Specifically, the Applicant is requesting a zoning change from T6-24A-O to T6-24B-O pursuant to the successional zoning requirements of Article 7, Section 7.1.2.8 of Miami 21. I. Property Information The Subject Property is located in the Omni neighborhood/Arts & Entertainment District of the City of Miami (the "City"), within the Omni Community Redevelopment Agency ("OMNI CRA") redevelopment area. The Subject Property is situated adjacent to T6-24B-O Transect Zones to both the North and East. The Subject Property abuts North Miami Avenue to the West, vacant land to the East, commercial uses to the South and civic uses (OMNI CRA office) to the North. According to the Survey, the Subject Property's lot area consists of approximately 21,468 square feet or 0.49 acres of land. The Subject Property is centrally located nearby Downtown Miami, Brickell, Edgewater, Midtown, Wynwood and the UM/Jackson Health District, with convenient vehicular access to I-95, Biscayne Boulevard, and State Road 836. The Applicant seeks to improve the Subject Property with a pedestrian oriented mixed -use development with ground level retail use and upper level multifamily units, including a workforce housing component, which will enhance the public realm in conformance with the intent and goals of Miami 21 and afford more residents the opportunity to live within walking distance of some of the City's most important cultural and entertainment venues, including the Adrienne Arsht Center, Kaseya Center, Frost Museum of Science and Perez Art Museum. This area is in great need of additional housing options to serve the thousands of individuals who work in nearby areas. Given the Subject Property's prime location with respect to both vehicular and pedestrian connectivity, the proposed commercial and residential uses will facilitate the implementation of the OMNI CRA Redevelopment Plan (the "CRA Redevelopment Plan"), helping to further revitalize the neighborhood and create additional housing options to serve the community. The Subject Property is located within the TOD created by the School Board Station, Adrienne Arsht Center Station, and Eleventh Street Station. In addition to the nearby Metromover Stations, including the School Board Metromover Station located just one block north of the Subject Property, the Subject Property is well served by other modes of mass transit, including the City of Miami Trolley's Allapattah route, as well as multiple routes of the Miami -Dade County Metrobus. Further, Ne 14th Street and NE 1st Avenue are designated Transit Corridors located in close proximity to the Subject Property. The Subject Property thus has unparalleled access to varied transportation options, including Miami - Dade County Transit Metro Bus, Metromover and Metro Rail systems, as well as the Brightline. As such, development at the Subject Property under Miami 21 will further increase ridership and use of the nearby transit opportunities and promote walkability in conformance with the principles of Miami 21 and the Comprehensive Plan. Pursuant to the Correspondence Table of the Comprehensive Plan, as depicted below, the Subject Property's General Commercial land use designation is compatible with the proposed T6-24B-O zoning designation. The FLUM designation of the Subject Property is indicative of the City's desire to allow greater FLR at the site. The Comprehensive Plan provides that properties designated "General Commercial" and located within the UCBD "allow a maximum floor lot ratio (FLR) of 37.0.". The current T6-24A-O zoning designation is contrary to the Comprehensive Plan as it only limits the permitted FAR to a maximum of 7. The proposed rezoning to T6-24B-O would permit a maximum FLR of 16, which is more compatible with the parameters set by the Comprehensive Plan. As such, the proposed rezoning brings the Subject Property closer to the goals and objectives of the Comprehensive Plan. III. Rezoning Request As reflected in the Survey, the Subject Property provides approximately 215 feet of street frontage along North Miami Avenue. Accordingly, the Subject Property meets the minimum requirement for rezoning pursuant to Article 7, Section 7.1.2.8(c)(1) of Miami 21. The proposed rezoning is appropriate for the Subject Property, meets the criteria set forth in Section 7.12.8(c)(2)(g) of Miami 21 as it is in conformance with the Comprehensive Plan, the established land use pattern for the adjacent properties and the immediate area, and is in scale with the needs of the neighborhood. DATE: January 8, 2024 RE: 1317 N Miami Ave and 1353 N Miami Ave, Miami, Florida (Folio Nos. 01- 3136-009-0170 and 01-3136-009-0200) / Rezoning Application Analysis This Rezoning Application Analysis is being submitted in connection