Public Works Purpose of Item: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE TRANSFER OF COMMUNITY DEVELOPMENT BLOCK GRANT ("CDBG") FUNDS IN THE TOTAL AMOUNT OF $1,629,040 TO THE DEPARTMENT OF RESILIENCE AND PUBLIC WORKS TO BE UTILIZED FOR STREET AND SIDEWALK IMPROVEMENTS, DRAINAGE, AND/OR ANY OTHER CDBG ELIGIBLE IMPROVEMENTS IN DISTRICT 5, AS DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, INCLUDING AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL FEDERAL, STATE AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS, FOR SAID PURPOSE. Background of Item: Pursuant to Resolution No. R-19-0501, Resolution No. R-21-0037 , and Resolution 21- 0424, adopted on December 12, 2019, January 28, 2021 and October, 14, 2021, respectively, the Miami City Commission approved the transfer of CDBG funds in the total amount of $1,629,040 to the Department of Housing and Community Development ("DHCD") for the implementation of the Single Family Rehabilitation Program in District 5. The Single -Family Rehabilitation Program has been primarily funded through the State Housing Initiative Program ("SHIP") to meet this program's annual expenditure deadline. There is a need to transfer these funds to the Department of Resilience and Public Works ("Public Works") to support street and sidewalk improvements, drainage, and/or any other CDBG eligible improvements in District 5. The City's Administration recommends the transfer of CDBG funds from DHCD in the total amount of $1,629,040.00 to the Department of Public Works for CDBG eligible improvements in District 5, as described in Exhibit "A," attached and incorporated. WHEREAS, pursuant to Resolution No. R-19-0501, Resolution No. R-21-0037 , and Resolution 21-0424, adopted on December 12, 2019, January 28, 2021 and October, 14, 2021, respectively, the Miami City Commission approved the transfer of Community Development Block Grant ("CDBG") funds in the total amount of $1,629,040.00 to the Department of Housing and Community Development ("HCD") for the implementation of the Single Family Rehabilitation Program in District 5; and WHEREAS, there is a need to re -allocate these funds in order for the City of Miami ("City") to meet its CDBG timeliness requirements by August 1, 2025; and WHEREAS, the City's Administration recommends the transfer of CDBG funds from HCD in the total amount of $1,629,040.00 to the Department of Public Works to be utilized for street and sidewalk improvements, drainage, and/or any other CDBG eligible improvements in District 5, as described in Exhibit "A," attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The transfer of CDBG funds from HCD in the total amount of $1,629,040.00 to the Department of Public Works to support street and sidewalk improvements, drainage, and/or any other CDBG eligible improvements in District 5, as described in Exhibit "A," attached and incorporated; is authorized. Section 3. The City Manager is authorized' to negotiate and execute any and all documents, including extensions, amendments, and modifications, all in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ng llf, Cty' ttor -y 3/31/2025 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
