(the "Applicant"), related to the property located at 31 NW 36 Street (the "Property") in the City of Miami (the "City"). Please let the following serve as the Applicant's letter of intent in support of three Exceptions related to the Property. Property Information. The Property is located on the north side of NW 36 Street, between N Miami Avenue on the east and NW 1 Avenue on the west. Miami -Dade County's Property Appraiser identifies the Property as one of the parcels included within Folio No. 01-3124-021-1810. The Property is approximately 9,500 square feet in size and currently being developed with a two-story commercial building approved via Waiver Final Decision No. 2017-0061 and Building Permit No. BD17-011953-001 ("Approved Building"). The Property is currently vacant and under construction. Pursuant to the Miami Comprehensive Neighborhood Plan Future Land Use Map, the Property is designated General Commercial. In addition, the Property is zoned T6- 8-0, Urban Core Zone, within the Wynwood Norte Neighborhood Revitalization District ("NRD-2"). According to Appendix P, Section 2.2 of Miami 21, the intent of NRD-2 is to restore, enhance and grow the existing diverse, and mixed -use Wynwood Norte neighborhood. Mr. David Snow City of Miami Planning Department Page 2 Proposed Development. The Applicant intends to build out the commercial space within the Approved Building with an Alcohol Beverage Service Establishment ("ABSE") and an active, covered, rooftop. The plans accompanying this application include minor differences from the plans accompanying Waiver Final Decision No. 2017-0061. These minor modifications to the approved design are approvable as of right and do not affect the previously granted Waivers. Modifications include the addition of one (1) additional story, for a total of three (3) stories, and the reconfiguration of the rear of the Approved Building. The requested ABSE will allow the Property to accommodate a unique restaurant and bar concept which will be known as "Bolera Tropical" (the "Project"). The Project proposal is consistent with the intent of the NRD-2, as an enhancement of the active cultural commercial opportunities within the district and revitalization of a currently vacant site. The Project will occupy approximately 7,325 square feet of the proposed structure. Request and Analysis. As previously noted, the Applicant seeks approval the following three (3) Exceptions related to the Property: Exception 1: Distance Separation. Pursuant to Chapter 4, Section 4-4 of the City of Miami Code of Ordinances (the "Code"), alcohol service establishments must be located a certain minimum distance from a similarly licensed establishment, as measured by the distance between their respective front doors along the route of ordinary pedestrian traffic. Pursuant to Section 4-4(g) of the Code, an Exception may be granted by the Planning, Zoning and Appeals Board ("PZAB"), with City Commission approval, for a reduction of up to fifty percent (50%) of such distance requirements. Section 4-4(f) of the Code specifies that the appropriate establishments must be separated by a minimum distance of 1,500 feet. The proposed Project will be seeking a 4COP quota license and will be less than 1,500 feet away from a similarly licensed establishment, as measured by the route of ordinary pedestrian traffic: the Sylvester, located at 3456 N Miami Avenue, is 760 feet away. Accordingly, the Applicant respectfully requests approval of an Exception to reduce the 1,500 feet restriction to 750 feet, so as to accommodate the Project. As previously noted, Project is consistent with the intent of the Wynwood Norte NRD-2, as it will contribute toward the desired revitalization of the NW 36 Street corridor and bring a vibrant use to a long vacant site. Exception 2: Hours of Operation. Pursuant to Chapter 4, Section 4-3 of the Code, alcohol service establishments may request an extension of hours to 5:00am. Accordingly, the Applicant respectfully requests approval of an Exception to extend the hours of operation to 5:00am. Exception 3: Establishment Size. Pursuant to Article 6 of Miami 21 and Chapter 4 of the Code, alcohol service establishments occupying more than 5,000 square feet of floor area require an Exception with approval by the City Commission. As such, the Applicant respectfully requests this Exception to permit an alcohol service establishment with a total floor area in excess of 5,000 square feet. Exception Review. Exception applications are reviewed pursuant to the Design Criteria contained in Article 4, Table 12. The Project meets the required criteria. The proposed use will operate in a manner that is respectful of its location and context: the Project will bring activity and vibrancy to the 36 Street Corridor, one of the main thoroughfares within the NRD-2. Article 4, Table 12.