with the rezoning application for the properties located at 1317 N Miami Ave and 1353 N Miami Ave, Miami, Florida (Folio Nos. 01-3136-009-0170 and 01-3136-009-0200) (collectively, the "Subject Property") . When we submit the official Rezoning Application, we will supplement this Analysis to include a radius map of the properties within a one-half mile radius of the Subject Property, together with photos of Building elevations extending 300 feet from the Subject Property. Under Miami 21, the current zoning designation of the Subject Property is T6-24A-O. The Future Land Use Map (the "FLUM") of the Miami Comprehensive Neighborhood Plan (the "Comprehensive Plan") designates the Subject Property as General Commercial. The Applicant is requesting to rezone the Subject Property to T6-24B-O pursuant to the successional zoning requirements of Article 7, Section 7.1.2.8 of Miami 21. The Subject Property provides approximately 215 feet of street frontage along North Miami Avenue. Accordingly, the Subject Property meets the threshold criteria for rezoning pursuant to Article 7, Section 7.1.2.8(c) (1) of Miami 21. Further, for the reasons outlined below, the proposed rezoning is appropriate for the Subject Property, meets the criteria established in Section 7.1.2.8 of Miami 21 and, therefore, should be approved. 1. The proposed rezoning will directly further the objectives, goals, and policies of the Comprehensive Plan. Under the Comprehensive Plan, the Subject Property is designated General Commercial and is located within the UCBD. The Comprehensive Plan provides that properties designated "General Commercial" and located within the UCBD "allow a maximum floor lot ratio (FLR) of 37.0." (emphasis added). The current T6-24A-O zoning designation is directly contrary to the Comprehensive Plan as it only permits a maximum FLR of 7 at the Subject Property. The proposed rezoning to T6-24B-O would permit a maximum FLR of 16 which is more compatible with the parameters set forth in the Comprehensive Plan. As such, the proposed rezoning furthers the objectives, goals and policies of the Comprehensive Plan. The Subject Property's designation as General Commercial and UCBD reflects the City's vision and intent to allow greater FLR at the Subject Property which the proposed rezoning will accomplish. In summary, the proposed rezoning to T6-24B-O will accomplish the City's goals through the implementation of its very own Comprehensive Plan. ACTIVE 691422484v4 David Snow 1317 N Miami Ave and 1353 N Miami Ave Rezoning Application Analysis January 8, 2024 Page 2 of 10 The following land use goals, objectives and policies of the Comprehensive Plan are furthered by the proposed rezoning of the Subject Property: • Goal LU-1: Maintain a land use pattern that (1) protects and enhances the quality of life in the City's neighborhoods; (2) fosters redevelopment and revitalization of blighted or declining areas; (3) promotes and facilitates economic development and the growth of job opportunities in the city; (4) fosters the growth and development of downtown as a regional center of domestic and international commerce, culture and entertainment; (5) promotes the efficient use of land and minimizes land use conflicts while protecting and preserving residential sections within neighborhoods; (6) protects and conserves the city's significant natural and coastal resources; and (7) protects the integrity and quality of the City's existing neighborhoods by insuring public notice, input and appellant rights regarding changes in existing zoning and land use regulations. Redesignation of the Subject Property to T6-24B-O will allow for greater development potential within the downtown area and encourage downtown's growth as a regional center of domestic and international commerce, culture and entertainment. The area is well buffered from other neighborhoods by major roadways, which minimize land use conflicts. The Subject Property is well served by infrastructure and would serve more efficiently if afforded higher intensity than that which is currently allowed. • Policy LU-1.1.7. Land development regulations and policies will allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range of residential, office, live/work spaces, neighborhood retail, and community facilities in a walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles, and mass transit. The proposed rezoning will facilitate the development of a mixed -use project located in close proximity to a robust mixed -use community that includes recreational and entertainment venues, as well as important employment centers such as the Miami Dade County Public Schools district office. • Policy LU-1.3.15: The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other. The