REQUEST
Pursuant to Chapter 55, Section 55-15(a) of the City of Miami Code of Ordinances (the "City
Code"), as amended, Ethan Wasserman, Esquire and Marissa A. Neufeld, Esquire, on behalf
of Land 1 (One) Ltd., (the "Applicant") requests to close, vacate, abandon, and discontinue
from public use of a twenty foot (20') public alley running along the eastern boundary of the
property along generally located between south of Northwest 11 street, east of Northwest 42
Avenue, north of Northwest 9 Street, and west of Northwest 41 Street and is generally located
at 901 Northwest 42 Avenue, 1001 Northwest 42 Avenue, and 1099 Northwest 42 Avenue,
Miami, Florida (the "Property").
RECOMMENDATION
Pursuant to Chapter 55, Section 55-15(a) of the City of Miami Code of Ordinances, as
amended, the City of Miami Plat and Street Committee and Planning Department
recommends Approval with Conditions of the requested closure, vacation, abandonment and
discontinued from public use of a public alley (the "Right -of -Way") based on the facts and
findings in this staff report.

THE PROPERTY
The Property is generally bounded by the following Thoroughfares: Northwest 11 Street,
Northwest 42 Avenue, Northwest 9 Street, and Northwest 41 Street, refer to Figure 1. The
Property's gross area is approximately 124,491 square feet or 2.86 acres.

Per the Tentative Plat, the area of the Public Right of Way (Le Jeune Road- State Road No.
953) is 679-83' x 50'. And a 20'-0" wide Public Right of Way. Is 629.78' x 20' approximately
Track F, 5,000 square feet or 0.115 acres, Track E, 9,774 square feet or 0.224 acres Refer
to Figure 3 and 4.

According to the Survey V-1, the Public Right of Way is twenty feet (20'-0") wide, an area of
5,000 square feet or 0.115 acres, referred to Figure 3.

Development Proposal
The Property is located within the "T6-8-O," Urban Core Transect Zone -Open. However, the
Public Right of Way primarily serves the properties to the east, which are situated within the "T3-
R," Sub -Urban Transect Zone — Restricted. The Right -of -Way is partially bounded by an existing
concrete block wall along the East -South Property line; however, along the Northern property line
it is bounded by existing Wood fences. Additionally, some of the residences to the East have back
gates that face the Alley located along the "T3-R," Sub -Urban Transect Zone — Restricted
boundary line. The Right -of -Way is primarily located among parcels that are exclusively owned
by the Residences located along the east side area. Additionally, the adjacent property to this
Right -of -Way remains mainly residential, with one commercial use at the south portion towards
Northwest 9 Street.
The Vacation and Closure of the Replating of the Property
Pursuant to Chapter 55, Section 55-15 of the City Code, the Applicant is replatting the Property
with the intent to vacate the Right -of -Way located at the east of the Property.

ANALYSIS
Pursuant to Chapter 55, Section 55-15(c) of the City Code, "In addition to review for
technical compliance, the plat and street committee shall also consider the request for
vacation and closure with respect to the following:"
Criteria 1:
Is it in the public interest, or would the general public benefit
from the vacation of the rights- of -way or easement?
Finding 1:
The vacation of the right-of-way removes maintenance burden and
related expenses from the City and tax payers. The Applicant will
maintain the area once it is closed/vacated.
Criteria 2:
Is the general public no longer using the rights of way or easement?
including public service vehicles such as trash and garbage trucks,
police, fire, or other emergency vehicles?
Finding 2:
The Alley is only accessed or used by local residents within the block.
The access will still be available by providing private ingress/egress
easement, to also include access by public service vehicles and
property owners to the East of Public Right Of Way. General public
access will be limited by posted signs for private property/driveway.
Criteria 3:
Would there be no adverse effect on the ability to provide police,
fire, or emergency services?
Finding 3:
Access to the Public Right Of Way will be still available for police, fire
and emergency vehicles. There will not be any gate or physical
restrictions.
Criteria 4:
Would the vacation and closure of the rights of way or easements
have? a beneficial effect on pedestrian and vehicular circulation in
the area?
Finding 4:
The Public Right Of Way is not interconnected to other Public Right Of
Ways to the North and South. It currently does not significantly
contribute to vehicular circulations in the area. Pedestrian circulation is
minimal because there is no sidewalk within the Public Right Of Way.
Miami 21 Code and the MCNP
Criteria 1:
The proposed vacating and closing of the Public Right of Way was
found to be consistent with Article 2, Section 2.1.2(b)(3.) of the Miami
21 Code:

