HomeMy WebLinkAboutR-24-0486City of Miami Resolution R-24-0486 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16951 Final Action Date: 12/12/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION PURSUANT TO SECTION 18-113 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), APPROVING AND AUTHORIZING THE ACCESSING OF ALL COMPETITIVELY SOLICITED AND AWARDED CONTRACTS AVAILABLE VIA GOVMVMT, A PUBLIC PROCUREMENT PROGRAM LAUNCHED BY THE NONPROFIT INNOVATIVE GOVERNMENT SERVICES ASSOCIATION ("IGSA"), SUBJECT TO ANY AMENDMENTS, RENEWALS, EXTENSIONS, NEW AND/OR REPLACEMENT CONTRACTS BY GOVMVMT, TO BE UTILIZED CITYWIDE ON AN AS NEEDED BASIS, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; ACKNOWLEDGING THE COOPERATIVE PROCUREMENT BENEFITS OF GOVMVMT THAT ENABLES THE CITY OF MIAMI ("CITY"), AS A PARTICIPATING ENTITY, TO AGGREGATE ITS PURCHASING VOLUME WITH THAT OF OTHER PARTICIPATING MEMBER PUBLIC AGENCIES, IN ORDER TO REALIZE A LARGER PERCENTAGE DISCOUNT PRICING STRUCTURE TO THE FINANCIAL BENEFIT OF THE RESIDENTS OF THE CITY; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, EXTENSIONS, NEW AND/OR REPLACEMENT CONTRACTS, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS AND BUDGETARY APPROVALS HAVING BEEN PREVIOUSLY MADE, COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING, THE CITY OF MIAMI'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. WHEREAS, GovMVMT, a public procurement program launched by the nonprofit Innovative Government Services Association ("IGSA"), offers all Participating Entities, free of charge, access to contracts which have been competitively solicited and awarded by one of its participating member public agencies; and WHEREAS, GovMVMT assists Participating Entities in reducing the costs of purchasing goods and/or services by pooling together the purchasing power of all the Participating Entities of which GovMVMT is comprised of in order to realize a larger percentage discount pricing structure to the benefit of the residents of all the participating member public agencies; and WHEREAS, Section 18-113 of the Code of the City of Miami, Florida, as amended ("City Code"), titled "Cooperative Purchasing," expressly allows the City of Miami's Procurement City of Miami Page 1 of 2 File ID: 16951 (Revision:) Printed On: 8/12/2025 File ID: 16951 Enactment Number: R-24-0486 Department to participate in, sponsor, conduct, or administer cooperative purchasing agreements such as GovMVMT for the procurement of any goods and services, with other Participating Entities; and WHEREAS, the adoption of this Resolution will enable the Procurement Department the ability to purchase goods and services, on an as needed basis, on behalf of all the City Departments, by utilizing all competitively solicited and awarded contracts available through GovMVMT, subject to the availability of funds and budgetary approval at the time of need; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The cooperative procurement benefits of GovMVMT that enable the City, as a participating entity, to aggregate its purchasing volume with that of other participating member public agencies in order to realize a larger percentage discount pricing structure to the financial benefit of the residents of the City is acknowledged. Section 3. The accessing of all competitively solicited and awarded contracts available via GovMVMT, subject to any amendments, renewals, extensions, new and/or replacement contracts, by the GovMVMT, to be utilized Citywide on an as needed contractual basis, subject to the availability of funds and budgetary approval at the time of need, is approved and authorized. Section 4. The City Manager is authorized' to negotiate and execute all other documents including any amendments, renewals and extensions, new and/or replacement contracts, subject to all allocations, appropriations, and budgetary approvals having been previously made, compliance with applicable provisions of the City Code, including the City's Miami's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules and regulations, as may be deemed necessary for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS: rge .
