Background of Item: Several locations in the City of Miami's ("City") District 1 residential neighborhoods are experiencing significant cut -through traffic and speeding during rush hour periods. Such cut -through traffic and speeding on local residential streets that are not designed for such volume diminishes residents' quality of life. Section 1.6 of the Miami -Dade County Traffic Flow Modification(s)/Street Closure(s) Procedure, as revised by the Miami -Dade County Public Works Department ("PWD") Traffic Engineering Division in January 2009, attached, and incorporated as Exhibit "A" ("County Procedure"), requires concurrence from the affected residents and/ or property owners. "Municipal Jurisdictions: In lieu of concurrence from the affected residents and/or property owners, a municipality may pass a resolution after a public hearing requesting PWD [now known as the Miami -Dade County Department of Transportation and Public Works ("DTPW')] to consider the proposed traffic flow modification(s)/street closure(s)." In lieu of concurrence from the affected residents and/or property owners, the City Commission finds it in the best interest of the City and its residents to pass a resolution after a public hearing requesting PWD/DTPW to consider the proposed traffic flow modification(s)/street closure(s) as described in Exhibit "B," attached. WHEREAS, several locations in the City of Miami's ("City") District 1 residential neighborhoods are experiencing significant cut -through traffic and speeding during rush hour periods; and WHEREAS, such cut -through traffic and speeding on local residential streets that are not designed for such volume diminishes residents' quality of life; and WHEREAS, in addition to quality -of -life problems such as noise and general congestion, such cut -through traffic and speeding creates significant life -safety risks as residential streets are narrower than nearby arterial roadways, increasing the risk of vehicular accidents, including those involving pedestrians; and WHEREAS, those who cut -through residential neighborhoods during rush hour traffic tend to disobey posted speed limits and signage to gain an advantage over using arterial roadways meant for such traffic; and WHEREAS, in order to alleviate these issues, the City proposes to install forty-four (44) traffic calming devices at several locations in the residential neighborhoods, as described in Exhibit "B," attached and incorporated, that experience significant cut -through traffic and speeding during morning and afternoon rush hour periods; and WHEREAS, Section 1.6 of the Miami -Dade County Traffic Flow Modification(s)/Street Closure(s) Procedure, as revised by the Miami -Dade County Public Works Department ("PWD") Traffic Engineering Division in January 2009, attached and incorporated as Exhibit "A" ("County Procedure"), requires concurrence from the affected residents and/ or property owners; and WHEREAS, Section 1.6 of the County Procedure further states: "Municipal Jurisdictions: In lieu of concurrence from the affected residents and/or property owners, a municipality may pass a resolution after a public hearing requesting PWD [now known as the Miami -Dade County Department of Transportation and Public Works ("DTPW)] to consider the proposed traffic flow modification(s)/street closure(s)"; and WHEREAS, in order to expeditiously address the aforementioned quality of life and life - safety issues, the City desires to install the forty-four (44) traffic calming devices, as more particularly described in Exhibit "B," attached and incorporated, in designated residential neighborhoods of District 1 without delay by holding a public hearing in lieu of resident/property owner concurrence through balloting; and WHEREAS, although the City is adopting this Resolution after a public hearing in lieu of concurrence, it is the intent of the City, to the best of its ability, to seek concurrence from the residential properties whose frontage directly abuts the proposed traffic calming devices, as are more particularly described in Exhibit "B," attached and incorporated; and WHEREAS, in lieu of concurrence from the affected residents and/or property owners, the City Commission finds it in the best interest of the City and its residents to pass a resolution after a public hearing requesting PWD/DTPW to consider the proposed traffic flow modification(s)/street closure(s) as described in Exhibit "B," attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Commission, after a duly noticed public hearing, authorizes and directs the City Manager to take all actions necessary to expeditiously request that DTPW consider the proposed traffic flow modifications at the following forty-four (44) locations within District 1, as more particularly described in Exhibit "B", attached and incorporated, in order to expeditiously proceed with design and construction of the traffic calming devices: 1. Northwest Eleventh Street and Northwest Thirty -Fourth Avenue 2. Northwest Eleventh Street and Northwest Twenty -Ninth Avenue 3. Northwest Twenty -Eighth Avenue between Northwest Seventh Street and Northwest Ninth Street 4. Northwest Thirtieth Court between Northwest Seventh Street and Northwest Eleventh Street 5. Northwest Thirtieth Place between Northwest Seventh Street and Northwest Eleventh Street 6. Northwest Thirty -First Avenue between Northwest Seventh Street and Northwest Eleventh Street 7. Northwest Thirty -Second Avenue between Northwest Seventh Street and Northwest Ninth Street 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 8.
