HomeMy WebLinkAboutR-25-0172City of Miami Resolution R-25-0172 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 17500 Final Action Date: 5/8/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AFTER A DULY NOTICED PUBLIC HEARING, AUTHORIZING AND DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL ACTION(S) NECESSARY TO EXPEDITIOUSLY REQUEST THE MIAMI-DADE COUNTY DEPARTMENT OF TRANSPORTATION AND PUBLIC WORKS ("DTPW') CONSIDER THE PROPOSED TRAFFIC FLOW MODIFICATIONS AND WAIVE THE REQUIRED RESIDENT CONCURRENCE AND EXEMPT THE BALLOTING PROCESS IN ORDER TO EXPEDITIOUSLY PROCEED WITH THE DESIGN AND CONSTRUCTION OF TRAFFIC CALMING DEVICES AT THIRTY (30) LOCATIONS IN THE RESIDENTIAL NEIGHBORHOODS OF CITY OF MIAMI DISTRICT 2, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED; DIRECTING THE CITY CLERK TO SEND A CERTIFIED COPY OF THIS RESOLUTION TO THE DTPW DIRECTOR. SPONSOR(S): Commissioner Damian Pardo WHEREAS, several locations in the City of Miami's ("City") District 2 residential neighborhoods are experiencing significant cut -through traffic and speeding during rush hour periods; and WHEREAS, such cut -through traffic and speeding on local residential streets that are not designed for such volume diminish residents' quality of life; and WHEREAS, in addition to quality -of -life problems, such as noise and general congestion, such cut -through traffic and speeding creates significant life -safety risks as residential streets are narrower than nearby arterial roadways, which increases the risk of vehicular accidents, including those involving pedestrians; and WHEREAS, those drivers who cut -through residential neighborhoods during rush hour traffic tend to disobey posted speed limits and signage to gain an advantage over using arterial roadways meant for such traffic; and WHEREAS, in order to alleviate these issues, the City proposes to install thirty (30) traffic calming devices at the locations in the residential neighborhoods, as described in Exhibit "A," attached and incorporated, that experience significant cut -through traffic and speeding during morning and afternoon rush hour periods; and WHEREAS, Section 1.6 of the Miami -Dade County Traffic Flow Modification(s)/Street Closure(s) Procedure, as revised by the Miami -Dade County Public Works Department ("PWD") Traffic Engineering Division in January 2009, attached and incorporated as Exhibit "B" ("County Procedure"), requires concurrence from the affected residents and/or property owners; and City of Miami Page 1 of 3 File ID: 17500 (Revision:) Printed On: 8/22/2025 File ID: 17500 Enactment Number: R-25-0172 WHEREAS, Section 1.6 of the County Procedure further states: "Municipal Jurisdictions: In lieu of concurrence from the affected residents and/or property owners, a municipality may pass a resolution after a public hearing requesting PWD [now known as the Miami -Dade County Department of Transportation and Public Works ("DTPW')] to consider the proposed traffic flow modification(s)/street closure(s);" and WHEREAS, in order to expeditiously address the aforementioned quality of life and life -safety issues, the City desires to install the thirty (30) traffic calming devices, as more particularly described in Exhibit "A," attached and incorporated, in designated residential neighborhoods of District 2 without delay by holding a public hearing in lieu of resident/property owner concurrence through balloting; and WHEREAS, although the City is adopting this Resolution after a public hearing in lieu of concurrence, it is the intent of the City, to the best of its ability, to seek concurrence from the residential properties whose frontage directly abuts the proposed traffic calming devices, as are more particularly described in Exhibit "A," attached and incorporated; and WHEREAS, in lieu of concurrence from the affected residents and/or property owners, the City Commission finds it in the best interest of the City and its residents to pass a resolution, after a public hearing, requesting PWD/DTPW to consider the proposed traffic flow modification(s)/street closure(s) as described in Exhibit "A," attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and are incorporated as if fully set forth in this Section. Section 2. The City Commission, after a duly noticed public hearing, authorizes' and directs the City Manager to take all actions necessary to expeditiously request that DTPW consider the proposed traffic flow modifications at the following thirty (30) locations within District 2, as more particularly described in Exhibit "A," attached and incorporated, in order to expeditiously proceed with design and construction of the traffic calming devices: 1. Tigertail Avenue and Kirk Street 2. Tigertail Avenue between Jefferson Avenue and Washington Avenue 3. Royal Palm Avenue between Douglas Road and Plaza Street 4. Royal Palm Avenue between Plaza Street and Hibiscus Street 5. Crawford Avenue between Frantz Road and Justison Road 6. Pomona Avenue between Le Jeune Road and La Playa Boulevard 7. Ventura Avenue between Le Jeune Road and La Playa Boulevard 8. El Prado Boulevard between La Playa Boulevard and Braganza Avenue 9. Avocado Avenue between Douglas Road and Plaza Street 10. Avocado Avenue between Plaza Street and Hibiscus Street 11. Palmetto Avenue between Douglas Road & Plaza Street 12. Palmetto Avenue between Plaza Street and Hibiscus Street 13. Day Avenue between Virginia Street and Matilda Street 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. The City Clerk is directed to send a certified copy of this Resolution to the Director of Miami -Dade County's Department of Transportation and Public Works. Section 4.
