Subject: Accept Final Plat - Alto Tower Subdivision
Purpose of Item:
Resolution of the Miami City Commission accepting the final plat of ALTO TOWER
SUBDIVISION located along the North side of NW 36 Street, from NW 22 Court to NW
23 Avenue, from BLUE CASL DADE, LLC, executed by Scott Macdonald and Shawn
Wilson; and authorizing the City Manager to execute the related documents for the
recordation of the plat and approving recording the same in the Public Records of
Miami -Dade County, Florida.
Background of Item:
The Plat and Street Committee established per Miami City Code Section 55-1, and
composed of the Departments of Resilience and Public Works, Planning, Building,
Office of Zoning, Police, Fire -Rescue, and Solid Waste, with representation of the Law
Department, has reviewed the Tentative Plat and determined its conformance to the
subdivision regulations of Chapter 55, and Miami 21 Zoning Regulations. The
Department of Resilience and Public Works has reviewed the final plat and has
determined that it is now in order for consideration of acceptance by the Miami City
Commission. The specific intent of this plat is to close the private alley lying within the
limits of the proposed plat and to create one (1) tract of land for residential use. The plat
entitled ALTO TOWER SUBDIVISION is a replat of the property described in the legal
description shown as Attachment 1. The platted area consists of approximately 37,155
square feet (0.853 ± acres) as depicted in Exhibits B and C. This plat was approved
under Miami 21 zoning designation T6-8-O (Urban Center Transect Zone Open).

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE PLAT TITLED "ALTO TOWER SUBDIVISION," A REPLAT IN THE
CITY OF MIAMI OF THE PROPERTY DESCRIBED IN ATTACHMENT "1," SUBJECT
TO SATISFACTION OF ALL CONDITIONS REQUIRED BY THE PLAT AND STREET
COMMITTEE AS SET FORTH IN EXHIBIT "A," ATTACHED AND INCORPORATED,
AND THE PROVISIONS CONTAINED IN SECTION 55-8 OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED; ACCEPTING THE DEDICATIONS SHOWN ON
THE PLAT; AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY
CLERK TO EXECUTE THE PLAT AND CAUSE THE RECORDATION OF THE PLAT
IN THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA.
WHEREAS, the Plat and Street Committee ("PSC"), established pursuant to Chapter 55
of the Code of the City of Miami, Florida, as amended ("City Code"), at its meeting of October 7,
2021, and subsequent meetings of June 7, 2022 and December 7, 2023, reviewed the proposed
plat titled "ALTO TOWER SUBDIVISION" and determined that all technical requirements have
been met; and
WHEREAS, the PSC recommends the acceptance of the plat; and
WHEREAS, The Miami Planning, Zoning and Appeals Board at its meeting on
November 2, 2022, adopted Resolution No. PZAB-R-22-055 recommending approval with
conditions of the vacation and closure of a portion of a platted private alley generally located
south of Northwest 38 Street, west of Northwest 22 Court, north of Northwest 36 Street, and
east of Northwest 23 Avenue; and
WHEREAS, the Miami City Commission, at its meeting on January 12, 2023 adopted
Resolution No. R-23-0037 closing and vacating of a portion of a platted private alley generally
located south of Northwest 38 Street, west of Northwest 22 Court, north of Northwest 36 Street,
and east of Northwest 23 Avenue;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The plat titled "ALTO TOWER SUBDIVISION," a replat and a subdivision of
the property described in Attachment "1," which plat by reference, in substantially the attached
form and subject to satisfaction of all conditions required by the PSC as set forth as Exhibit "A,"
attached and incorporated, and the provisions contained in Section 55-8 of the City Code, is
accepted.
Section 3. The dedications shown on the plat together with the dedications to the
perpetual use of the public of all existing and future planting, trees, and shrubbery on said
dedications are hereby accepted and confirmed by the City of Miami.
Section 4. The City Manager and City Clerk are authorized' and directed to execute the
plat and cause the same to be recorded in the Public Records of Miami -Dade County, Florida.
Section 5. This Resolution shall become effective immediately upon its adoption.