Subject Property is centrally located between regional business hubs and cultural and entertainment venues which are well served by mass transit. As such, redevelopment of the Subject Property will provide more individuals the opportunity to live within walking distance of major employment centers and recreational facilities. • Objective LU-1.2. The proposed rezoning will encourage the redevelopment of currently underutilized land located within the redevelopment area of the Omni Redevelopment Agency with a Miami 21 compliant Project. • Objective LU-1.6. Regulate the development or redevelopment of real property within the city to insure consistency with the goals, objectives and policies of the Comprehensive Plan. The proposed rezoning to T6-24B-O would permit a maximum FLR of 16, which is more compatible with the parameters set by the Comprehensive Plan. • Policy HO-1.1.9: The City's land development regulations will encourage high -density residential development and redevelopment in close proximity to Metrorail and Metromover stations. (See Land Use Policy LU-1.1.10 and Transportation Policy TR- 2.1.3.) The Subject Property is located in close proximity to Metrorail and Metromover stations, and the proposed rezoning will facilitate the redevelopment of the Subject Property with a high -density mixed -use project. • Policy HO-2.1.1: Through the land development regulations, the City will protect and enhance existing neighborhoods in downtown. Rezoning of the Subject Property to T6-24B will promote the development of a mixed -use, high density development meshing with the new multi family developments in the Omni neighborhood. • Policy TR-1.1: Encourage sustainable growth and development that aims to improve mobility, reduce congestion, and supports the overall growth strategy of the City. The Subject Property is located within walking distance to Metromover stations, with transfer connection to the Metrorail and Brightline. • Policy TR-2.1.3: The City will encourage increased density of development within walking distance of transit corridors and Metrorail stations (as referenced in Policy LU- 1.1.10. and HO-1.1.9). The Subject Property is located within walking distance to Metromover stations, with transfer connection to the Metrorail and Brightline. The Subject Property's location and the existing conditions in the surrounding area support the proposed rezoning to T6-24B-O. The Subject Property's central location amongst significant cultural, entertainment and recreational venues make it the prime location for a mixed -use development to serve the surrounding area. The Subject Property is located in the Omni CRA redevelopment area and the Arts & Entertainment District, and within a one-half mile radius of Wynwood, Edgewater, Downtown Miami, and Miami Worldcenter, areas of the City that continue to experience rapid population and business expansion. Also located within a one-half mile radius of the Subject Property are important public recreational, entertainment, and transportation amenities including the Adrienne Arsht Center for the Performing Arts, the Knight Concert Hall, the I-395 Signature Bridge and associated 30-acre linear park which are currently under construction, and four (4) Metromover Stations (School Board Station, Adrienne Arsht Center Station, Eleventh Street Station and Museum Park Station). In recent years, development of the Arts & Entertainment District has made this area a hub of culture, dining, shopping and entertainment. The Omni area is the point of connection between Downtown Miami and the areas of Design District, Midtown and Wynwood, creating an ideal location for both residents and visitors to live, work and play. The proposed ground floor retail on the Subject Property will create active pedestrian areas by providing connectivity with the surrounding commercial spaces and provide a gathering place within the Omni area for visitors and residents alike. Additionally, the proposed residential development at the Subject Property will increase the housing supply and benefit the existing businesses in the area by providing a more permanent customer base. 3. The current FLR under the existing zoning designation is inappropriate because it is inconsistent with the City's Comprehensive Plan and with the intent of Miami 21. The existing zoning permits a maximum FLR multiplier of 7 for the Subject Property which is inconsistent with the permitted development under the Comprehensive Plan and Miami 21. As stated earlier, the Comprehensive Plan provides that properties designated "General Commercial" and located within the UCBD "allow a maximum floor lot ratio (FLR) of 37." Similarly, under the existing zoning designation and FLUM designations, the Subject Property