I am writing this as a homeowner in the area. As you are aware, the project known as the Well is
seeking to be increased from the approved 5 stories to 8 stories. The basis for this addition was
under this supposed T5 Bonus that allowed for an additional 3 stories in non -single family areas
near a transit oriented zone only in the NCD-3. However, it is this non -single family area that is
the issue to be brought to light before this commission. At the commission hearing in September
of 2023, a change to the T5 bonus height was introduced by then Commissioner Covo. Such a
change was both substantial and material as it affected hundreds, if not thousands, of residents
surrounding the transit zone areas. As a result, said change that was introduced and voted on by
the commission was in dear violation of the rules approving changes to city ordinances,
specifically failing to allow the public to comment on the change. This very issue was addressed in
the Florida Supreme Court case of Neumont v. State which predates when this violation took
place. Therefore, white the matter could easily be addressed in Litigation, the commission today
should take the proactive step to immediately right a wrong committed and invalidate this non-
singLe family area for the T5 Bonus and deny all parties who have applied for such a permit to
benefit from an invalid ordinance change. We urge the commission to do the right thing and

My name is Nicole Crooks, and I am writing in strong opposition to FR.2. This ordinance may be
framed as a small adjustment to music exemptions, but the Language is wide open —making room
for any amplified sound to become normalized in our communities. And that is deeply concerning.
This is not hypothetical —it's my daily reality. I Live near Club E11EVEN, and I am consistently
awakened by bud construction activity at 5 a.m. nearly every weekday morning. This is happening
despite Laws that say construction shouldn't begin until after 8 a.m. If the city can't enforce the
noise protections we already have, what sense does it make to create more exemptions? In
Overtown, a venue was allowed to open against the dear objections of the community. Since then,
residents have been forced to Live with Late -night music that keeps elders from resting and children
from sleeping —despite repeated complaints and pleas for relief. This kind of unchecked noise —
whether from dubs, venues, or construction —is more than just an annoyance. It is a health issue.
Prolonged exposure to noise pollution impacts our nervous systems, increases stress and anxiety,
and chips away at our mental and physical well-being. FR.2 would make it easier for these harms
to expand across the city —and once again, it's everyday people who will bear the cost. We are not
asking for silence. We are asking for balance. For respect. For the right to rest in our homes.

"The Well" by Terra Group is being marketed as a luxury Condo with a rooftop bar and picklebalt
courts. It's located at the busy intersection of Tigertait and Mary Street, and stretches almost all
the way to 27th Avenue. It's massive!! The project wilt have 382 parking spaces for its 194 high -
end units. Are we to believe that the owners of Condos ranging from $1.5M to $4M wilt be leaving
their cars at home? If we allow Developers to take advantage of this loophole, our pedestrian,
family -friendly neighborhood wilt now be subject to towering Condos that block the sun and create
more congestion and traffic than our roads were designed to handle. We ask commissioners to
rescind this waiver, exclude the entire Grove from the bonus height loophole, and make Terra
return to its original plan of 5 floors as it is hypocritical to consider them a "Transit -Oriented"
development. Coconut Grove homeowners do not want to live in Brickelt 2.0!!!

prepares to vote on a potential 287(g) agreement with ICE, we must voice strong opposition to this
misguided proposal. This agreement would fundamentally alter the role of our local police by
deputizing them as immigration agents —a responsibility far beyond their intended purpose of
community protection. When local officers become entangled in federal immigration enforcement,
the consequences for our community are severe and far-reaching. First, these programs impose
substantial financial burdens on local taxpayers. The costs of training, implementation, and
potential litigation from civil rights violations would strain our city's already limited resources. More
critically, 287(g) agreements erode the vital trust between law enforcement and immigrant
communities. When residents fear that any police interaction could lead to deportation, they
become reluctant to report crimes or cooperate with investigations —making all Miami residents
Less safe. Evidence from other jurisdictions with similar agreements shows troubling patterns of
racial profiling and civil rights violations. These programs often lead officers to make stops and
arrests based on perceived immigration status rather than legitimate public safety concerns.
Miami's strength lies in its diversity and immigrant heritage. This agreement would betray those
values and transform our police from community guardians into agents of fear and division. I urge
our City Commissioners to reject this agreement and instead invest in policies that build trust,
enhance public safety for all residents, and honor Miami's proud immigrant tradition. Warm

