("DRG"), located Ohio is the sole source designer/developer of the TreeKeeper Inventory Management System and Services ("TreeKeeper") for the Department of Resilience and Public Works ("RPW"). The Department of Resilience and Public Works has an objective to enhance the urban forest and improve its livability. TreeKeeper will allow for diligent planning and effective management of the urban forest to optimize the long-term benefits of the City's urban forest provides while mitigating costs and risks. It will safeguard the residents of the City by delivering the essential environmental services that trees and shrubbery offer. According to DRG, it is the sole source provider of TreeKeeper. While there are tree inventory system systems on the market, TreeKeeper is the only system that uses LiDAR data to provide the most accurate up to date information for proactive management of the urban forestry. The system also has the ability to connect to the City's current Cartegraph data for easy transfer of information. The all- inclusive system provides a full spectrum of urban forestry management tools in one package, unlike any other system on the market. Accordingly, pursuant to Section 18-92 (a) (1) of the Code of the City of Miami, it is recommended that the requirements for competitive bidding be waived, and these findings be approved: DRG an Ohio for - profit company, is the sole source designer/developer, operator, service provider of the TreeKeeper Urban Forestry Management System, and approving the purchase for RPW for a term of five (5) years. RPW identified a supplier to provide an all-inclusive comprehensive system that provides a full spectrum of urban forestry management tools. TreeKeeper will allow for diligent planning and effective management of the urban forest to optimize the long-term benefits of the City's urban forest provides while mitigating costs and risks. It will safeguard the residents of the City by delivering the essential environmental services that trees and shrubbery offer. Research Conducted: Market research was conducted using various state and county contract databases to source any current contracts that the City could potentially use to piggyback or find other related vendors that could provide same to similar services. After a thorough review, the Department of Procurement ("Procurement") was unable to find any similar contracts in the databases visited. In addition to doing research on various state and county contract databases, an internet search was conducted in order to gauge the market and to verify whether there were any other companies that could provide the same or similar service as provided by DRG. However, no comparable all-inclusive contracts or products were located. Comparable Contracts: There are a number of contracts for specific aspects of the DRG software. Cities like Altamonte Springs ($6300), Sterling Heights ($9810), Los Angeles ($105,000), Oklahoma City ($2500), Des Moines ($31,000), Belmont ($20,000) and Boston ($7500). All have sole source specific items provided by DRG's tree inventory management family of products and services. Recommendation: Procurement recommends that the City use the products and services of DRG, as they are the Sole Source provider of the TreeKeeper Inventory Management Software System and Service. Procurement found that while there are other companies who provide the services of urban forestry management services, they are all a la carte with some companies not providing all the services needed by RPW. Davey Resource Group, Inc. affirms that they are the sole source manufacturer of the urban forestry resource management software, TreeKeeper, which offers a distinctive technology that visualizes 3D point clouds generated from LiDAR data, delivering precise information for urban forestry management to the City. The system's canopy integration feature also consolidates data on the urban tree canopy and the tree inventory within a unified web platform, thereby facilitating prioritized plantings based on canopy coverage and species diversity. Customization All of DRG's StoryMaps are custom in nature but we can further integrate GIS data layers into StoryMaps via API or 3rd Party links to provide a real-time data feed. For example, tree inventory data can be imported into the StoryMap for visualization and when changes are made in TreeKeeper®, they are updated within the StoryMap. DRG will not be responsible nor in any way liable for (a) any conditions not discoverable using the agreed upon means and methods used to perform the Services, (b) updating any Observational Data, (c) any changes in the Subjects after the Time of Collection (including, but not limited to, decay or damage by the elements, persons or implements; insect infestation; deterioration; or acts of God or nature [collectively, "Changes"]), (d) performing services that are in addition to or different from the originally agreed upon Services in response to Changes, or (e) any actions or inactions of you or any third party, not including any of DRG's subcontractors in connection with or in response to the Observational Data. If a visual inspection is utilized, visual inspection does not include aerial or subterranean inspection, testing, or analysis unless stated in the scope of work. When performing tree inventories or assessments, DRG will not be liable for the discovery or identification of non -visually observable, latent, dormant, or hidden conditions or hazards, and does not guarantee that Subjects will be healthy or safe under all circumstances or for a specified period of time, or that remedial treatments will remedy a defect or condition. To the extent you request DRG's guidance on your permitting and license requirements, DRG's guidance represents its recommendations based on its understanding of and experience in the industry and does not guarantee your compliance with any particular federal, state or local law, code or regulation. DRG may review information provided by or on behalf of you, including, without limitation, paper and digital GIS databases, maps, and other information publicly available or other third -party records or conducted interviews (collectively, "Source Information"). DRG assumes the genuineness of all Source Information. DRG disclaims any liability for errors, omissions, or inaccuracies resulting from or contained in any Source Information. If it is determined that DRG has breached this Limited Warranty, DRG will, in its reasonable discretion, either: (i) re -perform the defective part of the Services or (ii) credit or refund the fees paid for the defective part of the Services. This remedy will be your sole and exclusive remedy and DRG's entire liability for any breach of this Limited Warranty. You will be deemed to have accepted all of the Services if written notice of an alleged breach of this Limited Warranty is not delivered to DRG prior to the expiration of the Warranty Period. RPW identified a supplier to provide an all-inclusive comprehensive system that provides a full spectrum of urban forestry management tools. TreeKeeper will allow for diligent planning and effective management of the urban forest to optimize the long-term benefits of the City's urban forest provides while mitigating costs and risks. It will safeguard the residents of the City by delivering the essential environmental services that trees and shrubbery offer. Research Conducted: Market research was conducted using various state and county contract databases to source any current contracts that the City could potentially use to piggyback or find other related vendors that could provide same to similar services. After a thorough review, the Department of Procurement ("Procurement") was unable to find any similar contracts in the databases visited. In addition to doing research on various state and county contract databases, an internet search was conducted in order to gauge the market and to verify whether there were any other companies that could provide the same or similar service as provided by DRG. However, no comparable all-inclusive contracts or products were located. Comparable Contracts: There are a number of contracts for specific aspects of the DRG software. All have sole source specific items provided by DRG's tree inventory management family of products and services.
