A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING, AUTHORIZING, AND DIRECTING THE CITY MANAGER TO
UNDERTAKE THIS AMENDMENT IN ORDER TO ADD TO AND TO REVISE
CAPITAL PROJECTS IN THE CITY OF MIAMI'S ("CITY") FISCAL YEAR 2024-
2025 MULTI -YEAR CAPITAL PLAN ADOPTED ON SEPTEMBER 7, 2024,
PURSUANT TO RESOLUTION NO. R-24-0328 ("ADOPTED CAPITAL PLAN"),
AS SUBSEQUENTLY AMENDED, AND TO APPROPRIATE FUNDING FOR
ADDED PROJECTS IN ACCORDANCE WITH EXHIBIT "A," ATTACHED AND
INCORPORATED; RATIFYING, APPROVING, AND CONFIRMING CERTAIN
NECESSARY ACTIONS BY THE CITY MANAGER AND DESIGNATED CITY
OFFICIALS AND DEPARTMENTS IN ORDER TO UPDATE THE RELEVANT
FINANCIAL CONTROLS AND COMPUTER SYSTEMS IN CONNECTION
THEREWITH FOR ONGOING CAPITAL PROJECTS, PROJECT CLOSE-OUTS,
AND FOR GRANTS AND OTHER FUNDING SOURCES IN PROGRESS IN
CONNECTION HEREWITH; PROVIDING AN EFFECTIVE DATE.
WHEREAS, on March 31, 2022, the Citizens' Independent Transportation Trust ("CITT")
adopted CITT Resolution No. 22-006 instructing the Office of the Citizens' Independent
Transportation Trust ("OCITT") to withhold Surtax funds from the City and to recapture said
funds should the City fail to adequately address concerns raised in the most recent audit of the
City by the County Audit and Management Services Department ("AMS") in a timely and
satisfactory manner; and
WHEREAS, on April 5, 2022, the OCITT transmitted to the City a copy of the rendered
CITT Resolution No. 22-006 along with a letter stating that the OCITT had immediately
commenced withholding Surtax funds from the City; and
WHEREAS, on September 25, 2024, the CITT adopted CITT Resolution 24-022
authorizing the OCITT to discontinue the withholding of Charter County Transportation Surtax
("Surtax") Funds from the City of Miami, and to release any previously withheld Surtax Funds,
upon the City and OCITT's mutual agreement on an enhanced reporting, monitoring and
milestone plan for the timely and satisfactory expenditure of the City's Surtax Funds; and
WHEREAS, the City and OCITT have come to a mutual agreement on an enhanced
reporting, monitoring and milestone plan for the timely and satisfactory expenditure of the City's
surtax funds; and
WHEREAS, pursuant to representations made by the OCITT, the City anticipates it will
receive the Surtax funds before the end of the 2024 Calendar Year; and

WHEREAS, on November 19, 2024, the OCITT notified that City that OCITT was
transferring an amount not to exceed $75,583,814.72 in previously withheld Surtax funds with
interest to the City pursuant to CITT Resolution No. 24-022; and
WHEREAS, except for such changes as set forth herein, all previous appropriations
remain authorized to continue as previously approved City of Miami ("City") capital projects
(new, revised, and continued projects collectively, "Projects") according to the Fiscal Year 2024-
2025 Multi -Year Capital Plan adopted on September 7, 2024 pursuant to Resolution No. R-24-
0328, as subsequently amended ("Adopted Capital Plan"); and
WHEREAS, as set forth in the Capital Budget Amendment, attached and incorporated
as Exhibit "A," it is necessary to approve additional appropriations to the Adopted Capital Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby approves, directs, and authorizes' the City
Manager to add capital projects to the Adopted Capital Plan, revise current appropriations
among approved projects and appropriate funding for existing projects, all as set forth in Exhibit
"A," attached and incorporated.
Section 3. Certain necessary actions by the City Manager and designated City officials
and departments made in order to update the City's relevant financial controls and computer
systems for ongoing capital projects, project close-outs, and for grants and other funding
sources in progress in connection with the Adopted Capital Plan, the Capital Budget
Amendment, attached and incorporated as Exhibit "A," and the City's Final Operating Budget,
as amended, to implement the Projects in connection herewith are ratified, approved, and
confirmed.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature by the Mayor.2

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
