HomeMy WebLinkAboutR-25-0153City of Miami Resolution R-25-0153 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 17441 Final Action Date: 4/24/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), PURSUANT TO SECTION 163.360, FLORIDA STATUTES, APPROVING AND ADOPTING THE REDEVELOPMENT PLAN ("PLAN"), PREPARED BY BUSINESSFLARE, LLC, ATTACHED AND INCORPORATED AS EXHIBIT "A," FOR THE ALLAPATTAH REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY ("ALLAPATTAH CRA"); ACKNOWLEDGING THAT THE PLAN IS IN CONFORMITY WITH THE CITY OF MIAMI'S COMPREHENSIVE NEIGHBORHOOD PLAN; ACCEPTING AND INCORPORATING THE BOUNDARIES SET FORTH IN THE EXHIBIT "A," ATTACHED AND INCORPORATED; FILING THE BOUNDARIES, WITH A MAP, WITH THE CITY CLERK; FURTHER DIRECTING THE CITY MANAGER TO TRANSMIT THE PLAN TO THE ALLAPATTAH CRA, UPON ESTABLISHMENT AND THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY FOR FURTHER LEGISLATIVE ACTION; PROVIDING FOR THE INCORPORATION OF RECITALS AND AN EFFECTIVE DATE. SPONSOR(S): Commissioner Miguel Angel Gabela WHEREAS, the Florida Legislature enacted the Community Redevelopment Act of 1969, which is presently codified in Chapter 163, Part III, Sections 163.330 through 163.464, Florida Statutes ("Act"); and WHEREAS, on October 15, 2024, the City of Miami ("City") Commission, adopted Resolution No. R-24-0415, which directed the City Manager to, among other things, hire consultants to prepare the Finding of Necessity ("FON"), pursuant to the Act, for the creation of a Community Redevelopment Agency in the neighborhood commonly referred to as "Allapattah" in the City; and WHEREAS, on January 23, 2025, the City Commission adopted Resolution No. R-25- 0022 which directed the City Manager to take any and all steps necessary to expedite the creation of the Allapattah Redevelopment District Community Redevelopment Agency ("Allapattah CRA"); and WHEREAS, on April 10, 2025, the City Commission adopted Resolution No. R-25-0124, which approved the FON which declared the Allapattah area as outlined in the study to be slum and blighted and in need of redevelopment ("Area"), pursuant to Section 163.335 Florida Statutes; and WHEREAS, BusinessFlare, LLC., has prepared a Redevelopment Plan for the Area ("Plan"), as attached and incorporated herein as Exhibit "A"; and WHEREAS, on April 2, 2025, the Planning, Zoning and Appeals Board ("PZAB") of the City adopted Resolution No. PZAB-R-25-015 thereby approving, accepting, and adopting the City of Miami Page 1 of 2 File ID: 17441 (Revision: A) Printed On: 8/21/2025 File ID: 17441 Enactment Number: R-25-0153 Plan and acknowledging that the Plan was in conformity with the City's Comprehensive Neighborhood Plan ("MCNP"); and WHEAREAS, Allapattah CRA will be responsible for carrying out community redevelopment activities and projects within the Area, in accordance with the Plan, upon its establishment; and WHEREAS, the City Commission desires to approve and adopt the Plan and further request the Plan to be transmitted to Miami -Dade County ("County") Board of County Commissioners ("County Commission") and the Allapattah CRA, upon its establishment, for further legislative action; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Pursuant to Section 163.360 Florida Statutes, the Plan, attached and incorporated as Exhibit "A," is approved and adopted. Section 3. The City hereby acknowledges that the Plan is in conformity with the MCNP and accepts and incorporates the boundaries set forth in Exhibit "A," as attached and incorporated herein. Section 4. The City Manager is directed to transmit the Plan to the County Commission and Allapattah CRA, upon its establishment, for further legislative action. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
