Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute an Off -System Construction and Maintenance Agreement, in
substantially the attached form, with the State of Florida Department of Transportation
("FDOT"), for improvements on State Road 886 / Port Boulevard from SR-5 / Biscayne
Boulevard to Port Miami, Miami, Florida, for general roadway improvements in this
corridor, including improvements on roads not on the State Highway System.
Background of Item:
FDOT has developed design plans Financial Management ("FM") Projects No. FM
443913-1-52-01 and 443913-1-52-02 for State Road 886 / Port Boulevard from SR-5 /
Biscayne Boulevard to Port Miami, Miami, Florida, for the rehabilitation of the existing
concrete pavement, upgrading of pedestrian ramps, upgrading of signing and pavement
markings. FDOT intends to undertake and complete the Project, a portion of which
includes work on roads not on the State Highway System but City of Miami right-of-way,
specifically on NE 5 Street from SR-5 / Biscayne Boulevard to approximately 130 feet
west of the SR-5 /Biscayne Boulevard west edge of pavement. The Off -System
Construction and Maintenance Agreement incorporated as Exhibit "A", establishes the
terms, conditions, and responsibilities of FDOT and the City to accomplish the Project
and Local Roadway Improvements on the City's Streets. The City agrees with the terms
and conditions in the Agreement.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN OFF -SYSTEM
CONSTRUCTION AND MAINTENANCE AGREEMENT, IN SUBSTANTIALLY THE
ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION ("FDOT"), FOR IMPROVEMENTS ON STATE ROAD ("SR")
886/PORT BOULEVARD FROM SR-5/BISCAYNE BOULEVARD TO PORT MIAMI,
MIAMI, FLORIDA, FOR GENERAL ROADWAY IMPROVEMENTS IN THIS
CORRIDOR, INCLUDING IMPROVEMENTS ON ROADS NOT ON THE STATE
HIGHWAY SYSTEM.
WHEREAS, the Florida Department of Transportation ("FDOT") has developed design
plans Financial Management ("FM") Projects No. FM 443913-1-52-01 and 443913-1-52-02 for
State Road ("SR") 886/Port Boulevard from SR-5/Biscayne Boulevard to Port Miami, Miami,
Florida, for the rehabilitation of the existing concrete pavement, upgrading of pedestrian ramps,
upgrading of signing and pavement markings ("Project"); and
WHEREAS, FDOT intends to undertake and complete the Project, a portion of which
includes work on roads not on the State Highway System but City of Miami ("City") right-of-way,
specifically on Northeast 5 Street from SR-5/Biscayne Boulevard to approximately one hundred
thirty feet (130') west of the SR-5/Biscayne Boulevard west edge of pavement (for purposes of
this agreement, the "Off -System Project Limits") and
WHEREAS, the Project includes pavement milling and resurfacing, installation of new
roadway signs and pavement markings, replacement of signalization vehicular detection loops
and valves and manholes' adjustments ("Local Roadway Improvements") and all activities
associated with, or arising out of the construction of the Local Roadway Improvements; and
WHEREAS, the Off -System Construction and Maintenance Agreement ("Agreement"),
attached and incorporated as Exhibit "A", establishes the terms, conditions, and responsibilities
of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City's
Streets; and
WHEREAS, the City agrees with the terms and conditions in the Agreement, in
substantially the attached form;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the Agreement, in substantially
the attached form, with FDOT, for the Project on SR 886/Port Boulevard from SR-5/Biscayne
Boulevard to Port Miami, Miami, Florida, which includes improvements on roads not on the state
highway system, and the Local Roadway Improvements.
Section 3. This Resolution shall become effective immediately upon its adoption.
