A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE THE RECONSTRUCTION AND
RELOCATION AGREEMENT BETWEEN THE CITY OF MIAMI AND SDE MEDIA, LLC,
IN SUBSTANTIALLY THE ATTACHED FORM.
WHEREAS, pursuant to prior amendments to the Code of the City of Miami, Florida, as
amended, ("City Code") regarding the elimination of new billboards, the City of Miami ("City")
entered into settlement agreements with Carter Pritchett Hodges, Inc., dba Carter Outdoor
Advertising, Inc., in August of 2003 to approve twenty (20) signs for usage, relocation, and
reconstruction, with Clear Channel Outdoor, Inc, in July of 2004 to approve 452 signs for usage,
reconstruction, and relocation, and with CBS Outdoor, Inc., nka OutFront Media LLC in July
2008 for 53 signs; and
WHEREAS, the agreements were entered into after the City amended its City Code to
no longer allow new billboards to be constructed in the City; and
WHEREAS, this change meant that only those companies with existing billboard signs
would be allowed to continue to operate billboard signs; and
WHEREAS, currently, billboards agreements are governed by Chapter 62, Article XIII,
Division 6 of the City Code; and
WHEREAS, SDE Media, LLC ("SDE") has managed billboards, more specifically, a sign
located at 555 Northwest 79 Street, known as the Boardworks Sign and a sign located at 229-
301 Southwest 17 Road, known as the Hampton Inn sign; and
WHEREAS, SDE did file appeals and challenge the amended City Code along with the
other billboard companies at the time and the other companies as noted did receive settlement
agreements to maintain, reconstruct and relocate their now legally non -conforming signs; and
WHEREAS, the City Commission wishes to authorize the City Manager to execute a
Reconstruction and Relocation Agreement with SDE, pursuant to Section 62-618.1 et seq., in
substantially the attached form, between the City and SDE; and
WHEREAS, the City Commission wishes to allow SDE to operate on monopole, static
billboard with two sign faces;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the Reconstruction and
Relocation Agreement between the City and SDE, in substantially the attached form.
Section 3. This Resolution shall become effective immediately upon its adoption.
