Background of Item: FDOT has developed design plans Financial Management Project No. FM 446000-2- 52-01 for State Road 90 / SW 8 Street from SW 4 Avenue to SW 2 Avenue, for the milling and resurfacing of the existing asphalt pavement, installation of sidewalk bulbout, curb ramps, curb and gutter, signalization and new electrical service point, new signing and pavement markings and adjustment of utilities. FDOT intends to undertake and complete the Project, a portion of which includes work on roads not on the State Highway System but City of Miami right-of-way, specifically on SW 3 Avenue from approximately 33.5 feet south of the SE corner radius return from SW 8 Street to approximately 62.1 feet north of the NE corner radius return from SW 8 Street. The Off - System Construction and Maintenance Agreement establishes the terms, conditions, and responsibilities of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City's Streets. WHEREAS, the Florida Department of Transportation ("FDOT") has developed design plans Financial Management ("FM") Project No. FM 446000-2-52-01 for State Road ("SR") 90/Southwest 8 Street from Southwest 4 Avenue to Southwest 2 Avenue, for the milling and resurfacing of the existing asphalt pavement, installation of sidewalk bulb -out, curb ramps, curb and gutter, signalization and new electrical service point, new signing and pavement markings and adjustment of utilities ("Project"); and WHEREAS, FDOT intends to undertake and complete the Project, a portion of which includes work on roads not on the State Highway System but City of Miami ("City") right-of-way, specifically on Southwest 3 Avenue from approximately 33.5 feet south of the Southeast corner radius return from Southwest 8 Street to approximately 62.1 feet north of the Northeast corner radius return from Southwest 8 Street (for purposes of this agreement, the "Off -System Project Limits"); and WHEREAS, the Project includes pavement restoration through milling and resurfacing of the existing asphalt pavement, and installation of new roadway signs and pavement markings ("Local Roadway Improvements") and all activities associated with, or arising out of the construction of the Local Roadway Improvements; and WHEREAS, the Off -System Construction and Maintenance Agreement ("Agreement"), attached and incorporated as Exhibit "A," establishes the terms, conditions, and responsibilities of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City's Streets; and WHEREAS, the City agrees with the terms and conditions in the Agreement, in substantially the attached form; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute an Agreement, in substantially the attached form, with FDOT, for the Project on SR 972/Coral Way from south of 1-95 to east of Southwest 3rd Avenue, Miami, Florida, which includes improvements on roads not on the state highway system, and the Local Roadway Improvements. Section 3. This Resolution shall become effective immediately upon its adoption.
