By this Memorandum, the Office of Capital Improvements ("OCI") is requesting a capacity increase for the
subject construction contract with Recreational Design & Construction, Inc. (RDC) in the amount of Two
Million Five Hundred Thousand Dollars ($2,500,000.00) plus a ten percent (10%) Owner's Contingency in
the amount of Two Hundred Fifty Thousand Dollars, ($250,000.00), for a grand total of Two Million Seven
Hundred Fifty Thousand Dollars ($2,750,000.00) to process payment for redesign of the pool maximum
depth from 5' 3" to 7' 10" including demolition, dewatering, new pool piping, pool draining, and filtration
systems.
Justification and Background
On June 30, 2021, the City issued Invitation to Bid (ITB) Number 20-21-009 to procure a Prime Contractor
to demolish the existing swimming pool, construct a new swimming pool, on Virrick Park and install a
water main under the adjacent streets.
On January 18, 2022, RDC was awarded the project and entered a construction contract with the City on
April 1, 2022, for an amount not to exceed Six Million Five Hundred Thousand Dollars ($6,500,000.00);
construction started in June 2022. In May 2024, residents of District 2, where Virrick Park is located,
vehemently objected to the design of the aquatic facility. The community requested the pool depth be
increased from 5' 3" to 7' 10" to facilitate the pool's use for competitive aquatic sport activities.
The new construction of the Virrick Park Aquatic Facility requires partial demolition of the lap area and
includes step downs and railings. Additional design modifications allow for a recreational Zero entrance
area and learn to swim area. New pool piping, drainage, filtration, and dewatering are also required.
RDC submitted an initial cost estimate in September 2024 of Three Million One Hundred Fifty -One
Thousand One Hundred Ninety -Four Dollars ($3,151,194.00) for construction of the design modifications
to the pool. Negotiations between the City and RDC resulted in an agreed amount of Two Million Five
Hundred Thousand Dollars ($2,500,000.00) with a 10% Owner contingency of Two Hundred Fifty
Thousand Dollars ($250,000.00) for a grand total of Two Million Seven Hundred Fifty Thousand Dollars
($2,750,000.00) to cover the cost of the redesigned pool. An additional 240 calendar days will be
necessary to achieve substantial completion of the facility, pushing the date to July 2025.
Attached, you will find copies of the RDC original contract, and a memorandum dated January 11, 2022,
authorizing the Procurement Department to execute a contract with RDC for in an amount not to exceed
Six Million Five Hundred Thousand Dollars ($6,500,000) pursuant to City Resolution R-20-0209.
The contractor remains committed to the project's completion by no later than July 2025. There is sufficient
funding in the Project Number to fully cover the contract increase amount of Two Million Seven Hundred
Fifty Thousand Dollars ($2,750,000.00).