Analysis 1:
The request for the Vacation Closure aligns with the goals outlined in
both the Miami 21 Code and the Miami City Neighborhood Plan
(MCNP). According to Article 2, Section 2.1.2(b)(3) of the Miami 21
Code, private development must contribute to increased infrastructure
capacity while enhancing the pedestrian -friendly public realm. By
approving this Vacation Closure, the development project will not only
promote a more efficient and accessible urban space but will also
contribute to the enhancement of the surrounding public environment.
This aligns with the goal of creating high -quality, pedestrian -oriented
spaces.
Moreover, the proposed closure supports the Capital Improvements
Goal CI-1 of the MCNP, which emphasizes the need for sound fiscal
management and the timely provision of public capital facilities. By
allowing this Vacation Closure, the city will be able to redirect
resources to ensure the continued development and improvement of
infrastructure that meets the demands of both current and future
growth. The proposed Vacation Closure will enable the necessary
provisions for public capital facilities while fostering an environment
that enhances the quality of life for residents and visitors. Therefore,
the request is consistent with both the Miami 21 Code and the MCNP's
objectives, justifying the approval of the Vacation Closure.

It is consistent with Article 2, Section 2.1.3.3(b.) of the Miami 21 Code:
Analysis 2:
The request for the Vacation Closure aligns with the principle that
development should adequately accommodate vehicles while
respecting pedestrian mobility and the spatial integrity of public space.
This approach is consistent with Goal TR-1 of the Miami City
Neighborhood Plan (MCNP), which seeks to maintain an efficient and
cost-effective circulation network that reduces automobile dependency
and mitigates roadway congestion. The proposed project takes a
thoughtful approach to transportation planning, ensuring that the public
right-of-way will remain open and accessible to the public as it currently
exists. According to the Plat and Street Committee meeting on
December 7, 2023, various departments have provided conditions and
comments that must be met for the project to proceed (see Attachment
3). The Letter of Intent (LOI) further clarifies that the vacation and
closure of the Right -of -Way will not have any adverse impacts on public
access. Instead, it will facilitate a redevelopment that is in line with the
city's zoning code (Miami 21) and will result in the property being
removed from the city's tax roll, with the owner assuming all associated
costs. This ensures that the redevelopment process will both enhance
public space and improve circulation without negatively impacting the

overall transportation network, aligning with both the MCNP and Miami
21 objectives.

Pursuant to Article 3, Section 3.8.2.b of the Miami 21 Code:
Analysis 3:
The request for the Vacation of the Right -of -Way is consistent with
the principles outlined in the Miami 21 Code, particularly regarding
the design of the thoroughfare network. As stated in the Miami 21
Code, the thoroughfare network should prioritize connectivity by
defining blocks with an average perimeter of no more than 1,320
feet. The Closure of the Right -of -Way is in line with these
objectives, as the proposed redevelopment will improve
connectivity and circulation while maintaining access for both
public and service vehicles. According to the Letter of Intent (LOI),
a public access easement and a public utilities easement have
been reserved over the Right -of -Way, ensuring continued access
to the public and service vehicles.
Additionally, the closure will enable thoughtful redevelopment that
enhances the circulation and accessibility of the site by improving the
connection from Northwest 42 Avenue, Northwest 9 Street, and
Northwest 11 Street, while respecting the city's planning goals. The
Property's design will adhere to the principle that the thoroughfare
network should not only avoid unnecessary closings but should also
incorporate traffic calming measures to control volume and speed. This
Vacation Closure supports the broader goal of creating a functional,
efficient network that promotes pedestrian and vehicle safety, and
enhances the public realm without disrupting connectivity. Furthermore,
the Right -of -Way, which lies within the Tentative Plat site and connects
Northwest 9 Street to Northwest 11 Street, will be revitalized as part of
the project, with the owner assuming responsibility for necessary repairs,
ensuring that the site meets both aesthetic and functional urban design
standards.

FINDINGS
• The Property is located within the "T6-8-O," Urban Core Transect Zone — Open.
• The Property has the "General Commercial" Future Land Use designation.
• The Property is bound by Northwest 42 Avenue to the west, Single Family residences to
the west, Northwest 9 Street to the south, and Northwest 11 Street to the north.
• The Right -of -Way is partially bounded by a concrete block wall along the east -south
property line.
• The Right -of -Way is bounded by a wood fence along the northern property line.
• Per the T Plat, the property line to the east measures 629.88', the property line to the west
measures 629.84', the property line to the north measures 112.79', and the property line to
the south measures 113.48'.
• The total perimeter length of the Property is +/- 1,486 linear feet.

