HomeMy WebLinkAboutCRA-R-23-0016Southeast Overtown/Park West Community Redevelopment Agency Legislation 819 NW 2nd Ave 3rd Floor Miami, FL 33136 www.seopwcra.com CRA Resolution: CRA-R-23-0016 File Number: 13886 Final Action Date:4/27/2023 A RESOLUTION OF THE BOARD OF COMMISSIONERS OF THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY ("SEOPW CRA") BY A FOUR -FIFTHS (4/STHS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE EXECUTIVE DIRECTOR'S RECOMMENDATION AND FINDING THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS PURSUANT TO SECTIONS 18- 85 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AS ADOPTED BY THE SEOPW CRA; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING AS NOT BEING PRACTICABLE OR ADVANTAGEOUS TO THE SEOPW CRA; AUTHORIZING THE EXECUTIVE DIRECTOR TO DISPERSE FUNDS, AT HIS DISCRETION, ON A REIMBURSEMENT BASIS OR DIRECTLY TO VENDORS, UPON PRESENTATION OF INVOICES AND SATISFACTORY DOCUMENTATION, SUBJECT TO THE AVAILABILITY OF FUNDING, FROM THE SEOPW TAX INCREMENT FUND, ENTITLED "OTHER GRANTS AND AIDS" ACCOUNT NO. 10050.920101.883000.0000.00000 IN AN AMOUNT NOT TO EXCEED EIGHTY- SEVEN THOUSAND FOUR HUNDRED FORTY-FOUR DOLLARS AND ZERO CENTS ($87,444.00) ("FUNDS") TO BAME DEVELOPMENT CORPORATION OF SOUTH FLORIDA, INC., A FLORIDA NOT FOR PROFIT CORPORATION ("BAME") FOR REPAIRS AND IMPROVEMENTS ("PURPOSE") TO THE PROPERTY LOCATED AT 269 N.W. 8TH STREET, MIAMI, FLORIDA 33136 (THE "PROPERTY"); FURTHER AUTHORIZING THE EXECUTIVE DIRECTOR TO NEGOTIATE AND EXECUTE AN AGREEMENT, INCLUDING ANY AND ALL DOCUMENTS NECESSARY, ALL IN FORMS ACCEPTABLE TO THE GENERAL COUNSEL FOR THE ALLOCATION OF THE FUNDS FOR THE PURPOSE STATED HEREIN, PROVIDING FOR THE INCORPORATION OF RECITALS AND AN EFFECTIVE DATE. WHEREAS, the Southeast Overtown/Park West Community Redevelopment Agency ("SEOPW CRA") is a community redevelopment agency created pursuant to Chapter 163, Florida Statutes, and is responsible for carrying out community redevelopment activities and projects within its redevelopment area in accordance with the SEOPW CRA 2018 Redevelopment Plan Update ("Plan"); and WHEREAS, Section 2, Goal 6 lists "improving the quality of life for residents" as a stated redevelopment goal; and WHEREAS, Section 2, Principle 10 of the Plan lists "Streets and buildings must be attractive" as a stated redevelopment principle; and WHEREAS, BAME Development Corporation of South Florida, Inc., a Florida not for profit corporation ("BAME") owns a property located within the redevelopment area at 269 N.W. 8th Street, Miami, Florida 33136, further identified as Folio 01-0103-050-1120 (the "Property"); and City of Miami Page 1 of 3 File ID: 13886 (Revision:) Printed On: 9/11/2025 File ID: 13886 Enactment Number: CRA-R-23-0016 WHEREAS, the Property is a 2-story, 10-unit apartment building built in 1969, and has been vacant for some time and often becomes a site where homeless individuals illegally enter the property, contributing to blighted conditions; and WHEREAS, the Property is in need of several repairs which include; securing windows, door openings, exterior painting, structural and electrical improvements ("Purpose"); and WHEREAS, the Board of Commissioners wishes to authorize funding in the amount not to exceed Eight -Seven Thousand Four Hundred Forty -Four Dollars and Zero Cents ($87,444.00) ("Funds") to BAME for the Purpose; and WHEREAS, the Board of Commissioners finds that authorizing this Resolution furthers the aforementioned redevelopment goals and objectives; and WHEREAS, based on the recommendation and findings of the Executive Director, it is in the SEOPW CRA's best interest for the Board of Commissioners to authorize, by an affirmative four -fifths (4/5ths) vote, a waiver of competitive sealed bidding procedures pursuant to Section 18-85 of the Code of the City of Miami, Florida, as amended ("City Code"), as adopted by the SEOPW CRA, the allocation of the Funds to BAME; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Pursuant to Section 18-85 of the City Code, as adopted by the SEOPW CRA, by a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the Executive Director's recommendation, and written finding that competitive negotiation methods and procedures are not practicable or advantageous to the SEOPW CRA's provision of Funds for repairs to the Property and waiving the requirements for said procedures are ratified, approved, and confirmed. Section 3. The Executive Director is hereby authorized to disperse funds, at his discretion, on a reimbursement basis or directly to vendors, upon presentation of invoices and satisfactory documentation, subject to the availability of funding from the SEOPW Tax Increment Fund, entitled "Other Grants and Aids" Account No. 10050.920101.883000.0000.00000 to BAME for the Purpose stated herein. Section 4. The Executive Director is authorized to negotiate and execute an agreement, including any and all necessary documents, and all -in forms acceptable to the General Counsel, for said Purpose. Section 5. This Resolution shall become effective immediately upon its adoption.
