COMPLAINT Plaintiff, Juan Ismael as Personal Representative for the Estate of Manuel Ismael (hereinafter "Plaintiff'), sues the Defendant, CITY OF MIAMI, a municipal corporation and a political subdivision of the State of Florida, and alleges as follows: PARTIES, JURISDICTION, AND VENUE 1. This Court has jurisdiction because Plaintiff's damages exceed $50,000.00, exclusive of attorney's fees, interest, and costs. 2. Plaintiff, Juan Ismael as Personal Representative for the Estate of Manuel Ismael, is an individual residing in Miam-Dade County, Florida and is otherwise sui furls. 3. Defendant is a municipal corporation and subdivision under the laws of Florida and located in Miami -Dade County, Florida. 4. Under Florida Stature Section 47.011, venue lies in Miami -Dade County, Florida because the Plaintiff's causes of action occurred in Miami -Dade County, Florida, and the Defendant Juan Ismael as PR, et al. vs. City of Miami Case No.: is located in Mami-Dade County, Florida. BACKGROUND 5. Prior to his passing, Manuel Ismael ("Decedent"), Decedent was the owner of four (4) vacant lots located within the City of Miami. 6. Decedent passed away on March 31, 2018. 7. It appears that all of the violations discussed herein were issued after the Decedent passed away. 8. The properties that are or may be affected by the liens and orders discussed herein are as follows: a. 1190 NW 55t1' Street, Miami, FL Folio #01-3114-040-0080 b. 1180 NW 55th Street, Miami, FL Folio #01-3114-040-0070 c. 1170 NW 55t" Street, Miami, FL Folio #01-3114-040-0050 d. 1176 NW 55th Street, Miami, FL Folio 01-3114-040-0080 (hereinafter collectively the "Properties) 9. On May 14, 2019, the Code Enforcement Board for the City of Miami imposed a Final Administrative Enforcement Order (hereinafter "2019 Order") for "Outside Storage of miscellaneous materials, equipment, and/or debris for Property A. A true and correct copy of the Order is attached hereto as Exhibit "A." 10. The order imposed a lien on the Property and required Decedent to cure the deficiencies by April 6, 2018, or a daily fine of $250.00 would begin to accrue. See id. The deadline to cure the alleged violation was almost one (1) year before the date of the Order. 11. The deficiencies were not cured by April 6, 2018, and daily fines began to accrue. -2 Juan Ismael as PR, et al. vs. City of Miami Case No.: 12. On December 8, 2020, the Code Enforcement Board for the City of Miami imposed a Code Enforcement Order (hereinafter "2020 Order") for "Failure to maintain lot in a safe, clean condition; not allowing accumulation of debris, trash or dense growth of grass. City CODE SEC 22-116, 117,118). A true and correct copy of the Order is attached hereto as Exhibit "B." 13. The order imposed a lien on the Property and required Decedent to cure the deficiencies by October 19, 2020, or a daily fine of $250.00 would begin to accrue. See id. 14. The deficiencies were not cured by October 19, 2020, and daily fines began to accrue. 15. On August 20, 2021, the Code Enforcement Board for the City of Miami unposed a Code Enforcement Order (hereinafter "2021 Order") for "Failure to maintain lot in a safe, clean condition; not allowing accumulation of debris, trash or dense growth of grass. City CODE SEC 22-116, 117,118). A true and correct copy of the Order is attached hereto as Exhibit "C." 16. The order imposed a lien on the Property and required Decedent to cure the deficiencies by July 6, 2021, or a daily fine of $250.00 would begin to accrue. See id. 17. The deficiencies were not cured by July 6, 2021, and daily fines began to accrue. 18. On July 13, 2022, the Code Enforcement Board for the City of Miami imposed a Final Administrative Enforcement Notice (hereinafter "2022 Order") for "Failure to maintain lot in a safe, clean condition; not allowing accumulation of debris, trash or dense growth of grass. City CODE SEC 22-116, 117,118). A true and correct copy of the Order is attached hereto as Exhibit 19. The order imposed a lien on the Property and required Decedent to cure the deficiencies by July 18, 2022, or a daily fine of $500.00 would begin to accrue. See id. -3 Juan Ismael as PR, et al. vs. City of Miami Case No.: 20. The deficiencies were not cured by July 18, 2022, and daily fines began to accrue. 21. Defendant's Ordinance Number 2-817(d)(2) stipulates that any fines unpaid for over 270 days are not eligible for mitigation. 22. Ordinance Number 2-817(d)(4) provides in pertinent part that: Exceptions. The above chart and restrictions shall not apply to: (b) Bankruptcy matters, or matters in which the city has a litigation settlement which may be heard by the city commission: 23. On November 9, 2023, Defendant inspected the Property and confirmed that the 2017 Violation had been cured. A true and correct copy of the Affidavit of Compliance is attached as Exhibit "E." 24. These violations are the only violations Plaintiff is aware of, but in an abundance of caution, Plaintiff has listed all Properties as the lots are contiguous and there may be pending orders or violations not listed herein. 25. With respect to the various orders against the properties, the Properties accrued at least $510,500.00 in fines. 26. With respect to the various violations, the prior owner did not receive actual notice of same for several reasons. 27. First and foremost, all or substantially all of the violations were issued after the owner passed away. 28. Second, the notices were sent to incorrect addresses. With respect to the 2019 Order and the 2020 Order, on the face thereof they were sent to 9278 SW 36 Street, Miami, FL 33165- 4118. This property was transferred solely to Decedent's ex-wife prior to the 2019 Order and no notice was provided by Decedent's ex-wife. -4 Juan Ismael as PR, et al. vs. City of Miami Case No.: 29. Similarly, the 2021 Order and the 2022 Order were sent to 8205 SW 178th Terrace, Miami, FL 33157. This property was also lost in the divorce and was sold by Decedent's ex -spouse on January 14, 2016, long before the violations were issued. 30. Plaintiff, Decedent's personal representative, made several attempts to change the address for mailing with the property appraiser but the property appraiser refused to change the address even though the owner was deceased and the personal representative requested the change. 31. In fact, Plaintiff only learned of the various violations when another property located in Homestead was sold and the violations appeared in the lien search. 32. With respect to the violations, the garbage and debris for which the violations were issued were as a result of third parties dumping same on the properties. 33. The properties are routinely cleaned and cleared, but the Defendant was not contacted regarding an inspection as the Plaintiff was unaware that the violations existed. 34. All condition precedent have been completed before the filing of this case. COUNT 1 - QUIET TITLE 35. Plaintiffs reincorporate and reallege the allegations in Paragraphs 1-34 as set forth herein. 36. The orders impose liens on the Properties. 37. The Plaintiff is the personal representative of Decedent and must clear these liens prior to selling the vacant lots. 38. Plaintiff is authorized to bring an action to quiet title to the Property and clear any cloud on title to the Property. See Fla. Stat. § 65.031 ("An action in chancery for quieting title to, or clearing a cloud from, land may be maintained in the name of the owner or of any prior owner -5 Juan Ismael as PR, et al. vs. City of Miami Case No.: who warranted the title."). 39. Plaintiff has a compelling interest in removing the cloud on title unposed by the Orders and the liens because the Properties' titles are currently unmarketable as a result thereof. WHEREFORE, the Plaintiff, Juan Ismael as Personal Representative for the Estate of Manuel Ismael, respectfully request that this Honorable Court enter judgment in his favor and against Defendant, CITY OF MIAMI, remove the cloud on title currently hindering the Property, and award any other and further relief allowable under Florida Law that this Court deems just and proper.