• On December 7, 2023, the Plat and Street Committee reviewed and approved the JValle —
Tentative Plat #1960-A.
• Pursuant Chapter 55, Section 55-15(a) of the City Code, as amended, the Department of
Resilience and Public Works and Office of Capital Improvements confirmed the
expenditures of funds / restricted fund on City project Central Sanitary Sewer Improvement
— SR-5481 C (Project B-5481) applies on the right of way, Attachment 3.
• The Planning Department reviewed the request pursuant to Miami 21 Code and the Miami
Comprehensive Neighborhood Plan.
CONCLUSION
Pursuant to Chapter 55, Section 55-15(a) of the City of Miami Code of Ordinances, as
amended, the City of Miami Plat and Street Committee and Planning Department
recommends Approval with Conditions of the requested closure, vacation, abandonment
and discontinued from public use of a public alley based on the facts and findings in this staff
report.
CONDITIONS
1. The vacation and closure of the Right -of -Way shall be developed in accordance with the
"Jvalle - Tentative Plat #1960-A", consisting of two (2) sheets, digitally signed and sealed
by Mark Steven Johnson of Schwebke-Shiskin & Associates, Inc., Professional Surveyor
and Mapper, LS No. 4775, State of Florida, with a Survey Date of August 2, 2024.
2. The Applicant or their successor shall comply with all conditions and/or comments in the
letter drafted and signed by Juvenal Santana, P.E., CFM, Supervisor of Plats - Plat and
Street Committee, Department of Resilience, Public Works, Development and Roadway
Plans, Planning and Zoning, and standard comments, on February 14, 2024, for the
Tentative Plat # 1960-A located along the east side of Northwest 42 Avenue, and from
Northwest 9 Street to Northwest 11 Street.
3. Pursuant to Chapter 55 of the City Code, the Applicant shall obtain and submit the Total
Expenditure prior to the scheduling of a public hearing before the City
Commission. Payment to the City of the amount indicated on the Total Expenditure shall
be paid to the City before recordation of the Final Plat.

5. The Applicant, owner, or successor shall meet applicable development standards
identified in the Miami 21 Code and all applicable local, county, state, and federal
regulations.
6. The Applicant, owner, or their successor shall provide an access plan for review and
acceptance by the City's Fire -Rescue, Police, Solid Waste Departments, and the Capital
Improvements Program/Office Transportation.

7. A building permit, including phased permits, shall not be issued on the Property being
platted until the final plat is recorded in the official records of Miami -Dade County, Florida
or as authorized by Section 55-10(j) of the City of Miami Code of Ordinances, as amended.
8. Approval of the requested vacation and closure shall be valid for a period of four (4) years
and shall remain independent of the referenced tentative plat during this period, pursuant
to Section 55-15 of the City of Miami Code of Ordinances, as amended.
9. A Certificate of Occupancy shall only be issued after all the required subdivision
improvements have been completed.
10. The City reserves the right to inspect the site to ensure compliance with the conditions
listed.

Ladies and Gentlemen:
The City of Miami Plat and Street Committee, at its meeting of December 7, 2023 approved the above
tentative plat subject to the following revisions being made to the tentative plat, additional information
being provided and/or variances being granted. Please be advised that the processing of your tentative plat
cannot proceed until these conditions and/or comments have been satisfied.
Resilience and Public Works
1. Application, notary section, needs to specify the oath.
2. The Opinion of Title should remove the authority section or revise it to be in acceptable form.

amended to include the alley to be closed/vacated. The new one will need to be recorded

8. Provide corrections on the underground information of existing storm water drainage system
adjacent to the proposed plat — underground lines, inlet rim elevation, inlet type, structure bottom
elevation, pipe invert elevation and direction, pipe size, pipe length, pipe material, exfiltration
trench, and legend. The complete underground stormwater drainage utilities are to be located,
whether shown in City records or not. Obstructed structures must be cleaned to be accessible for
field verification.

