A RESOLUTION OF THE MIAMI CITY COMMISSION, ACCEPTING THE BID
RECEIVED ON AUGUST 27, 2024, FROM FLORIDA ENGINEERING AND
DEVELOPMENT CORP. ("FED"), THE SOLE RESPONSIVE AND RESPONSIBLE
BIDDER, PURSUANT TO INVITATION TO BID ("ITB") NO. 23-24-034 TO PROVIDE
CONSTRUCTION SERVICES FOR NORTHWEST 13TH STREET IMPROVEMENTS -
D1, PROJECT NO. 40-B50104 ("PROJECT"), FORA TOTAL CONTRACT AWARD
VALUE OF TWO MILLION TWO HUNDRED EIGHTY-SIX THOUSAND ONE
HUNDRED EIGHTY DOLLARS AND SIXTY CENTS ($2,286,180.60); ALLOCATING
FUNDS FROM THE DEPARTMENT OF RESILIENCE AND PUBLIC WORKS ("RPW')
PROJECT NO. 40-B50104; AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE AN AGREEMENT WITH FED, IN A FORM ACCEPTABLE TO THE

AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, AND
EXTENSIONS, SUBJECT TO ALLOCATIONS, APPROPRIATIONS, AND
BUDGETARY APPROVALS HAVING BEEN PREVIOUSLY MADE, AND IN
COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), INCLUDING, THE CITY'S
PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL
INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY
CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE
WITH APPLICABLE REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID

INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY
CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE
WITH APPLICABLE REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID
PURPOSE.
WHEREAS, on July 5, 2024, the Department of Procurement ("Procurement"), on behalf
of Department of Resilience and Public Works ("RPW'), issued Invitation to Bid ("ITB") No. 23-
24-034 for construction services for Northwest 13th Street Improvements - D1, Project No. 40-
B50104 ("Project") under full and open competition to procure construction services; and
WHEREAS, one (1) bid was received on August 27, 2024, in response to the ITB; and
WHEREAS, Florida Engineering and Development Corp. ("FED") was deemed to be the
sole responsive and responsible bidder; and
WHEREAS, the City Manager requests authorization to negotiate and execute an
agreement ("Agreement"), in a form acceptable to the City Attorney, with FED for a total contract
value of Two Million Two Hundred Eighty -Six Thousand One Hundred Eighty Dollars and Sixty
Cents ($2,286,180.60), which includes One Million Four Hundred Twenty -Eight Thousand Two
Hundred Eighty -Two Dollars and Ninety Cents ($1,428,282.90) for the Scope of Work of the City
of Miami's ("City") portion, plus One Hundred Forty -Two Thousand Eight Hundred Twenty -Eight
Dollars and Twenty -Nine Cents ($142,828.29) for an Owner's Contingency Allowance; Six
Hundred Nine Thousand Four Hundred Forty -One Dollars and Ninety -Five Cents ($609,441.95)
for the Scope of Work of the Water and Sewer Department's ("WASD") portion, plus Sixty
Thousand Nine Hundred Forty -Four Dollars and Twenty Cents ($60,944.20) for an Owner's
Contingency Allowance, plus Twenty -Six Thousand Four Hundred Dollars ($26,400.00) for a
Dedicated Allowance for off -duty police officers for the purpose of maintenance of traffic, plus
Eighteen Thousand Two Hundred Eighty -Three Dollars and Twenty -Six Cents ($18,283.26) for
a Dedicated Allowance for permits, fees, inspections, and impact fees; and
WHEREAS, funds in the amount of Two Million Two Hundred Eighty -Six Thousand One
Hundred Eighty Dollars and Sixty Cents ($2,286,180.60) are to be allocated from RPW Project
No. 40-B50104; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The bid received on August 27, 2024, from FED, the sole responsive and
responsible bidder, pursuant to ITB No. 23-24-034 for Northwest 13th Street Improvements -
D1, Project No. 40-B50104, in the amount of $2,286,180.60, is accepted.
Section 3. The City Manager is authorized' to negotiate and execute an Agreement with
FED, in a form acceptable to the City Attorney.
Section 4. Funds to be allocated from RPW Project No. 40-B50104.
Section 5. The City Manager is further authorized' to negotiate and execute any and all
other documents, including any amendments and extensions, subject to allocations,
appropriations, and prior budgetary approvals, and compliance with all applicable provisions of
the City Code, including, the City's Procurement Ordinance, Anti -deficiency Act, and Financial
Integrity Principles, all as set forth in Chapter 18 of the Code of the City of Miami, Florida, as
amended, in a form acceptable to the City Attorney, and in compliance with applicable
regulations, as may be deemed necessary for said purpose.
Section 6. This Resolution shall become effective immediately upon its adoption.
