The undersigned serves as special land use counsel to Educationem Consulendis Enterprises, Inc., a Florida corporation (hereinafter referred to as the "Applicant"). This request is submitted in accordance with the requirements applicable to the City of Miami's Land Use and Rezoning Cycle for the Spring of 2023. The Applicant respectfully submits the attached application to amend the Future Land Use Map of the Miami Comprehensive Neighborhood Plan (the "MCNP") and the accompanying application to change the zoning classification for property located at 136 NW 35 Street, Miami, Florida (referred to hereinafter as the "Subject Property"). The Subject Property comprises nearly 0.10 acres or 4,750± square feet in area. The Applicant is the fee owner of the Subject Property. On December 20, 2017, pursuant to Enactment Number PZAB-R-17-094, the City of Miami Planning, Zoning and Appeals Board approved an exception, warrant and waiver pursuant to Article 4, Table 3 and Article 7, Section 7.2.8 of Ordinance No. 13114, to permit the Property to be used as a Middle School and for the adjoining site located at 3465 NW 2 Avenue, which is also owned by the Applicant, to be used as a day care, elementary school and middle school. The Property is located within the High Density Multifamily Residential land use designation and the T4-R zoning district. The adjoining school site (under common ownership) is located within the General Commercial land use designation and the T5-0 zoning district. Recently, the City Commission adopted the Wynwood Norte zoning overlay that encumbers both the Property and the adjoining school site. Although the T4-R zoning district permits educational facilities pursuant to Exception, which was granted for the Property, the newly adopted Wynwood Norte regulations do not. The inconsistency existing amongst the T4-R zoning district and the THE RILEY FIRM, LLC ATTORNEYS AT LAW Lakisha Hull, Director City of Miami Page 2 Wynwood Norte district have caused the existing use of the Property to become legally non -conforming. The Applicant respectfully requests the approval of the instant applications for the purpose of preserving the existing use of the Property and to establish a single uniform land use designation and zoning classification for the entire school site (including both the Property and the adjoining property under common ownership). The purpose of this request is to penult the construction of a modern state-of-the-art school building on the Property that, but for the adoption of the current applications, would be prohibited. Apart from the construction of a modern school building, the Applicant does not currently intend on changing the operations of the Property, including the age range or number of student stations. Instead, the Applicant desires to improve the property with a three-story building to accommodate larger classrooms that provide students with more intimate learning environments. Furthermore, the Applicant has discussed the proposals with abutting neighbors and have not received any objects to the applications. The Applicant proposes an amendment to the City's Future Land Use Map to create consistency among proximate land uses, including the adjoining land use designation for the remainder of the school campus. The Applicant's proposed land use amendments are consistent with the City's vision and plans for the area. Pursuant to Article 7. 1. 2.8(c)(2)(g) of Miami 21, we provide general planning principles and the goals and objectives of the City's Comprehensive Plan finding that the proposed amendment and rezoning of the Subject Property are in conformity with the MCNP, the established land use pattern for the adjacent properties, and in scale with the needs of the neighborhood. At a minimum, the information below supports the Applicant's proposal as one that is consistent with the Goals, Objectives and Policies of the MCNP. Goal LU-1: Maintain a land use pattern that (1) protects and enhances the quality of life in the City's neighborhoods; (2) fosters redevelopment and revitalization of blighted or declining areas; (3) promotes and facilitates economic development and the growth of job opportunities in the city; (4) fosters the growth and development of downtown as a regional center of domestic and international commerce, culture and entertainment; (5) promotes the efficient use of land and minimizes land use conflicts while protecting and preserving residential sections within neighborhoods; (6) protects and conserves the city's significant natural and coastal resources; and (7) protects the integrity and quality of the City's existing neighborhoods by insuring public notice, input and appellant rights regarding changes in existing zoning and land use regulations. Policy LU-1.1.7: Land development regulations and policies will allow for the development and redevelopment of well -designed mixed- use neighborhoods that provide for the full range of residential, office, live/work spaces, neighborhood retail, and community facilities in a walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles, and mass transit. The Applicant's request supports this policy in that it furthers the intent of creating well -designed neighborhoods by establishing a uniform land use designation and zoning classification. Policy LU-1.1.11: The City hereby adopts designation of the City, excluding Virginia Key, Watson Island and the uninhabited islands of Biscayne Bay, that have a land use and zoning classification of Conservation, as an Urban Infill Area pursuant to Miami - Dade County's designation of an Urban Infill Area lying generally east of the Palmetto Expressway and including all of the City of Miami. Within this area, the concentration and intensification of development around centers of activity shall be emphasized with the goals of enhancing the livability of residential neighborhoods and the viability of commercial areas. Priority will be given to in fill development on vacant parcels, adaptive reuse of underutilized land and structures, the redevelopment of substandard sites, downtown revitalization and the development of projects that promote public transportation. Maintenance of transportation levels of service within this designated Urban Infill Transportation Concurrency Exception Area shall be in accordance with the adopted Transportation Corridors level of service standards and the City of Miami Person Trip Methodology as set forth in Policies T R-1. 