HomeMy WebLinkAboutBack-Up DocumentsCity of Miami PZAB Resolution Enactment Number: PZAB-R-24-050 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 13667 Date Rendered: 7/29/2024 A RESOLUTION OF THE PLANNING, ZONING AND APPEALS BOARD RECOMMENDING APPROVAL OF AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 35/ARTICLE VII OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TITLED "TRANSPORTATION TRUST FUND," MORE PARTICULARLY BY AMENDING SECTION 35-254(C) OF THE CITY CODE TO ESTABLISH A PURCHASE PRICE OF PARKING SPACES PAYABLE INTO THE TRANSPORTATION TRUST FUND; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, transit and mobility are challenges currently facing the residents and visitors of the City of Miami ("City"); and WHEREAS, City Commission adopted Ordinance No. 13568 on October 22, 2015, which established the Transportation Trust Fund; and WHEREAS, at the time of adoption it was identified that, due to the existing City - operated trolleys and planned new expanded routes, that the City would exhaust its restricted funds to continue trolley operations at some point in 2018; and WHEREAS, the creation of a Transportation Trust Fund created a dedicated source of revenue for transportation alternatives by requiring that the City budget a certain minimum amount of revenue for said purpose; and WHEREAS, expenditures from the Transportation Trust Fund will require authorization by a supermajority of the City Commission, ensuring the money collected will be spent in the best interest of all the residents of, and visitors to, the City; and WHEREAS, Article 4, Table 4 of Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended, ("Miami 21 Code") provides for a 50% reduction in parking spaces within Transit Oriented Development areas and along Transit Corridors with payment into the Transportation Trust Fund; and WHEREAS, no fee for payment was established at the time of adoption of the Transportation Trust Fund; and WHEREAS, the proposed amendment meets the intent of Goal TR-1, Objective TR1.1, Policy TR-1.1.3, Policy TR-1.1.4, Policy TR-1.1.5, Objective TR-1.2, Policy TR-1.2.1, and Policy TR-1.2.4 of maintaining an effective and cost-efficient circulation network that provides transportation for all persons while reducing both the dependency on automobiles and overall roadway congestion; and Date Rendered: 7/29/2024 City of Miami Page 1 of 3 File ID: 13667 (Revision:) Printed On: 7/29/2024 WHEREAS, consideration was given as to whether the proposed text amendment will further the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan, the Miami 21 Code, and other City regulations; and WHEREAS, consideration was given as to the need and justification for the proposed amendment to the City Code, including changed or changing conditions that make the passage of the proposed amendment to the City Code necessary; and WHEREAS, after careful consideration of this matter, it is deemed it advisable and in the best interest of the general welfare of the City and its citizens to amend the City Code as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 35/Article VII of the City Code, is amended in the following particulars.' "CHAPTER 35 MOTOR VEHICLES AND TRAFFIC ARTICLE VII. TRANSPORTATION TRUST FUND C. Garage contribution. All funds collected through parking ratio reductions pursuant to Article 4, Table 4 of the Miami 21 Code, as amended, shall be reserved in this trust fund for capital or acquisition costs associated with the creation of new public parking garages operated by the department of off-street parking. These funds may be carried over to the succeeding fiscal year. The purchase price is $10,000.00 per half -space (residential) and $20,000.00 per full space (commercial or residential) per parking space waiver ("Purchase Price"). The purchase price shall be adjusted for inflation at the end of each five-year period, as approved by the City Manager or his/her designee. *„ 1 Words and/or figures stricken through shall be deleted. If any section, part of a section, paragraph, clause, phrase, or word of this Resolution is declared invalid, the remaining provisions of this Resolution shall not be affected. Section 4.
