Background of Item: On April 28, 2021, pursuant to Resolution No. 21-0261 the Miami City Commission approved a special allocation of Home Investment Partnerships -American Rescue Plan ("HOME -ARP") funds in the total amount of $12,720,427.00 to provide homeless assistance and supportive services for eligible households experiencing the greatest risk of housing instability. Pursuant to Resolution No. 21-0310 adopted on July 22, 2021, the Miami City Commission approved the City of Miami's Annual Action Plan FY 2021-2022. On September 19, 2023, Miami -Dade Homeless Trust ("Homeless Trust") entered into a purchase and sale agreement with Cutler Bay Lodging LLC, a Florida limited liability company with the plans to convert La Quinta Hotel ("Property") located at 10821 Caribbean Blvd, Cutler Bay, Florida, into permanent housing for persons experiencing homelessness ("Project"). On November 7, 2023, the Homeless Trust submitted an application to the City of Miami, requesting Eight Million Dollars ($8,000,000.00) in HOME -ARP funds for the acquisition of the "Property". The City funds will be part of the Fourteen Million Dollars ($14,000,000.00) purchase price. The "Project" will provide 107 permanent supportive housing which includes 57 units to the City of Miami, with a preference for homeless population, as defined in 24 CFR 91.5 Homeless (1), (2), (3) as per HOME -ARP Qualifying Populations ("QP1"). The Department of Housing and Community Development ("HCD") has to make a Substantial Amendment to its Annual Action Plan FY 2021-2022 to reflect changes to the HOME -ARP allocation plan and provide residents with reasonable notice and an opportunity to comment on the proposed HOME -ARP allocation plan of no less than 15 calendar days. The City's Administration recommends the approval of the Substantial Amendment to the City of Miami's Annual Action Plan for FY 2021-2022, as indicated in Exhibit "A," attached, and incorporated, to reflect changes to the HOME Investment Partnership American Rescue Plan program ("HOME -ARP") allocation plan to HUD. A; and WHEREAS, the Department of Housing and Community Development ("HCD") has to make a Substantial Amendment to its Annual Action Plan FY 2021-2022 to reflect changes to the HOME -ARP allocation plan and provide residents with reasonable notice and an opportunity to comment on the proposed HOME -ARP allocation plan of no less than 15 calendar days; and WHEREAS, the City's Administration recommends the approval of the Substantial Amendment to the City of Miami's Annual Action Plan for FY 2021-2022, as indicated in Exhibit "A," attached, and incorporated, to reflect the changes to the HOME -ARP allocation plan to the United Sates Department of Housing and Urban Development ("HUD"); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City's Substantial Amendment to the Annual Action Plan for FY 2021- 2022, attached and incorporated, is approved. Section 3. The City Manager is authorized' to execute the necessary documents, in a form acceptable to the City Attorney, as may be necessary to submit the Substantial Amendment to HUD, for approval. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: rge ng11I, C ty' ttor -y 12/3/2024 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
