City of Miami File ID: 16655 (Revision:) Printed On: 8/7/2025 City of Miami Legislation Ordinance Enactment Number: 14317 File Number: 16655 Final Action Date: 9/26/2024 AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION, BY A FOUR - FIFTHS (4/5THS) AFFIRMATIVE VOTE, AMENDING CHAPTER 54/ARTICLE IV OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TITLED "STREETS AND SIDEWALKS/NAMING OF STREETS AND NUMBERING OF BUILDINGS," BY AMENDING SECTION 54-137, TITLED "STREET CODESIGNATION," TO ALLOW THAT THE REQUIREMENTS OF THAT SECTION MAY BE WAIVED BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE OF THE CITY COMMISSION; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, Chapter 54, Article IV of the Code of the City of Miami, Florida, as amended ("City Code"), titled "Streets and Sidewalks/Naming of Streets and Numbering of Buildings," establishes regulations regarding street naming and codesignations; and WHEREAS, Section 54-137 of the City Code sets forth specific criteria for street codesignations, including historical significance, avoidance of confusion, and limitations on the length of codesignations, among other guidelines; and WHEREAS, the City Commission recognizes that there may be circumstances where a street codesignation, otherwise not permissible under the established criteria of Section 54-137, may still serve a significant public or community interest, justifying a waiver of the requirements; and WHEREAS, the City of Miami seeks to honor a highly esteemed and beloved member of the community, whose lifetime of contributions has profoundly shaped the City, while he is still with us, as a gesture of deep respect and gratitude for his enduring impact; and WHEREAS, this Ordinance seeks to provide the City Commission with the authority, by a four -fifths (4/5ths) affirmative vote, to waive the requirements of Section 54-137 when it determines that such waiver serves a substantial community or public interest, thereby promoting flexibility while maintaining the integrity of the street codesignation process; and WHEREAS, pursuant to Section 166.041(3)(b), Florida Statutes, the City Commission finds that this emergency ordinance is necessary on the grounds of an urgent need for the continuity of services for City residents and for the preservation of health, safety, welfare, or property of the public; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Chapter 54/Article IV of the City Code is further amended in the following particulars:' "CHAPTER 54" STREETS AND SIDEWALKS ARTICLE IV. NAMING OF STREETS AND NUMBERING OF BUILDINGS Sec. 54-137. — Street codesignation. The city commission shall consider proposals for street codesignation using the following criteria: (1) Named streets, e.g., as in Coconut Grove, shall not be changed where there is an historical tradition attached to the existing name. (2) Named streets shall not be codesignated because of the resulting confusion. (3) Numbered streets shall not be codesignated for merely commercial purposes. (4) Numbered streets shall only be codesignated if there is significant historical, neighborhood or community benefit to the codesignation. (5) Numbered street codesignations shall not exceed five blocks in length. (6) There shall be a hiatus at least five blocks in length between consecutive codesignations in numbered streets. (7) Numbered streets shall not be codesignated with the names of living individuals. This provision can be waived by four votes of the city commissioners. (8) Block numbers shall be added to any new street signs that reflect codesignations, markers or plazas. Notwithstanding, the requirements of this section may be waived by a four -fifths (4/5ths) affirmative vote of the city commissioners, or an unanimous vote of the quorum that exists because of either abstentions or vacancies resulting from resignation, death, suspension, or physical incapacitation. *11 Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately upon final reading and adoption thereof.2 1 Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein. whichever is later.
