Property Address: 2222 NW 5th Avenue, Miami, FL 33127 NOTICE OF APPEAL Please be advised that undersigned, Greenspoon Marder, LLP represents BILL'S NURSERY, INC., (the "Applicant"), in connection with Applicant's request for a Certificate of Use as a medical marijuana dispensing facility at the above referenced Property Address. On July 6th, 2022 the denial of the requested Certificate of Use application, PZAB-R-22-018, was affirmed by the Planning, Zoning and Appeals Board on the grounds of the City of Miami lacking an ordinance permitting said use. First, there is no prohibition against medical marijuana dispensing facilities in Miami 21 or any other City enactments. This is further evidenced by Resolution R-22-0178, adopted on May 12th, 2022, where the City of Miami Commission reversed the denial of the Certificate of Use for a Cannabis Dispensary and/or Clinic of a separate applicant. Further, the subject property is located in Transect T6-12- 0, which permits General Commercial uses by right including but not limited to pharmacies. The office of zoning is required to base its decision solely on the relevant City of Miami legislative enactments, i.e. Miami 21. Therefore, BILL'S NURSERY, INC., appeals the denial of the requested Certificate of Use, PZAB- R-22-018, to the City of Miami City Commission as the use is permitted pursuant to Miami 21 (Art. 4, Table 3); Sec. 381.986, Florida Statutes; and Art. 10, Sec. 29, Florida Constitution (2016).