- Building Disposition. The Approved Building's disposition was found to be compatible with the context and approved via Waiver Final Decision No. 2017-0061 and via Building Permit No. BD17-011953-001. As previously noted, Project is consistent with the intent of the Wynwood Norte NRD-2. The NRD-2 identifies NW 36 Street as a "Wynwood Norte Corridor" and acknowledges that is a significant thoroughfare of relative importance. See Section 9.1 of the Wynwood Norte NRD-2. Based on its relative importance, NE 36 Street has been assigned setbacks different from those of other streets within the NRD-2 and has been assigned T6-8 zoning. Per Article 4, Table 1, the T6 Urban Core Zone is envisioned as consisting of the highest Density and greatest variety of uses. Consistent with Article 4, Table 12, the Approved Building and its proposed use respond to the lot and neighborhood context by contributing toward the desired revitalization of the NW 36 Street corridor and bringing a vibrant use to a long vacant site. It should be noted that the Approved Building does not maximize its permissible development rights and is only three (3) stories in height. It is also important to note that the permissible zoning around the Property, including parcels with T5 and T6 zoning, permits heights greater than the Approved Building as of right. The reduction in distance from other establishments, hours of operation, and size of establishment will not negatively impact the area; instead the Project reaches forward and brings the Approved Building in line with the NRD-2 vision for the NE 36 Street Wynwood Norte Corridor. Article 4, Table 12.- Ambient Standards. On -site lighting will be provided appropriate to the Approved Building. Lighting has been approved via Building Permit No. BD17-011953-001. • Orient lighting to minimize glare to the public realm and Abutting properties On -site lighting will minimize glare to the public realm and abutting properties. Lighting has been approved via Building Permit No. BD17-011953-001. • Apply mitigation measures to protect Abutting properties, Neighborhoods, and the public realm from excessive noise, fumes, odors, commercial vehicle intrusion, traffic conflicts and light spillover. Mitigation measures will be implemented to protect abutting properties. Details related to associated with operations and mitigation measures are included in the enclosed Operations Plan. It should be noted that the Property is just south of the 1-195 highway and there are currently no residential uses within the immediate vicinity of the Property. While, there are portions of parcels with NRD-2 T5 zoning which include vacant, duplex, and single-family structures south of NW 36 Street, these parcels front NW 35 Street, and are buffered from the Property by NW 36 Street and the T6-8 parcels which line the south side of NW 36 Street. It should also be noted that given the height of the Approved Building at just three stories and the NRD-2 zoning for the immediately abutting area, future development around the Property may be two or more stories taller than the Approved Building, providing additional future buffering for the Project. Accordingly, given context, the reduction in distance from other establishments, proposed hours of operation, and size of establishment are appropriate for the Property and its context. Article 4, Table 12.-Building Configuration. The Approved Building's configuration was found to be compatible with the context and approved via Waiver Final Decision No. 2017-0061 and via Building Permit No. BD17-011953-001. The scale and massing of the building reinforce and enhance the existing streetscape and neighborhood character and bridge the existing context with the future envisioned by the NRD-2 regulations. The building is only three stories in height which reinforces and enhances the neighborhood context. The roof is articulated to create a transition between the Approved Building and sky, and complement the Neighborhood context. While there is limited Open Space on the Property, the roof deck is covered to allow patrons to fully utilize the space and has convenient pedestrian access from the public realm. The reduction in distance from other establishments, hours of operation, and size of establishment facilitate the creation of exciting use that is completely appropriate for the Approved Building and contextually appropriate. In determining the appropriateness of the request, the PZAB and City Commission must take into consideration the recommendation of the Planning Department based on the submittal of an operational plan, including the methods of parking, crowd control, security, sanitation, and traffic analysis. As such, included with this application is an operations plan providing responses to the required criteria under Sec. 4-7(c)1-8. While alcohol will be available within the Project, it is in the context of this unique and much -needed, active use. This is exactly the kind of contextually appropriate and vibrant use that will make Wynwood Norte a destination for residents and visitors alike. An operational/business plan that addresses hours of operation, number of employees, menu items, business goals, and other operational characteristics pertinent to the application. • Hours of operation. The Applicant intends to operate seven days per week. The maximum occupancy is approximately 672 patrons. o First floor: The operator intends to employ approximately 10 persons per shift over two working shifts; operating hours 11 am — 5 am o Second floor: The operator intends to employ approximately 10 persons per shift over two working shifts; operating hours 10 pm — 5 am o Third floor: The operator intends to employ approximately 18 persons per shift over two working shifts; operating hours 11 am — 5 am • Number of employees. The operator intends to employ approximately 76 persons over two working