AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
2/ARTICLE XI/DIVISION 2 OF THE CODE OF THE CITY OF MIAMI, FLORIDA,
AS AMENDED, TITLED "ADMINISTRATION/BOARDS, COMMITTEES,
COMMISSIONS/STANDARDS FOR CREATION AND REVIEW OF BOARDS
GENERALLY," TO ESTABLISH SECTION 2-896, TO BE TITLED
"APPOINTMENT OF MEMBERS," TO PROVIDE THAT THE APPOINTMENT OF
BOARD MEMBERS SHALL OCCUR ON A QUARTERLY BASIS, UNLESS
THERE IS A TIME -SENSITIVE APPOINTMENT NECESSARY, AT WHICH TIME
AN APPOINTMENT WILL BE PLACED ON THE NEXT AVAILABLE CITY
COMMISSION AGENDA; CONTAINING A SEVERABILITY CLAUSE AND
PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE.
WHEREAS, it is necessary to revise the appointment procedures for the City's boards
and committees created under the Code of the City of Miami, Florida, as amended ("City Code")
in order to provide an efficient schedule of when board member appointments shall be placed
on a City Commission agenda; and
WHEREAS, currently, board member appointments are placed on the first agenda of
each month, unless requested by an Elected Official to be placed otherwise; and
WHEREAS, in this instance, board appointments that occur on the City Commission's
first agenda of each month, impact the total number of items that may be scheduled on a
regular City Commission agenda, pursuant to Section 2-33(c)(5) of the City Code; and
WHEREAS, each month approximately twenty-three (23) items are placed on a City
Commission agenda for board member appointments, with a majority of the items continued by
the City Commission; and
WHEREAS, it is the intent of the City Commission that board member appointments
shall be placed on a City Commission agenda on a quarterly basis (March, June, September,
and December) unless there is a time -sensitive appointment needed; and
WHEREAS, should there be a time -sensitive appointment needed, such board member
appointment will be placed on the next available City Commission agenda pursuant to the
procedures for appointment of members; and
WHEREAS, the City finds that revising the appointment process for board members of
the boards and committees of the City is in the best interests of the City and its residents;
NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted and incorporated as if fully set forth in this Section.
Section 2. Chapter 2/Article XI/Division 2 of the Code of the City of Miami, Florida, as
amended, is amended in the following particulars:1

ADMINISTRATION
ARTICLE XI. BOARDS, COMMITTEES, COMMISSIONS

DIVISION 2. STANDARDS FOR CREATION AND REVIEW OF BOARDS GENERALLY
Sec. 2-896. Appointment of Members.
Unless otherwise specifically provided in the Charter or the City Code, appointment of
board members shall be placed on a City Commission agenda on a quarterly basis. The
placement shall occur on the first regular scheduled City Commission meeting for the
months of March, June, September, and December, respectively.
Section (a) above shall apply to all board member appointments, unless, a written
request is submitted to the City Clerk for a time -sensitive appointment. Should such
request be made, the board appointment shall be placed on the next available City
Commission agenda, pursuant to the procedures for appointment of members.

Section 3. If any section, part of a section, paragraph, clause, phrase or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately upon its adoption and
signature of the Mayor.2

added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.
2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
