RESOLUTION
A Resolution of the Board of Directors of the Wynwood Community
Enhancement Association, Inc. Recommending Denial of File Id Nos. 13578
and 13579 with respect to applications for Amendment to the City of Miami
Future Land Use Map from High Density Multifamily Residential to General
Commercial and Amendment to the Miami 21 Zoning Atlas from T4-Rto T5-O,
for the Property located at 136 NW 35 Street, within the Wynwood Norte
(NRD-2) Neighborhood Revitalization District.
WHEREAS, the Wynwood Community Enhancement Association ("Wynwood CEA") is a not
for profit corporation registered in the State of Florida and active since 2018; and
WHEREAS, the mission of the Wynwood CEA is to provide a unified voice for neighborhood
improvements and enhancing the quality of life of current and future residents; and
WHEREAS, in 2019, the Wynwood CEA spearheaded a community -led, inclusive participatory
planning process resulting in the Wynwood Norte Community Vision Plan, which includes goals,
objectives, and policy recommendations for the future vitality of the neighborhood located generally
between North Miami Avenue and NW 6th Avenue/I-95, and from NW 29th Street to NW 37th Street
and/or I-195 ("Wynwood Norte"); and
WHEREAS, on March 25, 2021, the City Commission adopted Ordinance No. 13987,
establishing the Wynwood Norte Neighborhood Revitalization District, incorporated as Appendix P to
the Miami 21 Code ("NRD-2"), along with Ordinance No. 13985, amendments to the Future Land Use
Map, and Ordinance No. 13986, amendments to the Miami 21 Zoning Atlas; and
WHEREAS, pursuant to Section 2.2 of Appendix P of the Miami 21 Code, "the intent of the
Neighborhood Revitalization District (NRD-2) is to establish a protective series of land development
regulations to restore, enhance and grow the existing diverse, and mixed -use Wynwood Norte
neighborhood, guided by and intended to implement the Wynwood Norte Community Vision Plan,
pursuant to Resolution No. R-19-0472, adopted by the City Commission on November 21, 2019 (the
"Community Vision Plan")"; and
WHEREAS, William Riley, Esq. has filed companion applications on behalf of the owner of the
property located at 136 NW 35 Street, to change the Future Land Use Map classification from High
Density Multifamily Residential to General Commercial, and to change the Miami 21 Zoning Atlas from
T4-R to T5-O (the "Applications"); and
WHEREAS, the Applications were deferred at the April 19, 2023 meeting of the Planning
Zoning and Appeals Board to allow for the Applications to be presented/discussed with residents and
interested stakeholders in the neighborhood; and

WHEREAS, the Applicant's attorney William Riley, Esq. appeared and presented the
Applications at the Wynwood CEA Public Meeting on May 4, 2023 at Roberto Clemente Park
Community Center, and there were several questions and concerns articulated by stakeholders
regarding the change in intensity and commercial, office and hotel uses permitted through these
applications, as well as questions about operation and impacts of the private school; and
WHEREAS, the Wynwood CEA wishes to ensure any land use and zoning changes are
consistent with the goals and objectives of the Vision Plan and the NRD-2 to "preserve and protect the
neighborhood's unique character" and "maintain appropriate transitions" between the mixed use
corridors (primarily T5-O) and the interior residential neighborhood (primarily T4-R); and
WHEREAS, the staff report prepared by the City of Miami Planning Department does not
mention or reference the Community Vision Plan or how these Applications are consistent with the
Community Vision Plan; and
WHEREAS, these Applications would result in expansion of the T5-O transect zone further east
into the interior residential neighborhood, which would allow for development up to eight (8) stories
and a wide range of uses including office and hotel uses, which was intentionally restricted from T4-R
properties and would be inappropriate and create an incompatible transition to the existing and future
residential character, intensity and building height on the south side of NW 35 Street, and which could
have a domino effect undermining the integrity of the NRD-2; and
WHEREAS, these Applications are not necessary to accomplish the purpose articulated by the
Applicant of legalizing use of the property as a private school since the same uses are permitted by
either Warrant and/or Exception in T4-L and T5-L transect zones; and
WHEREAS, the Applicant has not proffered a covenant restricting the uses and height of
development to mitigate the impacts of future development under T5-O and General Commercial
future land use designation; and
WHEREAS, the Applications are therefore inconsistent with the criteria set forth under Section
7.1,2.8.f of the Miami 21 Code.
NOW THEREFORE, BE IT RESOLVED that the Board of Directors of the Wynwood Community
Enhancement Association, Inc. by a vote of 66-0, hereby adopts this Resolution as follows:
The Wynwood recommends denial of the above -referenced Applications.
