A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A SHELTER
PROGRAM AGREEMENT BETWEEN THE CITY OF MIAMI ("CITY") AND MIAMI-
DADE COUNTY HOMELESS TRUST ("PROVIDER") ("SHELTER PROGRAM
AGREEMENT"), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THE
IMPLEMENTATION OF THE MIAMI SHELTER PROGRAM FOR FISCAL YEAR 2024-
2025 WHICH WILL PROVIDE UP TO TWO -HUNDRED THIRTEEN (213) EXTENDED
STAY SHELTER BEDS AND ASSOCIATED SERVICES TO SUPPORT HOMELESS
INDIVIDUALS WITHIN THE CITY OF MIAMI; APPROPRIATING FUNDS IN AN
AMOUNT NOT TO EXCEED TWO MILLION, SEVENTY-EIGHT THOUSAND, SIX
HUNDRED SEVENTY-FIVE AND 00/100 DOLLARS ($2,078,675.00) FROM THE
MAYOR'S SHARE OF THE CITY'S MIAMI FOR EVERYONE ("MFE") HOMELESS
FUNCTIONAL ZERO PROGRAM FOR THE MIAMI SHELTER PROGRAM ("MFE
FUNDS"), AND FURTHER APPROPRIATING FUNDS FROM THE DEPARTMENT OF
HUMAN SERVICES OPERATING BUDGET ACCOUNT
(00001.450000.534000.0000.00000) IN AN AMOUNT NOT TO EXCEED FIVE

FUNDS"), FOR A TOTAL NOT TO EXCEED AMOUNT OF TWO MILLION, SEVENTY-

($2,638,675.00) FOR THE IMPLEMENTATION OF THE MIAMI SHELTER PROGRAM;
FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A
GRANT FUNDING AGREEMENT WITH THE PROVIDER, IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, FOR THE ALLOCATION, APPROPRIATION, AND
DISBURSEMENT OF THE MFE FUNDS AND THE GRANT FUNDS; AUTHORIZING
THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY NECESSARY
AMENDMENTS, EXTENSIONS, OR MODIFICATIONS TO THE AGREEMENT, ALL IN
FORMS ACCEPTABLE TO THE CITY ATTORNEY; AND PROVIDING FOR AN

FORMS ACCEPTABLE TO THE CITY ATTORNEY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on April 13, 2023, pursuant to Resolution No. R-23-0178, the City of Miami
("City") created the Miami For Everyone ("MFE") Program to assist communities facing the long-
term complications resulting from declared emergencies and to address the specific needs of
the most vulnerable residents and businesses, through a strategy of focusing the provision of
support towards priority areas of need that will further stabilize economic conditions within City
districts; and
WHEREAS, the City remains committed to addressing homelessness and ensuring the
availability of shelter beds for homeless individuals within the City's jurisdictional boundaries;
and
WHEREAS, the Miami -Dade County Homeless Trust ("Provider") has access to
emergency shelter beds that can be designated for the City's homeless population; and
WHEREAS, the Provider submitted a MFE grant application, attached and incorporated
as Exhibit "A," in order to continue providing its supportive shelter program ("Project"); and
WHEREAS, the Mayor wishes to provide grant funds from the Mayor's share of the
City's MFE Program Homeless Functional Zero allocation in an amount not to exceed Two
Million, Seventy -Eight Thousand, Six Hundred Seventy -Five and 00/100 Dollars ($2,078,675.00)
("MFE Funds") for the Project; and
WHEREAS, the City Manager wishes to provide funds from the Department of Human
Services General Fund, Account No. 00001.450000.534000.0000.00000, in a total amount of
Five Hundred Sixty Thousand and 00/100 Dollars ($560,000.00) ("Grant Funds") to assist in
funding the Project; and
WHEREAS, MFE Funds and Grants Funds awarded for the Project are in a combined
total amount not to exceed Two Million, Six Hundred Thirty -Eight Thousand, Six Hundred
Seventy -Five and 00/100 Dollars ($2,638,675.00); and
WHEREAS, the City and Provider agree to implement a Shelter Program ("Miami Shelter
Program"), which will provide up to two -hundred thirteen (213) emergency shelter beds
("Extended Stay Beds") and related services for the use of homeless individuals placed by the
City's Department of Human Services' Homeless Outreach Team and the Miami Police
Department; and
WHEREAS, the Shelter Program will comply with the standards of dignity, respect, and
accessibility outlined in the spirit of the Pottinger Settlement Agreement, ensuring no involuntary
religious requirements or mandated treatment as a condition for shelter; and
WHEREAS, the City Commission has appropriated funding in an amount not to exceed
Two Million, Six Hundred Thirty -Eight Thousand, Six Hundred Seventy -Five and 00/100 Dollars
($2,638,675.00) to be paid in arrears based on monthly reporting and invoicing, as further
detailed in the Shelter Program Agreement between the City and the Provider ("Shelter Program
Agreement"); and
WHEREAS, the City Manager requests the authority to negotiate and execute the
Shelter Program Agreement and the Grant Funding Agreement, along with any necessary
amendments, extensions, or modifications, to ensure the ongoing operation of the Miami Shelter
Program for Fiscal Year 2024-2025;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to negotiate and execute the Shelter
Program Agreement between the City and the Miami -Dade County Homeless Trust, in a form
acceptable to the City Attorney, for the implementation of the Miami Shelter Program for Fiscal
Year 2024-2025.
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
Section 3. The City Manager is further authorized' to allocate the MFE Funds from the
Mayor's share of the City's MFE Program to the Miami -Dade County Homeless Trust for the
Project.
Section 4. The City Manager is further authorized1 to allocate the Grant Funds from the
Department of Human Services General Fund, Account No. 00001.450000.534000.0000.00000
to the Miami -Dade County Homeless Trust for the Project.
Section 5. The Miami Shelter Program shall provide up to two hundred thirteen (213)
Extended Stay Shelter Beds, exclusively designated for homeless individuals within the City of
Miami, as defined in the Shelter Program Agreement, with associated services including case
management and other homeless services.
Section 6. The City Manager is further authorized' to negotiate and execute a Grant
Funding Agreement with the Provider, in a form acceptable to the City Attorney, for the
allocation, appropriation, and disbursement of the MFE Funds and the Grant Funds.
Section 7. The City Manager is further authorized' to negotiate and execute any and all
other documents necessary, including any modifications, extensions, and amendments, all in
forms acceptable to the City Attorney, for said purpose.
Section 8. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
