BACKGROUND INFORMATION: This amendment is to allow the allow the fee schedule for the Planning and Zoning Departments to be amended and approved by Resolution of the City Commission. This is in alignment with other large cities and Miami- Dade County. WHEREAS, Chapter 62 of the Code of the City of Miami, Florida, as amended, ("City Code") provides the fee schedule for planning and zoning matters, including but not limited to the processing of administrative entitlements, covenants, public hearing applications, and plan reviews by the Planning Department and the Office of Zoning; and WHEREAS, the City of Miami ("City") wishes to eliminate the fee schedule from within City Code and instead have it adopted by resolution of the City Commission; and WHEREAS, the updated language allows the City Commission to easily implement fiscally sound and best practices that are consistent with City regulations and changing market demands; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on October 16, 2024, following an advertised public hearing, adopted Resolution No. PZAB-R-24- 071 by a vote of ten to zero (10-0), Item No. PZAB 11, recommending approval of the City Code amendment; and WHEREAS, consideration was given to the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan, Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code"), and all other regulations of the City; and WHEREAS, consideration was given to the need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as fully set forth in this Section. Section 2. (1) All fees for pre -application meetings shall be invoiced and collected by the planning department or the office of zoning, as applicable, from the applicant before any work is initiated by city staff.
