Ron DeSantis has signed a bill that will revamp the insurance practice known as "assignment of benefits." Gov. DeSantis and other support- ers of the bill pointed to abuses of the so-called AOB process. The insurance industry contends that AOB fraud and excessive litigation have h el ped lead to higher property - insurance rates. "I thank the Florida Legislature for passing meaningful AOB re- form, which has become a racket in recent years," Gov. DeSantis said in a prepared statement. "This legislation will protect Florida con- sumers from predatory insurance practices." Assignment of benefits is a de- cades -old practice that has become contentious in recent years, at least in part because of an increase in residential water -damage claims. Those claims have primarily dealt with issues such as broken water pipes and leaks, rather than hur- ricane damage. In assignment of benefits, prop- erty owners in need of repairs sign over benefits to contractors, who ultimately pursue payments from insurance companies. While insur- ers have complained about fraud and litigation, plaintiffs' attorneys and other groups argue AOB helps make sure claims are properly paid. They accuse insurers o foften trying lowball amounts paid for work. Lawmakers in recent years con- sidered changes to the process but could not agree amid heavy'. hby- ing by groups on botb sides of the issue. This year, however, the House and Senate bridged differences and sent the bill to Gov. DeSantis. The bill includes numerous changes, including creating a system that will effectively limit at- tomey fees inAOB lawsuitsfiledby contractors against insurers. The fee changes, which involve a formula, would not apply to lawsuits filed by policyholders. Also, the bill will let insurers offer policies that restrict or do not allow assignmentofbenefits.