1. 2 and 1.1.3 of the Transportation Element of the MCNP. The Applicant's requests furthers the aforementioned policy in that it will provide a state-of-the-art educational facility that will enhance the livability and viability of the neighborhood. Policy LU-1.1.12: In order to encourage the development and maintenance of educational facilities in the City of Miami, the City's Land Use policies permit schools in all land use classifications except Conservation, Public Parks and Recreation, and Industrial. During pre - development program planning and site selection activities, the City shall coordinate with Miami - Dade Public Schools and continue to seek, where feasible and mutually acceptable, to co -locate schools with other facilities such as parks, libraries, and community centers to the extent possible. In accordance with this stated policy, the Applicant's requests seek to peiinit a state-of-the-art educational facility on the Subject Property. 3 THE RILEY FIRM, LLC ATTORNEYS AT LAW Lakisha Hull, Director City of Miami Page 4 Objective LU-1.3: The City will continue to encourage commercial, office and industrial development within existing commercial, office and industrial areas; increase the utilization and enhance the physical character and appearance of existing buildings; encourage the development of well -designed, mixed -use neighborhoods that provide for a variety of uses within a walk able area in accordance with neighborhood design and development standards adopted as a result of the amendments to the City's land development regulations and other initiatives; and concentrate new commercial and industrial activity in areas where the capacity of existing public facilities can meet or exceed the minimum standards for Level of Service (LOS) adopted in the Capital Improvement Element (CIE). These applications will further this objective by providing for a state-of-the-art educational building that will enhance the physical character and appearance of the existing buildings. Policy LU-1.3.4: The City will continue to work with the Miami -Dade County School Board to ensure the expansion of educational facilities in areas that are easily accessible by public transit and facilitate the expansion of job training/job placement programs offered to youths (full time and summer terms) and low-income persons. In accordance with this stated policy, the Applicant's requests seek to permit a state-of-the-art educational facility on the Subject Property, which is easily accessible by public transit. Policy LU-1.3.15: The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other. The proposed state-of-the-art educational facility will enhance the existing neighborhood and contribute to the balanced mix of uses in accordance with this policy. Objective LU-3-1: Promptly review and act on petitions for land use plan amendments and rezoning of property in Urban Infill Areas or Urban Redevelopment Areas to facilitate redevelopment. Goal HO-2: Achieve a livable city center with a variety of urban housing types for persons of all income levels in a walkable, mixed -use, urban environment. This application will help further the goal of creating a livable city center by providing for an educational facility that will further the character of neighborhood. These applications will further the objective of expanding on neighborhood amenities and improving on the existing neighborhood with the continued educational services in an improved state-of-the-art building. The requested land use amendment will allow the Subject Property to continue to offer neighborhood educational services without an amortization period and will permit the existing school building to be improved with a new low-rise state-of-the-art building. A hallmark of good urban form is to promote the retention of neighborhood schools. That is precisely what this application seeks to accomplish. As a companion application, the Applicant respectfully requests a zoning change for the Subject Property from T4-R to T5-0. As explained above, this change of zoning is necessitated by the recent enactment of the Wynwood Norte overlay district, which although generally was intended to create more flexibility in land use patterns to support future growth, created a legal nonconformity of an existing school within the neighborhood. The result of the nonconforming status prohibits the ability for the Applicant to present a plan of new construction for the Property that would introduce an innovative and state-of-the-art design for a new school building. The use of the Subject Property is not proposed to be changed or otherwise modified. Instead, the Applicant seeks the zoning change to T5-0 to establish a single zoning classification for the entirety of the school campus and allow the educational use to remain without an amortization schedule. Additionally, as stated herein, the Applicant desires to propose a new school building with larger classroom space for a more intimate learning environment.
