HomeMy WebLinkAboutR-25-0003City of Miami Resolution R-25-0003 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16976 Final Action Date: 1/23/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE MUTUAL AID AGREEMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND THE SCHOOL BOARD OF MIAMI-DADE COUNTY, CITY OF DORAL, CITY OF HIALEAH GARDENS, MIAMI-DADE COUNTY, VILLAGE OF MIAMI SHORES, CITY OF MIAMI SPRINGS, BAL HARBOUR VILLAGE, VILLAGE OF KEY BISCAYNE, TOWN OF SURFSIDE, BAY HARBOR ISLANDS, INDIAN CREEK VILLAGE, VILLAGE OF VIRGINIA GARDEN, AND THE CITY OF SUNNY ISLES TO RECEIVE AND EXTEND MUTUAL AID IN THE FORM OF LAW ENFORCEMENT SERVICES AND RESOURCES TO ENSURE PUBLIC SAFETY AND ABILITY TO ADEQUATELY RESPOND TO INTENSIVE SITUATIONS, INCLUDING BUT NOT LIMITED TO NATURAL AND MAN-MADE DISASTERS OR EMERGENCIES AS DEFINED IN PART 1, CHAPTER 23, FLORIDA STATUTES, THE "FLORIDA MUTUAL AID ACT." WHEREAS, there are natural and man-made challenges faced by the City of Miami's ("City") Police Department ("MPD") and other local municipal police departments that are, or are likely to be, beyond the control of the services, personnel, equipment, or facilities of MPD or other local municipal police departments; and WHEREAS, the City and the School Board of Miami -Dade County, City of Hialeah Gardens, Miami -Dade County, City of Doral, Village of Miami Shores, City of Miami Springs, Bal Harbour Village, Village of Key Biscayne, Town of Surfside, Bay Harbor Island, Indian Creek Village, Village of Virginia Garden and the City of Sunny Isles (collectively, the "Participating Municipalities") wish to enter into a Mutual Aid Agreement ("MAA") to ensure that preparation and resources from each Participating Municipalities' respective law enforcement agency will be adequate to address natural and man-made challenges, protect public peace and safety, and to preserve the lives and property of the people of the City and the Participating Municipalities; and WHEREAS, the City and the Participating Municipalities have the authority under the Florida Mutual Aid Act, Chapter 23, Part 1, Sections 23.12-23.127, Florida Statutes, to enter into mutual aid agreements; and WHEREAS, City and the Participating Municipalities have the authority under the Florida Interlocal Cooperation Act of 1969, promulgated under Section 163.01, Florida Statutes, to enter into interlocal agreements for the purposes of permitting local governmental units to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and thereby to provide services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic population, and other factors influencing the needs of the local communities; City of Miami Page 1 of 2 File ID: 16976 (Revision:) Printed On: 8/12/2025 File ID: 16976 Enactment Number: R-25-0003 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute the MAA, in substantially the attached form, with the Participating Municipalities to receive and extend mutual aid in the form of law enforcement services and resources to ensure public safety and the ability to adequately respond to intensive situations, including but not limited to natural or manmade disasters or emergencies as defined in Chapter 23, Part 1, Florida Statutes. Section 3. This Resolution shall become effective immediately upon its adoption.
