HomeMy WebLinkAboutOrdinanceCity of Miami Ordinance Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16683 Final Action Date: 10/15/2024 AN ORDINANCE OF THE MIAMI CITY COMMISSION DELETING REFERENCES TO THE COMMUNITY RELATIONS BOARD FROM CHAPTER 2/ARTICLE XI/DIVISION 2/SECTION 2-892 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TITLED "ADMINISTRATION/BOARDS, COMMITTEES, COMMISSIONS/STANDARDS FOR CREATION AND REVIEW OF BOARDS GENERALLY/"SUNSET" REVIEW OF BOARDS"; FURTHER REPEALING, IN ITS ENTIRETY, CHAPTER 2/ARTICLE XI/DIVISION 12 OF THE CITY CODE, TITLED "ADMINISTRATION/BOARDS, COMMITTEES, COMMISSIONS/COMMUNITY RELATIONS BOARD," THEREBY SUNSETTING THE COMMUNITY RELATIONS BOARD AND DELETING ALL REFERENCES THERETO; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission created and established the Community Relations Board ("CRB") in 1999 to advise and oversee community related issues; and WHEREAS, the CRB has had many issues with attendance which affects the CRB's ability to conduct its necessary business; and WHEREAS, due to the lack of attendance and the inability to further the purpose of the CRB, the City Commission wishes to sunset the Community Relations Board; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 2/Article XI/Division 2/Section 2-892 of the City Code, titled "Administration/Boards, Committees, Commissions/Standards For Creation And Review Of Boards Generally/Sunset Review of Boards" is amended in the following particulars: 1 1 Words/and or figures stricken through shall be deleted. STANDARDS FOR CREATION AND REVIEW OF BOARDS GENERALLY * * * Sec. 2-892. "Sunset" review of boards. Commencing with the year 1995, each city board shall be reviewed in the following manner: (1) By February 15 of the year in which a board is to be reviewed, the city manager shall deliver to the city commission the report submitted by the chairperson of each board pursuant to section 2-890 herein above, together with any recommendation or comments the city manager desires to submit. (2) During the month of March of each year in which a board is to be reviewed, the chairperson shall make an oral presentation to the city commission. Said presentation shall be based on the report set forth in section 2-890 above. At the conclusion of the oral presentation by the board's chairperson, any individual commissioner may request the formation of a special purpose board, (hereinafter referred to as the "SPB"), consisting of five members appointed by the city commission. The SPB shall evaluate the chairperson's report, the city manager's recommendations and any other information it deems relevant to determine whether the board being reviewed shall continue in its present form. The SPB shall make a report to the full commission within 90 days. (3) At the conclusion of this review process, the city commission shall determine whether to abolish, continue, consolidate or modify the board for the ensuing four years thereafter. Nothing contained herein shall be construed to authorize the abolition, consolidation or modification of any multijurisdictional board. (4) The following boards shall initially be reviewed in the following years and shall be reviewed every four years thereafter: d. 1998: 1. Historical and environmental preservation board. 2. Chapter 2/Article XI/Division 12 of the City Code, titled "Administration/ Boards, Committees, Commissions/Community Relations Board" is repealed in its entirety to effect said sunset, in the following particulars:1 "CHAPTER 2 ADMINISTRATION ARTICLE XI. BOARDS, COMMITTEES, COMMISSIONS * * * DIVISION 12. RESERVED. COMMUNITY RELATIONS BOARD * * * Sec. 2 1150. Established. There is hereby established a limited agency and instrumentality of the city to be known as the "community relations board" and shall be hereinafter referred to as the "board". Sec. 2 1151. Purpose, powers and duties. The purpose, powers and duties of the community relations board are: {1) To serve in an advisory capacity to the city commission; {2) To foster mutual understanding, tolerance, and respect among all economic, social, religious and ethnic groups in the city; authority and charged with the duty and responsibility; {1) To attempt to act as conciliator in controversies involving community relations; {5) To cooperate with federal, state, county, and municipal agencies in developing harmonious community relations; {6) To cooperate in the development of educational programs dedicated to the improvement of community relations wit;h,I and to enlist the support of, civic leaders; civic, religious, veterans, tG l and eleemosynar„ groups; and private agencies engaged ire the inculcation of ideals of tolerance, cultural and understanding; {7) To prepare studies, and have studies made, in the field of community relations, and to prepare and disseminate reports of such studies; {8) To recommend to the mayor, commissioners, and the city manager such ordinances to carry out the purposes of the provisions set forth herein; {9) To submit an annual report to the mayor, commissioners, and the city manager; and {10) To make recommendations regarding grants and donations on behalf of the city from approval by the city commission. Sec. 2 1152. The members of the board shall be broadly representative of the pride interest integrit„ responsibility and business or profess {c) Terms of office. The provisions set forth in section 2 885 of this article shall apply to all rnembers of the community relations board. (d) Vacancies. If a vacancy shall occur on the board, such vacancy shall be filled by the rnayor or city commission after nomination by the commissioner who nominated the member whose position has become vacant. Such appointment shall be effective for the remainder of the unexpired term or until the mayor or the nominating commissioner leaves offices. {e) Officers. The members of the board shall select and designate from its members a who shall serve at the pleasure of the board. No chairperson shall serve more than two years in office. The vice -chairperson shall serve as chairperson in the absence of the chairperson. (f) Rules of procedure. The board may a-ils own order of business and rules of with the provisions set forth herein, which rules of procedure shall be filed with the city clerk. Copies of minutes of all board meetings shall be furnished to the mayor, commissioners and the city manager. {g) Meetings; quorum. All meetings of said board shall be open to the public. A quorum is necessary for the conduct of business by the board and shall consist of five members of the board. An affirmative vote of not leaf than 50 percent of the members present and voting at any meeting is required for any action to be taken by the members. {h) Attendance requirements. The provisions set forth in section 2 886 of this article shall apply to all mcmbcrs of the community relations board. Sec. 2 1153. Creation of the office of community relations; assignment of a community rclations coordinator and staff. coordinator and staff. It shall be the duty of the city manager to designate the community relations coordinator. The community relations coordinator shall provide administrative support board, keep minutes of meetings, prepare reports and documents, maintain board functions required by the board. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective immediately after final reading and adoption thereof.2 APPROVED AS TO FORM AND CORRECTNESS: 2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
