HomeMy WebLinkAboutR-24-0456City of Miami Resolution R-24-0456 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16866 Final Action Date: 11/21/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), BY A FOUR FIFTHS (4/STHS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDINGS, ATTACHED AND INCORPORATED AS EXHIBIT "A," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY") AND WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING GRANT FUNDS FROM THE DISTRICT 1 COMMISSIONER'S SHARE OF THE CITY'S ANTI -POVERTY INITIATIVE IN A TOTAL AMOUNT NOT TO EXCEED ONE HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($100,000.00) TO LITTLE HAVANA ACTIVITIES & NUTRITION CENTERS OF DADE COUNTY, INC., A FLORIDA NOT FOR PROFIT CORPORATION ("LHANC"), IN SUPPORT OF THE ANTONIO MACEO PARK CONGREGATE MEALS PROGRAM; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS NECESSARY, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Commissioner Miguel Angel Gabela WHEREAS, the City of Miami ("City") created the Anti -Poverty Initiative ("API") to address poverty based on a strategy of focusing the provision of support towards the City's residents achieving self-sufficiency; and WHEREAS, Little Havana Activities & Nutrition Centers of Dade County, Inc., a Florida not for profit corporation ("LHANC"), is seeking funding to continue their Antonio Maceo Park Congregate Meals Program which provides nutritious meals to elderly residents 60 years of age or older ("Program"); and WHEREAS, in addition to this Program, LHANC provides center and home -based services to older adults; and WHEREAS, the City's District One Commissioner ("Commissioner") wishes to provide grant funds from the Commissioner's share of the City's API in an amount not to exceed One Hundred Thousand Dollars and Zero Cents ($100,0000.00) ("Funds") for the Program; and WHEREAS, pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has made a written finding, attached and incorporated as Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of the Funds for the Program; and WHEREAS, the City Manager is requesting authority from the City Commission to City of Miami Page 1 of 2 File ID: 16866 (Revision:) Printed On: 8/8/2025 File ID: 16866 Enactment Number: R-24-0456 negotiate and execute any and all documents necessary, all in forms acceptable to the City Attorney, for said allocation of Funds for the Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Pursuant to Section 18-85(a) of the City Code, by a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written findings, attached and incorporated as Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of the Funds for the Program and waiving the requirements for said procedures, are hereby ratified, approved, and confirmed. Section 3. The City Manager is authorized to allocate the Funds from the Commissioner's share of the City's API to LHANC for the Program. Section 4. The City Manager is further authorized' to negotiate and execute any and all documents necessary, all in forms acceptable to the City Attorney, for said purpose. Section 5.
