Staff Report and Business Impact Statement
Purpose:
The proposed ordinance will provide various updates and clarifications to Miami Zoning Code
regarding "T3" Transect Zone Sub -Urban Transect Zones, a new Portico definition, and a new
Waiver for additional height for raised decks where there is an atypical geographical elevation
change. The updates and clarifications to the T3 Transect Zone 'Sub -Urban Transect Zones' include
regulations relating to height, ingress vehicle control devices, raised decks, Freeboard, Porches,
rear encroachments, setbacks, driveways standards, fences, parking placement, and landscape
standards.
The public purposed to be served by the proposed ordinance include enhanced clarity of and
compliance with the Code, consistency in Sub -Urban development, practical solutions for atypical
geographical conditions, improved public safety and accessibility, and enhanced community
aesthetics. Overall, the ordinance aims to create a more organized, safe, and visually appealing
Sub -Urban environment.
Estimated Direct Economic Impact:
• The proposed ordinance, if enacted, will not result in direct compliance costs for
businesses*;
• The proposed ordinance will not result in any new charge or fee on businesses subject to
the proposed ordinance, or for which businesses will be financially responsible*; and
• There will be no additional municipal regulatory costs for businesses*.
* Costs, charges and/or fees associated with proposed Waiver for additional height for
raised decks where there is an atypical geographical elevation change will apply to owners
of certain "T3" Sub -Urban properties.
