda —
working for the better-
ment of the community,
disabled veterans, and all
those who feel they don't
have a voice." However,
his application lacks a
resume and details about
his military service.
Espinosa and Montan-
don, the two female can-
didates, have expressed
Interest In running for the
council seat in the 2025
election if appointed to
the interim position.
However, the council is
seeking a "placeholder"
to serve for one year until
a decision is made about
who will ultimately run
for the scat.
Next year, Hialeah will
have four of its seven
council seats on the bal-

seats are up for reelec-

NOTICE OF PUBLIC HEARING
The Board of Commissioners ("Board") of the Southeast 0vertown/
Park West Community Redevelopment Aaencv ("SEOPW CRA") will
hold a Public Hearing on Thursday, November 21'., 2024, at 10:00 a.m.
or anytime thereafter in the City Commission chambers located at
Miami City Hall, 3500 Pan American Drive, Miami, FL 33133.
The Board will consider the allocation of funding to Miami Urban
Contemporary Experience, LLC, a Florida Limited Liability Company,
to assist In the showcase of a dynamic and Immersive art exhibition
at the Historic D.A. Dorsey House. This event will take place during
Overtown's annual art week, Soul Basel, from December 6-8, 2024.
In accordance with the SEOPW CRA 2018 Redevelopment Plan
Update ("Plan") and Florida Statutes 163, the Board will consider the
allocation of funding in an amount not to exceed Ten Thousand Dollars
and Zero Cents ($10,000.00), This allocation will assist In promoting
local arts and cultural events within the redevelopment area, and is
consistent with the Plan.

City Commission chambers.
Should any person desire to appeal any decision of the Board with
respect to any matter considered at this meeting, that person shall
ensure that a verbatim record of the proceedings is made, Including
all testimony and evidence upon which any appeal may be based
