Fernandez, Esq. 1 2 ATTORNEYS SMGQLAW.coM 1 9/20/ Fig. 1 - 160 NE 3O 'Terrace Fig. 3 -17 NE 50' Street Fig. 2 - BVM - 50th Terrace Fig. 4 - B VM - NE Corner 3 4 2 9/20/2023 Applicant's Request • The Property consist of 1.33 acres; however, only 0.98 are the subject of the requested FLUM amendment. • The applicant is requesting the following: • FLUM amendment from "Single -Family Residential" and "Medium Density Multifamily Residential" to "Medium Density Restricted Commercial" and "Restricted Commercial; and • Rezone from "T4-L" General Urban Zone — limited, "T4-R" General Urban Zone — Restricted and "T3-L" Sub -Urban Zone -Limited to "T5-0" Urban Center Transect — Open, "T5-L" Urban Center Zone — Limited, and "T4-L" General Urban Zone." 5 Applicant's Request Applicant has presented this request as it believes the project represents one of the best local examples of quality, fined -grained, urban infill development the City seeks to encourage through Miami 21 and stands in sharp contrast to other recent proposals for the surrounding area that are less contextually appropriate and complementary in scale. Policy LU-1.3.14: The City will continue to enforce urban design guidelines for public and private projects which shaft be consistent with neighborhood character, history, and function, and shall be in accordance with the neighborhood design and development standards adopted as a result of the amendments to the City's land development regulations and other initiatives. 13 Advances Goats, Objectives, & Policies of the MCPN • The Property is located within both the state Enterprise Zone 1 and the recently authorized federal Opportunity Zone. • Approval of the requested FLUM amendments and rezoning will further permit the diversification of commercial activities and commercial activities within these zones designated by the state and federal governments for revitalization through directed and tax -advantaged investment. Policy LU-1.3.14 is also advanced by the Applicant's request through development of a scale and character consistent with the architectural character of the adjoining historic neighborhood and recently approved changes to the FLUM and zoning transect designations of neighboring properties to the immediate North and recommended changes to properties to the North and East. 14 7 9/20/2023 Advances Goals, Objectives, & Policies of the MCNP Objective TR-2.7: Encourage transit -supportive development patterns that promote walkable, mixed -use neighborhoods that help to increase transit ridership, reduce automobile trips, and provide increased mobility for al! people. Policy TR-2.7.1: The City will preclude land uses within 7 mile of transit corridors...that are not conducive to public transit ridership...Conversely, the City will support the expanded development and design of a transit system that helps shape the desired land use patterns. 15 Advances Goals, Objectives, & Policies of the MCNP Approval of the Applicant's request would serve to encourage the co -location of neighborhood -serving commercial uses along a Transit Corridor thereby reducing automobile trips from residents in the surrounding areas which would otherwise need to seek similar services elsewhere. The uses resulting from the approval of the Applicant's request will also prove conducive to supporting public transit ridership serving the corridor, whether that be bus service along the Corridor or future commuter rail service on the FECI right-of-way. 15 8 9/20/2023 Justification for Proposed Change Given Changed Conditions In recent years, the trend of development has markedly changed in this subarea. Recent development orders have been approved by the City Commission, like the Miarni Jewish Health System Special Area Plan ("CH SAP"), or have received a recommendation of approval from the Planning Department ("Department"), like the Sable Palm Special Area Plan, which have/will significantly alter the residential character of NE 50th Terrace and the low -density commercial character of NE 2nd Avenue in the immediate vicinity of the Property. (ii) Transportation Corridors should be planned and reserved in coordination with land Use (s. 2.1.3.1.d.); (iii) The ordinary activities of daily living should occur within walking distance of most dwellings, allowing independence to those who do not drive (s. 2.1.3.2.c.); (iv) Appropriate building Densities and land uses should occur within walking distance of transit stops (s. 2.1.3.2.f.); and (v) Commercial activity should be embedded in Mixed -Use urban centers, not isolated in remote single -use complexes (s. 2.1.3.2.g.). 21 Neighborhood Outreach • The Applicants reached out to 10 Neighborhood Associations and held numerous video/phone/face-to-face meetings with 6 Associations' leaders. • A Letter of Support was secured from Buena Vista West Neighborhood Association, the largest Neighborhood Association in the Buena Vista area. The Applicants conducted door-to-door outreach between June and August, answering questions and collecting feedback, securing 350 Letters of Support from individuals and representing 405 properties. 50 Letters of Support secured within the permitters of Buena Vista East (Historic), and 26 in the smaller boundaries (49th- 52nd street) of Upper Buena Vista. • Miami Jewish Health and Avenues School, two businesses immediately surrounding the property, expressed support. 22 11 23 Closing The applicant believes that the requested change is consistent with the evolving character of the sub -area as evidenced by the City's approval of development orders (or recommendations for approval thereof) for neighboring parcels. Your responsibilities under the law when faced with voting on a measure in which you have a conflict of interest will vary greatly depending on whether you hold an elective or appointive position. INSTRUCTIONS FOR COMPLIANCE WITH SECTION 112,3143, FLORIDA STATUTES A person holding elective or appointive county, municipal, or other local public office MUST ABSTAIN from voting on a measure which would inure to his or her special private gain or loss. Each elected or appointed local officer also MUST ABSTAIN from knowingly voting on a measure which would inure to the special gain or loss of a principal (other than a government agency) by whom he or she is retained (including the parent, subsidiary, or sibling organization of a principal by which he or she is retained); to the special private gain or loss of a relative; or to the special private gain or loss of a business associate. Commissioners of community redevelopment agencies (CRAs) under Sec. 163.356 or 163.357, F.S., and officers of independent special tax districts elected on a one -acre, one -vote basis are not prohibited from voting in that capacity. For purposes of this law, a "relative"• includes only the officer's father, mother, son, daughter, husband, wife, brother, sister, father-in-law, mother-in-law, son-in-law, and daughter-in-law. A "bUslness associate" means any person or entity engaged in or carrying on a business enterprise with the officer as a partner, joint venturer, coowner of property, or corporate shareholder (where the shares of the corporation are not listed on any national or regional stock exchange).