is permitted development up to 48 stories and a maximum density of 500 units per acre. However, these maximum densities and intensities are unattainable under the current FLR multiplier of 7. The rezoning to T6-24B-O would permit an FLR multiplier of 16, which would result in development that is consistent with the City's vision for the Subject Property and the surrounding area given its Comprehensive Plan designation. Without the rezoning, the Subject Property would not be able to achieve a viable development potential in permitted stories or density under Miami 21 and the Comprehensive Plan. The rezoning will correct this inconsistency in the Subject Property's current zoning, thereby implementing the City's Comprehensive Plan in accordance with the intent of Miami 21 which encourages denser development in areas that are well served by transit. The proposed rezoning will permit a cohesive and unified development with increased Floor Area at the Subject Property in accordance with the guiding principles of Miami 21. The Subject Property's existing T6-24A-O zoning designation permits a maximum FLR multiplier of 7 and a Bonus FLR 30%. The proposed rezoning to T6-24B-O will permit a cohesive and unified development of the Subject Property by permitting a maximum FLR multiplier of 16 and a 40% Bonus Floor Area increase while requiring on -site Affordable/Workforce Housing to obtain any the additional Floor Area. This increase in FLR and associated Affordable/Workforce Housing potential will permit increased development which will be consistent with the character, scale and uses of the surrounding area. Moreover, the proximity to Downtown Miami enhances the need for maximum lot coverage to further promote the much needed residential and commercial development in the area, as well as an activation of the pedestrian realm. More importantly, the required on -site Affordable/Workforce Housing will further the guiding principles of Miami 21 and address the City's current and projected Affordable/Workforce Housing needs. 5. The changing conditions and recent rezonings in the immediate vicinity of the Subject Property warrant the proposed rezoning to T6-24B-O. The rapid growth of the surrounding area supports and demands the zoning change to a higher transect zone designation which will promote growth along transit nodes. The character of the surrounding areas has evolved to consist of higher scale multifamily residential uses which has served as a catalyst in the revitalization of the area and stimulated economic growth and jobs in the Arts and Entertainment District and surrounding neighborhoods. The City has recognized the changing character of the surrounding area through the approval of similar rezoning applications. Properties located within a one-half mile radius of the Subject Property have recently been rezoned from T6-24A-O to T6-24B-O. Below is an analysis of these recent rezonings. • On January 25, 2018, the City Commission approved the rezoning from T6-24A-O to T6- 24B-O for assemblage of properties depicted below located approximately one (1) block north of the Subject Property, pursuant to Ordinance No. 13739, attached as Exhibit 1. See Image 1 below. This property was subsequently developed with the Art Plaza Project consisting of two mixed -use towers containing 667 residential units. See Image 2 below. Image 2 • On July 20, 2016, the City Commission approved the rezoning from T6-24A-O to T6- 24B-O for the property depicted below located approximately two blocks south of the Subject Property, pursuant to Ordinance No. 13619, attached as Exhibit 3. Image 3 • On October 26, 2017, the City Commission approved the rezoning from T6-24A-O to T6- 24B-O for assemblage of properties depicted below located approximately two (2) blocks north of the Subject Property, pursuant to Ordinance No. 13706, attached as Exhibit 4. This property was subsequently developed with the Miami Plaza Project containing 425 residential units. See Image 4 below. Good afternoon Inspector Harris, attached is a code and lien search dated 09-06-2024 that we obtained today for our client's property. The search reveals a 2022 trash violation on the property. Please refer to a second attached report dated 4-02-2024, which revealed two trash violations, the 2023 appeared as complied which seems that at some point the property was inspected and complied with, (please see snip below). I believe the owner had addressed the violation and later paid the solid waste ticket in 2024 (attached is the paid receipt), however, the 2022 violation has not been released. Can you please let us know if your records indicate otherwise? If not, please let us know what you need from the owner to proceed to clear the 2022 trash violation.
