AMENDED COMPLAINT TO QUIET TITLE Plaintiff, 3436 North Miami Avenue LLC, ("3436") by and through undersigned counsel, hereby files this Complaint against Defendant City of Miami (the "City") to quiet title as to a certain parcel of real property, and in support thereof, avers as follows: 1. 3436, owns the real property located in Miami -Dade County, Florida more particularly described as follows: Lots 3 & 4 and N2OIN Lot 5, Block 7, WYNWOOD PARK, according to the map or plat thereof as recorded in Plat Book 5, Page 23, Public Records of Miami -Dade County, Florida. a/k/a 3436 North Miami Avenue, Miami, Florida 33127 (the "Property"). 2. This is an action to quiet title of the Property, thereby vesting the Circuit Court with subject matter jurisdiction over this cause pursuant to Chapter 26 and Chapter 65 of the Florida Statutes. 3. Venue is proper in this Court pursuant to section 47.011, Florida Statutes, as the Property is located in Miami -Dade County, Florida. FACTUAL BACKGROUND 4. On October 27, 2021, the City posted the following notices on the 3436's tenants' doors: notice of a lack of Certificate of Use ("CU"), failure to renew Business Tax Receipts ("BTR"), operating without a BTR, and a violation for Placing Signs on the Public Right of Way. However, the City failed to provide 3436 with proper notice of the magistrate hearing summons by certified mail service regarding the lien created by the aforementioned violations. 6. Given the lack of proper notice, 3436 did not appear in the magistrate hearing on December 8, 2021. 7. 3436's tenants were not able to apply for CU or BTR because the Property was undergoing its Forty (40) Year Recertification ("Recertification"), and the City would not approve any requests until the finalization of the Recertification. 8. On December 12, 2021, the City placed a $500.00 per diem lien against the Property due to the CU and BTR violations. 9. As a result of the City's insufficient notice, the lien has accrued for seven hundred sixty (760) days for a total of three hundred eighty thousand dollars ($380,000). 10. 3436 has complied with the CU and BTR violations and with the Recertification. 11. The extent of the violation penalties was solely the result of the City's insufficient notice to 3436. COUNT I — QUIET TITLE 12. 3436 reiterates and incorporates by reference the allegations in paragraphs 1 through 12 as if contained herein in their entirety. 13. Pursuant to City of Miami Code of Ordinances, art. X, section 2-814, when a Code Inspector notes a code violation, the Code Inspector "shall notify the violator in writing and give him or her a reasonable time to correct the violation." If the violation continues beyond the specified time for correction, the Code Inspector "shall request a hearing in writing pursuant to the procedure outlined in section 2-815 hereof." Art. X, Section 2-814. 15. Proper notice of violations and notice of hearings, as outlined in the City of Miami Code of Ordinances, art. X, section 2-819, is a requirement for all code enforcement liens, civil infractions, or penalties. 16. Pursuant to the City of Miarni Code of Ordinances, art. X, section 2-819(a), proper notice "shall be in writing and furnished by certified mail, return receipt requested or by hand delivery" at the owner's residence. 17. The City failed to provide 3436 with proper notice of code violations and proper notice of hearing. 18. Given that the City has not complied with written notice of violations, pursuant to the City of Miami Code of Ordinances, art. X, section 2-814, nor notice of hearing, pursuant to Miarni, Florida, Code of Ordinances, art. X, section 2-826, the lien on the Property is unenforceable by the City. WHEREFORE, Plaintiff, 3436 North Miarni Avenue LLC, respectfully requests that this Court find in Plaintiff's favor and against the Defendant(s) removing the clouds from its title and quieting the title in the Plaintiff and also placing in the Plaintiff in possession of the property.
