WHEREAS, on April 13, 2023, pursuant to Resolution No. R-23-0178, the City of Miami ("City") created the Miami For Everyone ("MFE") Program to assist communities facing the long- term complications resulting from declared emergencies and to address the specific needs of the most vulnerable residents and businesses, through a strategy of focusing the provision of support towards priority areas of need that will further stabilize economic conditions within City Districts; and WHEREAS, pursuant to Resolution No. R-24-0330 adopted on September 12, 2024, the City updated its Revenue Replacement total by an increment of Thirteen Million, Three Hundred Ninety -Two, Five Hundred Seventy -Three and 46/100 Dollars ($13,392,573.46) pursuant to the final rule (31 CFR Part 35) to implement the Coronavirus State Fiscal and Local Fiscal Recovery Funds ("ARPA Funds") established under the American Rescue Plan Act of 2021; and WHEREAS, the City intends to allocate funds in a total amount not to exceed Nine Million, Five Hundred Thousand and 00/100 ($9,500,000.00), as described in Exhibit "A," attached and incorporated, to the MFE program; and WHEREAS, the City intends to reallocate funds in a total amount not to exceed Ninety - Three Thousand and 00/100 ($93,000.00), as described in Exhibit "A," attached and incorporated, to the City's Department of Housing and Community Development; and WHEREAS, the City intends to reallocate funds in a total amount not to exceed Eight Hundred Thousand and 00/100 ($800,000.00), as described in Exhibit "A," attached and incorporated, to the City's Department of Human Services; and WHEREAS, the City intends to reallocate funds in a total amount not to exceed Three Million and 00/100 ($3,000,000.00), as described in Exhibit "A," attached and incorporated, to capital projects identified therein; and WHEREAS, except for such changes as set forth herein, all previous appropriations remain authorized to continue as previously approved City of Miami ("City") capital projects (new, revised, and continued projects) according to the Fiscal Year 2023-2024 Multi -Year Capital Plan adopted on September 9, 2023 pursuant to Resolution No. R-23-0376, as subsequently amended ("Adopted Capital Plan"); and WHEREAS, the appropriations authorized pursuant to this Resolution are subject to all applicable Federal, State of Florida ("State"), local, and City laws, rules, and regulations; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is authorized' to appropriate an amount not to exceed Thirteen Million, Three Hundred Ninety -Three Thousand and 00/100 Dollars ($13,393,000.00) to projects and programs specified in the Exhibit "A," attached and incorporated. Section 3. Certain necessary actions by the City Manager and designated City officials and departments made in order to update the Capital Plan, relevant financial controls and computer systems in connection therewith, for project close-outs, and for grants and other funding sources in progress in connection herewith are ratified, approved, and confirmed. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ' The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
