LAW ENFORCEMENT TO REPLACE DRONES THAT ARE NOT IN COMPLIANCE
WITH RULE 6000-2.0075; ESTABLISHING A NEW SPECIAL REVENUE ACCOUNT
TITLED "DRONE REPLACEMENT PROGRAM 2024" NOT TO EXCEED THE
AMOUNT OF $475,000.00; ALLOCATING TO THE CITY ACCOUNT NO.
11000.184010.434000.0000.00000 FOR THE PERIOD BEGINNING JULY 1, 2024 AND
ENDING JUNE 30, 2025; FURTHER AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, ALL IN
FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR THE ACCEPTANCE OF THE
FINANCIAL ASSISTANCE AWARD.
Background of Item:
The Department of Fire -Rescue purchased drones prior to the establishment of Rule
6000-2.0075, Florida Administrative Code, that do not meet the minimum security
standards required by Rule 6000-2.0075, Florida Administrative Code and the State of
Florida Department of Law Enforcement will provide financial assistance to replace the
drones.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE A DRONE REPLACEMENT PROGRAM
FINANCIAL ASSISTANCE AGREEMENT ("AGREEMENT"), IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN THE FLORIDA DEPARTMENT
OF LAW ENFORCEMENT AND THE CITY OF MIAMI, TO ACCEPT FUNDS IN AN
AMOUNT NOT TO EXCEED $475,000.00, FOR THE REPLACEMENT COSTS OF
DRONES THAT ARE NOT IN COMPLIANCE WITH RULE 6000-2.0075, FLORIDA
ADMINISTRATIVE CODE; ESTABLISHING A NEW SPECIAL REVENUE ACCOUNT
TITLED "DRONE REPLACEMENT PROGRAM 2024," ALLOCATING FUNDS
RECEIVED THROUGH THE AGREEMENT TO ACCOUNT NO.
11000.184010.434000.0000.00000 FOR THE PERIOD BEGINNING JULY 1, 2024 AND
ENDING JUNE 30, 2025; FURTHER AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, ALL IN
FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR THE ACCEPTANCE AND
ADMINISTRATION OF THE FINANCIAL ASSISTANCE AND COMPLIANCE WITH
THE TERMS OF THE PROGRAM.
WHEREAS, Section 934.50, Florida Statutes establishes rules, regulations, and security
standards for the use of drones by governmental entities, and
WHEREAS, pursuant to Rule 60GG-2.0075, Florida Administrative Code (FAC), the
Department of Management Services (DMS) has published minimum security standards for
drones used by governmental entities; and
WHEREAS, the Department of Fire -Rescue ("Fire") purchased drones prior to the
establishment of Rule 60GG-2.0075, Florida Administrative Code, that do not meet the
minimum security standards required by the FAC; and
WHEREAS, the Florida Department of Law Enforcement ("FDLE") has made state
financial assistance available to the City of Miami ("City") upon acceptance of the terms and
conditions set forth in the Drone Replacement Program Financial Assistance Agreement
("Agreement"); and
WHEREAS, The General Appropriations Act, 2023 Legislature, Section 123 provides
nonrecurring funds to the FDLE for the Drone Replacement Program established in Chapter
2023-240, Laws of Florida; and
WHEREAS, The General Appropriations Act, 2024 Legislature, Section 147, reverted
and appropriated the unexpended balance of funds for use in the 2024-2025 fiscal year; and
WHEREAS, Chapter No. 2024-228, Section 44, amended the Drone Replacement
Program ("Program") requirements; and
WHEREAS, Fire must maintain a fleet of drones in order to effectively carry out its
mission of saving lives and protecting property; and
WHEREAS, Fire is eligible to receive state financial assistance through Program in an
amount commensurate with the replacement cost, not to exceed $25,000 per drone, for each
non -compliant drone relinquished to FDLE; and
WHEREAS, the total amount of financial assistance will be determined at the time non-
compliant drones are relinquished to the FDLE; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. City Manager is authorized' to execute the Agreement between the FDLE
and the City, to accept funds in an amount not to exceed $475,000.00, for the replacement
costs of Fire's drones that are not in compliance with Rule 60GG-2.0075, FAC, without further
City Commission approval, and to execute any and all necessary documents, amendments,
renewals, and extensions of the program, all in forms acceptable to the City Attorney for the
purpose stated herein.
Section 3. Funds received from the FDLE Drone Replacement Program, not to exceed
the amount of $475,000.00, will be placed in Account No. 11000.184010.434000.0000.00000.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2
APPROVED AS TO FORM AND CORRECTNESS:
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
