PZ-21-10194 02/10/23 Analysis of Miami 21 Rezoning Criteria — Art. 7, s. 7.1.2.8 A proposed rezoning pursuant to Art. 7.1.2.8 of Miami 21 must demonstrate each of the following: (i) the relationship of the proposed amendment to the goals, objectives and policies of the Comprehensive Plan, with appropriate consideration as to whether the change will further the goals, objectives and policies of the Comprehensive Plan, the Miami 21 Code, and other City of Miami ("City") regulations; (ii) the need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary; and (iii) that the change is limited to the next intensity Transect Zone and in a manner that maintains the goals of the Miami 21 Code to preserve Neighborhoods and to provide transitions in intensity and Building Height. The proposed rezoning advances each of the applicable criteria as follows: ■ s. 7.1.2.8(f)(1)(a) — Advances the Goals, Objectives & Policies of the Comprehensive Plan The proposed rezoning advances each of the following goals, objectives & policies of the Comprehensive Plan: Policy LU-1.1.7: Land development regulations and policies will allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range of residential, office, live/work spaces, neighborhood retail, and community facilities in a walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles, and mass transit. The application would serve to further reinforce the positive trend seen along the NE 2nd Avenue Corridor (the "Corridor") of facilitating development redevelopment of well -designed neighborhoods containing a full -range of uses that are amendable to a variety of transportation modes. In the instant case, the Applicant's have introduced food & beverage and micro -retailing uses to a portion of the Buena Vista neighborhood previously devoid of such uses. The change will continue to provide the Applicant the needed flexibility to further evolve such uses on the Property and provide additional parking on -site in support of the same. Objective LU-1.3: The City will continue to encourage commercial, office and industrial development within existing commercial , office and industrial areas;.. .encourage the development of well -designed, mixed -use neighborhoods that provide for a variety of uses within the a walkable area in accordance with neighborhood design and development standards adopted as a result of the amendments to the City's land development regulations and other initiatives;... Objective LU-1.3 is advanced by the subject application as will permit the continued evolution of neighborhood serving commercial uses within a walkable area consistent with applicable neighborhood design guidelines and development standards. PZ-21-10194 02/10/23 Policy LU-1.3.14: The City will continue to enforce urban design guidelines for public and private projects which shall be consistent with neighborhood character, history, and function, and shall be in accordance with the neighborhood design and development standards adopted as a result of the amendments to the City's land development regulations and other initiatives. The Property is located within both the state Enterprise Zone' and the recently authorized federal Opportunity Zone.2 Approval of the requested FLUM amendments and rezoning will further permit the diversification of commercial activities and commercial activities within these zones designated by the state and federal governments for revitalization through directed and tax -advantaged investment. Policy LU- 1.3.14 is also advanced by the Applicant's request through development of a scale and character consistent with the architectural character of the adjoining historic neighborhood and recently approved changes to the FLUM and zoning transect designations of neighboring properties to the immediate North and recommended changes to properties to the North and East. Objective TR-1.1: Encourage sustainable growth and development that aims to improve mobility, reduce congestion, and supports the overall growth strategy of the City. Policy TR-1.1.1: As an Urban Infill Area (UIA) and/or a Transportation Concurrency Exemption Area (TCEA)...the City will encourage the concentration and intensification of development around centers of activity with the goal of enhancing livability of residential neighborhoods, supporting economic development, and the viability of commercial areas.... Policy TR-1.1.5: The City will encourage new development to be structured to reinforce a pattern of neighborhoods and urban centers by focusing growth along transit corridors and around transit nodes and centers. The Property is situated along a Transit Corridor — NE 2nd Avenue and within both the Urban Infill Area (UTA) and TCEA. This application will further encourage the concentration and intensification of development around centers of activity and provide complimentary neighborhood services and uses that will enhance the livability and quality of the adjoining Buena Vista and Brentwood neighborhoods while simultaneously increasing the viability of the commercial uses along the Corridor. Finally, the proposed request reinforces Policy TR-1.1.5 of focusing future growth along transit corridors. Approval of the Applicant's request would serve to encourage the co -location of neighborhood -serving commercial uses along a Transit Corridor thereby reducing automobile trips from residents in the surrounding areas which would otherwise need to seek similar services elsewhere. The uses resulting from the approval of the Applicant's request will also prove conducive to supporting public transit ridership serving the corridor, whether that be bus service along the Corridor or future commuter rail service on the FECI right-of-way. ■ s. 7.1.2.8(f)(1)(b) — Justification for Proposed Change Given Changed Conditions In recent years, the trend of development has markedly changed in this subarea. Recent development orders have been approved by the City Commission, like the Miami Jewish Health System Special Area Plan ("MTH SAP") or have received a recommendation of approval from Planning Department ("Department"), like the East Ridge Special Area Plan, which have/will significantly alter the residential character of NE 50th Terrace and the low -density commercial character of NE 2nd Avenue in the immediate vicinity of the Property. Such approvals (or pending approvals) represent a significant increase in density and proposed scale/envelop of structures or buildings that can be erected on those neighboring sites. Specifically, those approvals would render the FLUM Designation for the portions of the Property fronting the Corridor consistent with the changes recently authorized by pursuant to the MJH SAP, while preserving transitions in both density and height consistent with the principles of Miami 21 without detriment to the adjoining single-family neighborhoods. Further, the proposed East Ridge SAP, recommended by the Department for approval, would have permitted development consistent with Urban Core Transect Zone (T6-8-O) designation catty -corner from the proposed site. While the application remains pending, both applications demonstrate the changed conditions as evidenced by the development trend reflected in such applications. Applicant's request is, therefore, consistent with such recent approvals/recommendations and provides for a transition from such proposed projects that will honor the principles of Miami 21. ■ s. 7.1.2.8(f)(2) — Preservation of the Goals of Miami 21 Code Sec. 7.1.2.8(f)(2) of Miami 21 requires that a zoning change be only to the next intensity Transect Zone and in a manner which maintains the goals of the Miami 21 Code to preserve Neighborhoods and to provide transitions in intensity and Building Height. Specifically, the Applicant's request will advance the following goals of the Miami 21 Code: (i) growth strategies should encourage Infill and redevelopment (s. 2.1.3.1.b.); (ii) Transportation Corridors should be planned and reserved in coordination with land Use (s. 2.1.3.1.d.); (iii) the ordinary activities of daily living should occur within walking distance of most dwellings, allowing independence to those who do not drive (s. 2.1.3.2.c.); (iv) appropriate building Densities and land uses should occur within walking distance of transit stops (s. 2.1.3.2.f.); and (v) Commercial activity should be embedded in Mixed -Use urban centers, not isolated in remote single -use complexes (s. 2.1.3.2.g.).
