R-24- 0138 OF THE MIAMI CITY COMMISSION; ALLOCATING FUNDS FROM THE APPROPRIATE FEDERAL, STATE, LOCAL, AND DISTRICT 4 FUTURE PROJECT BUDGETS, SUBJECT TO BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE THE AGREEMENT WITH DMSI, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO PROVIDE DESIGN -BUILD SERVICES FOR THE PROJECT; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND EXTENSIONS SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS AND BUDGETARY APPROVALS HAVING BEEN PREVIOUSLY MADE, COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ("CITY CODE"), INCLUDING, THE CITY OF MIAMI'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH City of Miami Page 1 of 3 File ID: 17014 (Revision:) Printed On: 8/12/2025 File ID: 17014 Enactment Number: R-24-0504 ALL APPLICABLE LAWS, RULES AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. SPONSOR(S): Commissioner Manolo Reyes, Commissioner Christine King WHEREAS, on April 5, 2024, the Department of Procurement ("Procurement") issued Request for Proposals ("RFP") No. 23-24-025 to provide design -build services for Auburndale flood mitigation improvements - D4 ("Project"); and WHEREAS, on May 20, 2024, three (3) proposals were received in PeriscopeS2G in response to the RFP, and subsequently, one (1) proposal was found to be non -responsive to the Minimum Qualification Requirements of the RFP, after Procurement completed its due diligence effort; and WHEREAS, on July 24, 2024 (Step 1) and September 4, 2024 (Step 2), an Evaluation Committee met and completed the evaluation of the remaining two (2) proposals submitted by responsive and responsible proposers, following the guidelines stipulated in the RFP, finding DMSI to be the top ranked responsive and responsible Proposer; and WHEREAS, on September 25, 2024, a Negotiation Committee appointed by the City Manager met and conducted negotiations through November 14, 2024; and WHEREAS, the contract terms and conditions negotiated and agreed upon by DMSI were formally accepted by the City on or about November 18, 2024; and WHEREAS, the City Manager requests authorization to execute an Agreement with DMSI, for $67,100,000.00, including $11,304,472.59 for Phase 1, consisting of $9,776,793.26 for Section 2-City, $500,000.00 for City of Miami Project No. B-173655, and $1,027,679.33 for a 10% Owner's Contingency Allowance (collectively "Phase 1") and $55,795,527.41 for subsequent phases to be determined as funding becomes available, including $12,936,649.26 for Section 1, $4,018,624.53 for Section 2-Miami-Dade County Water and Sewer Department ("WASD"), $19,754,015.81 for Section 3, $13,513,917.14 for Section 4, $500,000.00 for Right Of Way Enhancement Option at Southwest 36th Avenue, and $5,072,320.67 for a 10% Owner's Contingency (collectively "Subsequent Phases"), on a phased basis and subject to availability of funds; and WHEREAS, funds are to be allocated from the appropriate federal, state, local, and District 4 future project budgets; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The proposal received on May 20, 2024, from DMSI, the top ranked and responsible Proposer, pursuant to RFP No. 23-24-025, to provide design -build services for the Project, for $67,100,000.00, including Phase 1 and Subsequent Phases, on a phased basis and subject to availability of funds, is accepted. Section 3. The requirements of Resolution No. R-24-0138 of the Miami City Commission are hereby waived by an affirmative vote of three or more City Commissioners. Funds are to be allocated from the appropriate federal, state, local, and District 4 future project budgets. Section 5. The City Manager is authorized to negotiate and execute the Agreement with DMSI, in a form acceptable to the City Attorney, for design -build services for the Project, consisting of Phase 1 and Subsequent Phases, with each phase subject to availability of funds. Section 6. The City Manager is further authorized' to negotiate and execute all other documents, including any amendments, renewals, and extensions, subject to all allocations, appropriations, and prior budgetary approvals, and in compliance with all applicable provisions of the Code of the City of Miami, Florida, as amended ("City Code"), including the City of Miami's Procurement Ordinance, Anti -deficiency Act, and financial integrity principles, all as set forth in Chapter 18 of the City Code, all in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose.
