HomeMy WebLinkAboutR-24-0471City of Miami Resolution R-24-0471 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16859 Final Action Date: 11/21/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO PARTNER WITH MIAMI-DADE COUNTY ("COUNTY") AS A CO -GRANTEE FOR THE APPLICATION AND ACCEPTANCE OF GRANT FUNDS FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT ("HUD") FOR THE CHOICE NEIGHBORHOODS IMPLEMENTATION GRANT PROGRAM IN AN AMOUNT NOT TO EXCEED THIRTY-NINE MILLION NINE HUNDRED SIXTY- EIGHT THOUSAND FOUR HUNDRED TWENTY-FOUR DOLLARS ($39,968,424.00) ("GRANT"), TO BE AWARDED TO THE COUNTY AS LEAD GRANTEE, FOR THE IMPLEMENTATION OF A TRANSFORMATION PLAN IN THE OVERTOWN NEIGHBORHOOD OF THE CITY, FOR THE PERIOD BEGINNING JULY 17, 2024 AND ENDING SEPTEMBER 30, 2032; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT BETWEEN THE CITY, THE COUNTY, AND HUD FOR THE ACCEPTANCE AND ALLOCATION OF THE GRANT, INCLUDING ANY AND ALL NECESSARY DOCUMENTS, AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR THE PURPOSE STATED HEREIN, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS; PROVIDING FOR AN EFFECTIVE DATE. SPONSOR(S): Commissioner Christine King WHEREAS, in 2010, the United States Department of Housing and Urban Development ("HUD") created the Choice Neighborhoods Program ("Choice Neighborhoods") to leverage public and private dollars to support local strategies to address struggling neighborhoods with distressed public or HUD -assisted housing through a comprehensive approach to transform entire neighborhoods; and WHEREAS, through Choice Neighborhoods, local leaders, residents, and stakeholders such as public housing authorities, cities, schools, police, business owners, nonprofits, and private developers, come together to create and implement a plan that revitalizes distressed HUD housing and address challenges in the surrounding neighborhood; and WHEREAS, Choice Neighborhoods' grants are highly competitive and awarded based on quantitative and qualitative criteria; and WHEREAS, Choice Neighborhoods require one -for -one replacement of all HUD -assisted housing units, with a right -to -return requirement for all residents living on -site as of the date of the grant award; and WHEREAS, Choice Neighborhoods also requires matching funds in the amount of five percent (5%) of each grant; and City of Miami Page 1 of 3 File ID: 16859 (Revision: A) Printed On: 8/11/2025 File ID: 16859 Enactment Number: R-24-0471 WHEREAS, Choice Neighborhoods provides two (2) types of grants, which include planning grants and implementation grants; and WHEREAS, Choice Neighborhoods implementation grants support communities who have undergone comprehensive local planning and are ready to implement their plans to transform a neighborhood; and WHEREAS, Choice Neighborhoods implementation grants requires that the local government of jurisdiction where the property is located to be the Lead Applicant or Co - Applicant; and WHEREAS, Miami -Dade County ("County") as lead -grantee and the City of Miami ("City") as co -grantee (collectively "Grantee") applied for, and on July 16, 2024, was awarded by HUD the Choice Neighborhoods Implementation Grant for fiscal year 2023 — 2024, for the implementation of a Transformation Plan ("Transformation Plan") to enhance the Overtown neighborhood in the District 5 area of the City into a more connected, opportunity -rich, climate - resilient and safe community, in accordance with the Choice Neighborhood Implementation Program ("Program"); and WHEREAS, HUD agrees, subject to the terms of the Grant Agreement ("Agreement"), attached and incorporated herein as Exhibit "A," to provide grant funds to the Grantee, in the total amount no to exceed Thirty -Nine Million, Nine Hundred Sixty -Eight Thousand, Four Hundred Twenty -Four Dollars ("$39,968,424.00") ("Grant") as per form HUD-1044, for the activities described in the Transformation Plan as defined in Article IV of the Agreement, attached and incorporated herein as Exhibit "A," for the period beginning July 17, 2024 and ending September 30, 2032 ("Performance Period"); and WHEREAS, the County, as lead -grantee will have sole access to the Grant funds and is responsible for ensuring proper use of the Grant and to disburse the funds for eligible activities as approved by HUD; and WHEREAS, the County, as lead -grantee, will fulfill the matching funds requirement by providing the Building Better Communities General Obligation Bonds funds in an amount of Two Million Dollars ($2,000,000.00) for the Grant, and was previously approved by the County pursuant to Resolution No. R-1148-20; and WHEREAS, on November 6, 2024, the County adopted Resolution No. R-1000-24, which retroactively authorizes the County Mayor or designee to apply for and accept the Grant, among other things related to the implementation and acceptance of the Grant; and WHEREAS, the City Commission finds that it is in the best interest of the City to authorize the City Manager to partner with Miami -Dade County as Co -grantee for the application and acceptance of grant funds, from HUD for the Program during the Performance Period, and further authorizing the City Manager to negotiate and execute an agreement, including any and all necessary documents, amendments, extensions, and modifications, all in forms acceptable to the City Attorney, for acceptance and implementation of the Grant for the purpose stated herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 2 of 3 File ID: 16859 (Revision: A) Printed on: 8/11/2025 File ID: 16859 Enactment Number: R-24-0471 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to partner with the County as a co -grantee for the application and acceptance of the Grant from HUD for the fiscal year 2023-2024 Choice Neighborhood Implementation Grant Program for eligible activities under the Choice Neighborhoods Program, during the Performance Period, to be awarded to the County as lead - grantee. Section 3. The City Manager is authorized' to negotiate and execute an agreement between the City, County, and HUD, for the acceptance and allocation of the Grant, including any and all necessary documents, amendments, extensions, and modifications, all in forms acceptable to the City Attorney, for said purposes, subject to all federal, state, and local laws that regulate the use of such funds. Section 4. This Resolution shall become effective immediately upon its adoption.
