HomeMy WebLinkAboutPre-LegislationCity of Miami Legislation Resolution: R-21-0261 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 9054 Final Action Date: 6/24/2021 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING A SPECIAL GRANT ALLOCATION FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT OF HOME INVESTMENT PARTNERSHIPS-AMERICAN RESCUE PLAN ACT OF 2021 FUNDS IN THE AMOUNT OF $12,720,427.00 ("FUNDS"); ALLOCATING THE FUNDS AS MORE PARTICULARLY SPECIFIED IN EXHIBIT "A," ATTACHED AND INCORPORATED, TO PROVIDE HOMELESS ASSISTANCE AND SUPPORTIVE SERVICES FOR ELIGIBLE HOUSEHOLDS EXPERIENCING THE GREATEST RISK OF HOUSING INSTABILITY; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS INCLUDING AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS. WHEREAS, on April 28, 2021, the Department of Housing and Community Development ("HOD") received a letter from United States Department of Housing and Urban Development ("HUD") announcing a special allocation of Home Investment Partnerships -American Rescue Plan ("HOME -ARP") funds to be granted to the City of Miami ("City") in the total amount of $12,720,427.00 ("Funds"); and WHEREAS, these allocations were authorized by the American Rescue Plan Act of 2021 Public Law 117-2 ("ARP"), which was signed by President Joseph R. Biden on March 11, 2021; and WHEREAS, the Funds must be used for individuals or families from the following qualifying populations: homeless, at -risk of homelessness, fleeing or attempting to flee domestic violence, dating violence, sexual assault, stalking, human trafficking, other populations where providing assistance would prevent the family's homelessness or would serve those with the greatest risk of housing instability, and veterans and families that include a veteran family member that meet one of the preceding criteria; and WHEREAS, the City's Administration recommends the acceptance and the allocation of the Funds as specified in Exhibit "A," attached and incorporated, to provide homeless assistance and supportive services for eligible households experiencing the greatest risk of housing instability; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The acceptance of a special grant allocation from HUD of HOME -ARP Funds and the allocation of the Funds as more particularly specified in Exhibit "A," attached and incorporated, to provide homeless assistance and supportive services for eligible households experiencing the greatest risk of housing instability is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents including amendments, extensions, and modifications, all in forms acceptable to the City Attorney, for said purpose, subject to all federal, state, and local laws that regulate the use of such funds. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, City 'ttor ey 6/11/2021 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. City of Miami Page 2 of 2 File ID: 9054 (Revision:) Printed on: 12/13/2021 City of Miami Legislation Resolution: R-21-0310 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 9118 Final Action Date: 7/22/2021 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE CITY OF MIAMI'S ANNUAL ACTION PLAN FOR FISCAL YEAR ("FY") 2021-2022, ATTACHED AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO SUBMIT THE ANNUAL ACTION PLAN FOR FY 2021- 2022 TO THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR REVIEW AND APPROVAL; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, pursuant to the Code of Federal Regulations 24 CFR 91.220, all entitlement jurisdictions are required to submit an Annual Action Plan ("Plan") to the United States Department of Housing and Urban Development ("HUD") for the purpose of carrying out long term strategic plans; and WHEREAS, the Plan sets forth the overall goals and objectives of the City of Miami's ("City") Consolidated Plan; and WHEREAS, the Plan must be submitted to the local HUD field office forty-five (45) days before the beginning of the Fiscal Year ("FY"), which is August 15, 2021; and WHEREAS, the City's Administration recommends the approval of the Plan for FY 2021- 2022; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City's Plan for FY 2021-2022, attached and incorporated as Exhibit "A", is approved. Section 3. The City Manager is authorized1 to submit the Plan for FY 2021-2022 to HUD for review and approval. Section 4. The City Manager is authorized' to negotiate and execute any and all necessary documents, all in forms acceptable to the City Attorney, for said purpose. 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions.