I am concerned by the allowance of bonus height concessions in historic Coconut Grove. I am
grateful that the high profile Well development put the issues with this concession literally directly
in my path as I am forced to cross dangerously busy Mary street each day while waking with my
children. This development that is geared towards people able to afford 1.5 to 4 million dollar
condos will inevitably increase the congestion on this side of the Grove. According to Miami-Dade's
own public transportation ridership studies in recent years, people that can afford a home, in this
tax bracket, are using public transportation at declining rates. Literally all demographics reported
that on -time service and problems with first and last mite transport are to blame. So why would
this building and others like it qualify as transit oriented? Finally, I have grave concerns about the
information highlighted in the Coconut Grove Spotlight that explains that at the command of
Sabina Covo, the City attorney added new language to an agenda item in 2023 that enabled all of
this to be possible. This smells of corruption and cronyism and thank god the people of Miami, and
most specifically Coconut Grove are not wilting to silently let the character of our neighborhood be
sold and molded by the highest bidders.

only can the Grove not handle the congestion brought on by these massive buildings, they are not
in line with the preservation efforts of the community and its protected status The change to the T5
bonus height should have never been introduced or moved forward as it was both substantial and
material, and the public was not allowed to comment This was a dear violation of rules, which was
also addressed in Florida Supreme Court case Neumont v. State, and the commission should take
the step to immediately right a wrong by supporting PZAB's unanimous decision removing the

and developments within miami. Coconut grove in itself has charged, some for the better and
much for not. I'm pleading and requesting to please remove the t8 height for coconut grove. The
area is not suited for 8 stories. We don't need more over development. We need more trees and
parks across miami. Stop working for the developers and listen to the people who actually live in
this area.
In Florida, several cities have signed agreements for police to collaborate with ICE (Immigration
and Customs Enforcement). The 287(g) program is a federal initiative that trains police to enforce
immigration laws. However, it's essential to note that participation in this program is entirely

just administrative; it's deeply personal for many in our community. In the 1960s and 70s, U.S.
immigration policies were more inclusive. The 1965 Immigration Act prioritized family reunification,
and the 1980 Refugee Act provided protections for those fleeing persecution. Many of our families
—perhaps even yours —benefited from these policies, finding a new home and building lives here
in Miami. However, the landscape has drastically changed. The 1996 Illegal Immigration Reform
and Immigrant Responsibility Act introduced stricter enforcement and limited judicial review. Today,
asylum seekers face prolonged detentions, and legal pathways are fraught with obstacles. The
system that once welcomed many is now a labyrinth that deters and punishes. Now, consider the
current state of ICE detention centers. Reports have highlighted severe overcrowding, inadequate
medical care, and preventable deaths. For instance, the Krome Detention Center in Miami has
faced scrutiny for holding 200 individuals in a space designed for 85. Since October, three
detainees have died there, including a 44-year-old Ukrainian man in February. A comprehensive
report titled "Deadly Failures" examined 52 deaths in ICE custody between 2017 and 2021, finding
that 95% were preventable, tied directly to medical neglect and inadequate mental health care.
This doesn't make Miami safer. It makes it colder. More afraid. It silences survivors of abuse. It
fractures families. And it turns police into an arm of federal enforcement in a city where trust is

What is the benefit of this exception? It is only to benefit the developers and will not increase
public transit usage by any stretch. This project of The Well is nearly a mile from the train station
and prices are in the millions for a condo - who in that group will be taking the train a mile away