shifts. • Menu items. See Exhibit A for sample Menu. • Business goals and information. See Exhibit B 2. A parking plan which fully describes where and how the parking is to be provided an utilized, e.g., valet, self -park, shared parking, after -hour metered spaces, and the manner in which the parking is to be managed. The city commission or the PZAB, as applicable, may grant approval for 100 percent of the required parking to be located offsite within a distance of 600 feet from the subject alcohol service establishment if the proposed parking is to be "self -park" and a distance of 1,000 feet from the subject alcohol service establishment if the proposed parking is to be by "valet." The Project complies with the Miami 21 parking requirements. The Project requires 22 parking spaces which, consistent with NRD-2 regulations, will be provided via payment into the Wynwood Norte Parking Trust Fund. Nonetheless, consistent with Article 4, Table 12, the project will offer a valet parking service for customers. The Applicant is working with Miami Parking Inc. to provide valet services for the Property. See Exhibit C, for letter from Miami Parking Inc. To minimize the impact of parking and loading on the public realm and adjacent properties, these activities will not occur on NW 36 Street, but rather AlmaRosa Restaurant Lounge - Bowling Operations Plan along the alley along the north side of the Property. It should also be noted that there is a large public parking garage across the street at 3401 N Miami Ave (Midtown) available for customers. 3. For alcohol service establishments proposing capacities over 300 persons, an indoor/outdoor crowd control plan that addresses how large groups of people waiting to gain entry into the alcohol service establishment and already on the premises will be controlled. In order to minimize impacts on the public realm, the entrances to the Project will be from the back of the building. Groups will wait for admission at the first floor lobby and security will ensure that the public right of way is not impacted. Security will maintain an accurate count of patrons relative to permissible capacity and create clearly demarked queuing space. Additionally, crowds will be controlled on an operational basis through the reservation system. 4. A security plan for the alcohol service establishment and any parking facility. The operator will employ two full-time security officers. Additionally, the operator intends to utilize a third -party security company (10 persons) between the hours of 9pm and 5 am for the operation of all the three floors. Additionally, the operator intends to contract for off duty police service from 10pm to 4:50 am. There are no affiliated parking facilities. Security will be tasked with: • Requiring proper identification, • Identifying overly intoxicated individuals and refusing entry, and • Maintaining training in security related scenarios. 5. For alcohol service establishments proposing capacities over 300 persons, a traffic study and traffic circulation analysis and plan that details the impact of projected traffic on the immediate neighborhood and how this impact is to be mitigated. The Applicant provides the requested analysis under separate cover. 6. A sanitation plan which addresses on -site facilities as well as off -premises issues resulting from the operation of the alcohol service establishment. The Applicant will contract Waste Management to have trash picked up 6 days per week from the hours of 7am — Noon. Additionally, Staff will maintain the premises and immediate area clean and in good order. Proximity of the proposed alcohol service establishment to districts —residential. The Property is located on the north side of the Wynwood Norte NRD-2,just south of the 1-195 highway. There are no residential districts in the immediate vicinity of the Property. 8. If the proposed alcohol service establishment is within 200 feet of any residential use, a noise attenuation plan that addresses how noise will be controlled shall be required, especially in the case of indoor/outdoor uses. There are currently no residential uses within the immediate vicinity of the Property. While, there are portions of parcels with NRD-2 T5 zoning which include vacant, duplex, and single-family structures south of NW 36 Street, these parcels front NW 35 Street, and are buffered from the Property by NW 36 Street and the T6-8 parcels which line the south side of NW 36 Street. Residents of the NRD-2 supported the rezoning and creation of the NRD-2 to encourage revitalization of the area and to attract businesses and active uses to the commercial corridors like NW 36 Street. It should also be noted that the Property is adjacent to the 1-195 highway, which creates significant and constant background noise levels. Nonetheless the Applicant has considered noise attenuation strategies to be implemented on the premises: • Life -safety occupancy levels will be strictly enforced to limits crowds and their requisite noise levels. • A canopy roof element covers outdoor areas which will facilitate the containment of sound within the Project. • Music in outdoors areas will be limited to ambient levels, at a level that permits normal conversation. • Landscaping and rooftop plantings have been designed and arranged in manner anticipated to offer some noise buffering from the abutting right of way.
