Background of Item: The City of Miami ("City") submitted a grant application to the Florida Department of Transportation ("FDOT") to fund the Miami Police Department's ("MPD") motor vehicle and highway safety initiatives to combat incidents of seatbelt violations in the City ("Project"). The City received a subgrant award from FDOT providing for approved funding in an amount not to exceed $90,000.00 ("Grant") for reimbursement of the Project's personnel and services. The Grant will be used to continue MPD's efforts to decrease hazardous driving incidents attributed to not wearing a safety belt and enhance enforcement efforts and deterrence capabilities to reduce seatbelt related fatalities in the City. The implementation of the Project's cost will be allocated towards personnel costs which will cover overtime salaries and benefits including those provided pursuant to the Federal Insurance Contributions Act. The subgrant award will terminate on September 30, 2025. WHEREAS, the City of Miami ("City") submitted a grant application to the Florida Department of Transportation ("FDOT") requesting funds for the implementation of the Miami Police Department's ("MPD") motor vehicle and highway safety initiatives and educational campaign to combat incidents of seatbelt violations in the City ("Project"); and WHEREAS, the City received notification of a subgrant award from FDOT to fund the Project in an amount not to exceed $90,000.00 ("Grant") to the City for equipment and expenditures by MPD to perform the Project's initiatives; and WHEREAS the Grant funds will be used to continue MPD's efforts to decrease seatbelt violations, establish highway safety by bringing awareness to seatbelt laws, and enhance seatbelt enforcement operations and deterrence capabilities intended to reduce motor vehicle fatalities in the City; and WHEREAS, the implementation of the Project's cost will be allocated towards personnel costs which will cover overtime salaries and benefits including those provided pursuant to the Federal Insurance Contributions Act; and WHEREAS, the subgrant award will terminate on September 30, 2025; and WHEREAS, there are no matching funds required from the City for the acceptance of this grant; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following new Special Revenue Project is established and resources are appropriated as described below: FUND TITLE: Miami Seatbelt Enforcement Project FY 2025 RESOURCES: Florida Department of Transportation $90,000.00 APPROPRIATIONS: Highway Safety $90,000.00 Section 3. The City Manager is authorized' to execute the subgrant agreement, in substantially the attached form, between the City and FDOT. Section 4. The City Manager is further authorized' to negotiate and execute any and all other necessary documents, all in forms acceptable to the City Attorney, for the purposes stated herein. Section 5. The City Manager is further authorized' to designate the Chief of Police or any other designee to execute the necessary documents to implement the acceptance of the Grant funds for the provision overtime reimbursement of MPD's members conducting enforcement initiatives to reduce incidents of seatbelt violations and establishing a highway safety campaign. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: rge ng11I, C ty' ttor -y 12/3/2024 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City of Miami Commission.
