HomeMy WebLinkAboutExhibit ACITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: Arthur Noriega V DATE: March 11, 2025 City Manager r—DS AF FROM: Andrew Frey, Director Department of Real Estate & Asset Management BACKGROUND: SUBJECT: Bid Waiver Authorization REFERENCES: N/A ENCLOSURES: N/A Miami Downtown Development Authority ("DDA"), created pursuant to laws of Fla., ch. 65-1090, currently using the Area as an autonomous agency of the City, to advocate, facilitate, plan, and execute business development, planning, capital improvements, and marketing and communication strategies. The occupant had a Lease Agreement in place with a third -party management company which was utilized by the City and is now defunct. The DDA has expressed interest in continuing occupying retail ground floor space consisting of approximately 433 Square Feet from the City of Miami ("City") for the property located at 174 E Flagler Street, Miami, Florida, 33130 ("Property") to operate an administrative office for the DDA ("Project"). It would be advantageous to the City to allow the DDA to enter into a Revocable License Agreement for the use of the Property for said Project and waive procurement requirements at this time. Approving the continuous use of the Property for the Project will allow for the DDA to continue providing services to the community and maintain a revenue stream for the City with no added time for the procurement process, which is in the City's and the greater community's best interest. RECOMMENDATION: In light of the above, DREAM respectfully requests approval of a waiver of the formal requirements of competitive sealed bidding methods as not being practical or advantageous to the City as set forth in the City Code of Ordinances, as amended, specifically Section 18-85(a), the affirmation of these written findings and the recommendation to the City Commission for ratification by a four -fifths vote.