Planning/Zoning
13. Provide a Tree Table listing all trees with common and scientific names, height, diameter and
spread prepared by a Certified Arborist, to include their name, certification number, date of site
visit.
14. Under the Development Information, #3, update it to: T6-8-O (Urban Core Transect Zone — Open).
Standard Comments
15. Existing utilities located within the alley to be closed and vacated must be relocated or easements
provided.
16. Applicant is to comply with requirements of City of Miami Code Section 55-15(b)(1) for the
properties on each side of the right-of-way to be vacated and closed to be included in the plat. City
of Miami Code Section 54-4(b) is an alternative method to the requirement for abutting properties
for the vacation and closure of public street or alley.
17. An opinion of title as to reversionary rights for the right-of-way to be closed and vacated will be
required by the Planning, Zoning and Appeals Board. The opinion of title must also address
whether or not there are individuals, in addition to the abutting property owners, having an interest
in the right-of-way to be vacated and closed. A copy must be provided to the Survey Section of
Department of Resilience and Public Works.
18. The Planning, Zoning, and Appeals Board will require a Sketch and Legal Description with a
square footage, on an 8 %" X 11" paper, for the proposed closure. Contact the Office of the Hearing
Boards, at 305-416-2030. Provide a copy of to the Survey Section of Department Resilience and
Public Works.
19. The Subdivider or applicant is to comply with the requirements of Chapter 55, Sec. 55-15(a) City of
Miami Code before scheduling a public hearing before the city commission for the vacation and
closure of the alley.
20. A letter from Comcast is required to determine if any adjustments to their facilities or easements are
required.
21. A letter from Miami -Dade Water and Sewer Department is required to determine if any adjustments
to their facilities or easements are required. Also, a letter to release the final plat in connection with
water and sewer service agreements.
22. Verify with Miami -Dade County that the proposed plat name is acceptable.
23. All encroachments across proposed tract and/or lot lines must be removed prior to final plat
submittal.
24. An Opinion of Title, in the City of Miami Opinion of Title form, must be provided at the time of
final plat submittal.
25. Current backup documentation will be required for all who execute the final plat. A resolution for
authority to execute documents and a Certificate of Good Standing from the Secretary of State are
required, if applicable.
26. A plat letter from the Florida Department of Transportation (FDOT) is required at the time of final
plat submittal. A copy of the final plat must be provided to FDOT, not a copy of the tentative plat.
27. Tentative plat application must be made with Miami -Dade County after receiving approval from the
City of Miami Plat and Street Committee.
28. Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is the
owner's responsibility to work with his/her surveyor and attorney to assure that everything is in
order before submitting the final plat package.
29. Be advised that if all requirements for scheduling the final plat for City Commission action are not
in order, the final plat will not be scheduled for a City Commission meeting.

30. A letter of concurrency from Miami -Dade County School Board is required at the time of final plat
submittal.
31. Provide two 8 %" by 11" paper location sketch exhibits, one "Before Replat" and one "After
Replat".
In addition to the above requirements, you should be aware of the following:
1. State and local laws require the installation of various physical improvements in the public rights -
of -way when property is platted. These subdivision improvements include paving, drainage,
landscaping, sidewalks, etc. In some cases, this could represent a substantial investment on your
part. REQUIRED: The submission of an electronic file of the tentative plat, in an AutoCAD, to the
City of Miami Resilience and Public Works Department, Development and Roadway Plans Section
will EXPEDITE the preparation and enhance the ACCURACY of the subdivision improvement
letter required for the final plat approval.
2. Execution of Covenant for Postponement of Subdivision Improvements is required in cases where
the required subdivision improvements are not completed.
3. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric,
telephone, water, etc., caused by this plat will be at the property owner's expense. Also, utility
easements may be required on the property being platted.
4. Provide compliance to Bulletin 51 for minimum elevation of stormwater drainage system.
5. A building permit will not be issued on the property being platted until the final plat is recorded or
as authorized by the City of Miami Code Section 55-10(j). Also, the Temporary Certificate
Occupancy and/or Certificate of Occupancy for any building construction will be issued only after
all the required subdivision improvements have been completed.
6. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to the
issuance of a building permit.
7. In order to mitigate problems associated with access and construction activities throughout the
neighborhood, the contractor/developer is encouraged to notify the affected neighborhood residents,
in writing, of the project starting and completion dates at the time of issuance of permits. The
contractor/developer may coordinate the notification with the residents.
8. Additional items must be provided to the City of Miami Department of Resilience and Public
Works before the final plat is submitted to the City Commission for approval. You will be notified
in writing as to what these items are after the amount of the bond has been determined for the
necessary subdivision improvements. It is required that the applicant contacts the Survey Section of
City of Miami Resilience and Public Works Department to verify that all final plat submittal
documents are complete prior to final plat submittal.
9. Tentative plat approval is only valid for one (1) year and six (6) months from the date of the Plat
and Street Committee meeting at which time it was approved.
