This letter shall serve as the required letter of intent and preliminary analysis in support of an Exception and Waiver requests related to the Property. Property Description. The Property is a mid -block lot that fronts NE 25 Street, east of Biscayne Boulevard and west of Biscayne Bay. See Figure 1. Aerial, below. The Property is approximately 8,880 square feet in size and has eighty feet (80') of frontage with no rear or side access. The Applicant is proposing to develop the Property with an eight (8) story boutique hotel (the "Project"). The Project includes sixty-one (61) hotel units, with twenty (20) on -site parking spaces within the building envelope, and two (2) on -street spaces. Consistent with the City's requirements for hotel units, the units within the Project will include limited kitchen facilities.' Requests. At this time, the Applicant seeks the following Exception and Waivers: Exception: Parking Reduction. Pursuant to Article 4, Table 4 of Miami 21, as amended on April 28, 2022, in T6 Transects there are certain parking reductions available for sites not within 500 feet of an ungated T3 Transect Zone and within a TOD area or within a one -quarter mile of a Transit Corridor. The Property is within a within one -quarter mile of the Biscayne Boulevard Transit Corridor and further than 500 feet of an ungated T3 Transect Zone. Therefore, the Property is eligible for up to thirty percent (30%) reduction by process of Exception with City Commission approval. Also consistent with Article 4, Table 4, the Applicant will be paying into the Transit Enhancement Trust Fund for an additional twenty percent (20%) reduction, for a total of fifty percent (50%). Waiver: Frontage at Front Setback Section 5.6.1.e of Miami 21 requires that facades be built parallel to the principal frontage line along a minimum of seventy percent (70%) of its length on the setback line for the minimum building height. The Property faces a number of practical difficulties which result in the need for relief: 1) the existing width of the lot is less than one hundred feet (88'), 2) the Property only has a Primary Frontage, 3) there exists a functional need to provide two-way vehicular access to the site from the Primary Frontage which limits the amount of space that can practically occupied by a building. Accordingly, the Applicant respectfully requests a Waiver pursuant to 7.1.2.5a.29. to permit an up to ten percent (10%) reduction in the length of the facade along the principal frontage line. Waiver: Open Space. Section 5.6.6.b. of Miami 21 requires that Open Space shall be a minimum ten percent (10%) of the total Lot area. However, the Property faces a number of practical difficulties which result in the need for relief: 1) the existing width of the lot is less than one hundred feet (88'), 2) the Property only has a Primary Frontage. These factors combined limit the logical configuration of the lot and limit how Open Space is calculated. It should be noted that the Project does not exceed the maximum permitted lot coverage or floor area, which means that the granting of this Waiver does not permit the Project any additional building area. It should also be noted that the requested reduction of Open Space is for less than a one percent reduction (0.8%). Accordingly, the drain or trap size no larger than one one -quarter inch (11/4") in diameter; (2) stoves, ranges, ovens, or combinations will not be provided, microwave ovens will be allowed; (3) the total area for the footprint of all Limited kitchen facilities, including sink, microwave, refrigerator, and any other permitted items will not exceed 64 square feet. Design Criteria. The proposed Project complies with the Design Criteria as identified in Article 4, Table 12. The Project is an eight -story, small hotel building that responds to its lot and neighborhood context. It does not maximize its potential height or floor area: eight stories are provided where thirty-six are permitted as of right, and 50,765 square feet of floor area are provided where 106,560 square feet are possible. This is consistent with the Project's immediate context as taller buildings characterize the Biscayne Boulevard and the Biscayne Bay -fronting corridors, but projects in the eight to ten story range are more typical of the interior roadways between the two corridors. The Project's elevations are designed with architectural elements and materials that complement the principal building facade to create a cohesive architectural composition. The front facade features a unique frame design that adds visual texture and a sense of play to the building. Landscaping and hardscape materials have been selected and designed to enhance the building, and contribute to a high -quality, pedestrian -friendly streetscape within the neighborhood. Edgewater is one of the more pedestrian friendly neighborhoods within the City, and this project will contribute to its character. On -site lighting will be appropriate to the Project and will be oriented to minimize glare to the public realm and abutting properties. The Project is in harmony with the intent of the T6 transect, as described in Article 4 Table 1, which provides that the Urban Core Zone should "consist of the highest density and greatest variety of uses... with steady tree planting and Buildings set close to the Frontage with frequent doors and windows." The Project includes plantings within the first layer and has gone to great lengths to glaze and provide as much of the building at the frontage as possible. Parking and mechanical equipment are screened, and the project proposes only one driveway to reduce conflicts between pedestrian and vehicular circulation. The Exception to reduce parking will not negatively impact the neighborhood given Edgewater's transient nature, walkability, and proximity to transit. The Waivers do not impact the massing of the Project, which remains well below the maximum height and floor area. The Project's hotel use will add to the pedestrian experience and promote transit use. Conclusion. Approval of the requested Exception and Waivers will permit revitalization of the underutilized Property, in close proximity to transit. The Project is in harmony with the intent of the T6 transect as well and the Edgewater neighborhood context. Hegedus, Zoning Administrator DATE: July 28, 2014 RE: Zoning Interpretation 2014-005 This zoning interpretation is issued to clarify, interpret and regulate Limited Kitchen Facilities. Specifically, clarification is required in order to determine whether a Lodging Unit used as hotel/ condominium unit or extended stay unit can avail itself of a full Kitchen Facility. At this time, the Miami 21 Code does not provide a definition for Limited Kitchen Facilities and nor do previous Zoning Ordinances. The City has received a number of requests for clarification as to what would be considered a Limited Kitchen Facility. In order to answer this question we need to evaluate the difference between a Dwelling Unit and a Lodging Unit. Properties with Lodging Units are allowed a significant increase in density as well as significant reduction in the number of required parking spaces required. Article 3, Section 3.4.3 states that Lodging Units shall be considered as equivalent to one-half (0.50) of a Dwelling Unit; and Article 4 requires a minimum of one (1) parking space for every two (2) Lodging Units as opposed to one and one-half (1 '/2) parking spaces per Dwelling Unit. Additionally, Impact Fees are significantly lower for lodging uses. It is the intent of Miami 21 to maintain transient uses as such and assure that changes in Use are strictly documented and regulated for full compliance. Article 1.1(b) of Miami 21, the City of Miami's ("City") Zoning Ordinance states "This category is intended to encompass land Use functions predominantly of sleeping accommodations occupied on a rental basis for limited periods of time. These are measured in terms of lodging units; a lodging unit is a furnished room of a minimum of two hundred (200) square feet that includes sanitary facilities, and that may include limited kitchen facilities" An inference can be made that the kitchen serving a Lodging Unit is meant to serve for a limited period of time where it would not be necessary to prepare full course meals on a regular basis; and, in order for a kitchen to be considered a "limited kitchen facility" kitchen fixtures may be smaller, cooking appliances may be limited and the floor area may be restricted. In conclusion, a Limited Kitchen Facility prohibits the preparation of full course meals and shall follow the following criteria: (1) One small sink not exceeding fifteen inches (15") in length and width and no deeper than six inches (6"), with a drain or trap size no larger than one one -quarter inch (11/4") in diameter. (2) Stoves, ranges and ovens or a combination thereof are strictly prohibited. Microwave ovens are allowed. (3) The total area for the footprint of all Limited kitchen facilities, including sink, microwave, refrigerator, and any other permitted items may not exceed 64 square feet. No Waiver shall be permitted to alleviate this requirement. This interpretation shall be final unless appealed to the Planning, Zoning, and Appeals Board within 15 days of the date of its issuance.
