HomeMy WebLinkAboutR-24-0494City of Miami Resolution R-24-0494 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16912 Final Action Date: 12/12/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING A SUBSTANTIAL AMENDMENT TO THE CITY OF MIAMI'S ("CITY") ANNUAL ACTION PLAN FOR FISCAL YEAR ("FY") 2021-2022, TO REFLECT THE MODIFICATIONS TO THE HOME INVESTMENT PARTNERSHIPS AMERICAN RESCUE PLAN PROGRAM ("HOME -ARP") ALLOCATION PLAN, ATTACHED AND INCORPORATED AS EXHIBIT "A"; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, INCLUDING AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY TO SUBMIT THE SUBSTANTIAL AMENDMENT TO THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT ("HUD") FOR APPROVAL. WHEREAS, on April 28, 2021, pursuant to Resolution No. R-21-0261, the Miami City Commission approved a special allocation of Home Investment Partnerships -American Rescue Plan ("HOME -ARP") funds in the total amount of $12,720,427.00 to provide homeless assistance and supportive services for eligible households experiencing the greatest risk of housing instability; and WHEREAS, pursuant to Resolution No. R-21-0310, adopted on July 22, 2021, the Miami City Commission approved the City of Miami's ("City") Annual Action Plan for Fiscal Year (FY") 2021-2022 ("Annual Action Plan"); and WHEREAS, on September 19, 2023, Miami -Dade Homeless Trust ("Homeless Trust") entered into a purchase and sale agreement with Cutler Bay Lodging LLC, a Florida limited liability company, with the plans to convert La Quinta Hotel located at 10821 Caribbean Blvd, Cutler Bay, Florida ("Property"), into a permanent housing for persons experiencing homelessness ("Project"); and WHEREAS, in July 2024, the Homeless Trust submitted an application to the City of Miami ("City"), requesting eight million dollars ($8,000,000.00) in HOME -ARP funds for the acquisition of the Property, which has a total purchase price of fourteen million dollars ($14,000,000.00), of which the Homeless Trust will pay the balance of the remaining six million dollars ($6,000,000.00) using an allocation of Miami Dade County general fund revenues, approved by the Miami -Dade County Board of County Commissioners as part of their FY 2022- 2023 budget; and WHEREAS, the Project will provide one hundred seven (107) permanent supportive housing for elderly persons experiencing homelessness of which fifty-seven (57) units will be City of Miami -designated, with a preference for homeless, elderly populations, as defined in the 24 CFR 91.5 Homeless (1), (2), (3) as per HOME -ARP Qualifying Populations ("QPs1") and the City of Miami Page 1 of 2 File ID: 16912 (Revision:) Printed On: 8/12/2025 File ID: 16912 Enactment Number: R-24-0494 Project will be open to all four Qualifying Populations ("QPs,") as defined in HUD CPD Notice 21-10 IV. A; and WHEREAS, the Department of Housing and Community Development ("HCD") has to make a Substantial Amendment to its Annual Action Plan FY 2021-2022 to reflect changes to the HOME -ARP allocation plan and provide residents with reasonable notice and an opportunity to comment on the proposed HOME -ARP allocation plan of no less than 15 calendar days; and WHEREAS, the City's Administration recommends the approval of the Substantial Amendment to the City of Miami's Annual Action Plan for FY 2021-2022, as indicated in Exhibit "A," attached, and incorporated, to reflect the changes to the HOME -ARP allocation plan to the United Sates Department of Housing and Urban Development ("HUD"); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City's Substantial Amendment to the Annual Action Plan for FY 2021- 2022, attached and incorporated, is approved. Section 3. The City Manager is authorized' to execute the necessary documents, in a form acceptable to the City Attorney, as may be necessary to submit the Substantial Amendment to HUD, for approval. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: rge ng IIR, C ty htto`rjey j 12/3/2024 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
