A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ALLOCATING AN ADDITIONAL NINE HUNDRED FIFTY-TWO THOUSAND
AND 00/100 DOLLARS ($952,000.00) IN AMERICAN RESCUE PLAN ACT OF
2021 ("ARPA") FUNDS FROM THE DEPARTMENT OF HOUSING AND
COMMUNITY DEVELOPMENT'S NEW CONSTRUCTION OF AFFORDABLE
HOUSING PROJECTS FUNDING ("FUNDS") APPROVED AND ADOPTED ON
SEPTEMBER 13, 2021, PURSUANT TO RESOLUTION NO. R-21-0352, IN
ORDER TO DEVELOP THE SINGLE FAMILY AND TWIN HOMES SPECIFIED
IN EXHIBIT "A," ATTACHED AND INCORPORATED, PROVIDED THAT THIS
ALLOCATION IS APPROVED IN WRITING BY THE CITY OF MIAMI'S ("CITY")
ARPA CONSULTANT ("ARPA CONSULTANT APPROVAL") AND SUBJECT TO
ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF
SUCH FUNDS; AUTHORIZING THE DE -OBLIGATION OF HOME
INVESTMENT PARTNERSHIP PROGRAM FUNDS ("HOME"), IN THE
AMOUNT OF TWO HUNDRED SIXTY-TWO THOUSAND THREE HUNDRED
DOLLARS ($262,300.00), AND AN AMOUNT OF SIX HUNDRED EIGHTY-NINE
THOUSAND SEVEN HUNDRED DOLLARS ($689,700.00) FROM
NEIGHBORHOOD STABILIZATION PROGRAM FUNDS ("NSP"), IN THE
TOTAL AMOUNT OF NINE HUNDRED FIFTY-TWO THOUSAND AND 00/100
DOLLARS ($952,000.00), RESPECTIVELY, SUBJECT TO ALL FEDERAL,
STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS;
AUTHORIZING THE DE -OBLIGATED "HOME" AND "NSP" FUNDS TO BE RE-
ALLOCATED AND APPROPRIATED TO CITY-WIDE ELIGIBLE HOUSING
ACTIVITIES; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE ANY AND ALL NECESSARY DOCUMENTS, INCLUDING
AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN FORMS
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE.

WHEREAS, on September 13, 2021, pursuant to Resolution No. R-21-0352 ("R-21-
0352"), the City Commission approved the allocation of American Rescue Plan Act of 2021
("ARPA") funds in the amount of $137,639,417.00, which included an amount of $15,500,000.00
to the Department of Housing and Community Development ("Department"); and
WHEREAS, the allocation to the Department included an amount of Two Million, Seven
Hundred Fifty Thousand and 00/100 Dollars ($2,750,000.00) to establish a pipeline of new
construction affordable housing projects, in which the Department would hire several developers
to construct four (4) single family homes in District 4 and another six (6) homes in District 5 with
the potential to add more; and

WHEREAS, on April 1, 2021, the City of Miami ("City") issued a Request for Proposals
("RFP") inviting qualified private real estate developers to propose developments of single-
family homes and/or twin homes on certain City -owned parcels of land (collectively, "Project");
and
WHEREAS, a total of five (5) responses were received, two (2) of which most fully met
the minimum threshold and fulfilled all of the RFP's requirements as responsive and responsible
bidders: RJ Spencer Construction LLC, a Florida Limited Liability Company ("RJ Spencer"), and
RF Construction Group Inc., a Florida Profit Corporation ("RF Construction Group") (collectively,
"Developers"); and
WHEREAS, on July 8, 2021, pursuant to Resolution No. R-21-0281, the City
Commission accepted the proposals received May 17, 2021, pursuant to RFP No. HCD 2021-
03 from RJ Spencer and RF Construction Group; and
WHEREAS, on January 11, 2024, pursuant to Resolution No. R-24-0009, the City
Commission allocated an initial $1,000,000 from the total $2,750,000.00 allocated in R-21-0352
in order to develop the single family and twin homes specified in Exhibit "A"; and
WHEREAS, the Department wishes to allocate an additional portion of the ARPA funds
allocated for new construction affordable housing projects in the amount not to exceed Nine
Hundred Fifty -Two Thousand and 00/100 Dollars ($952,000.00) ("Additional ARPA Funds") to
develop the properties specified in Exhibit "A," attached and incorporated, subject to the prior
written approval by the City's ARPA Consultant, Atkins, a member of the SNC-Lavalin Group, or
its successor ("ARPA Consultant"), and subject to all federal, state, and local laws that regulate
the use of such funds; and
WHEREAS, the Department wishes to de -obligate Home Investment Partnership
program ("HOME") funds in the amount of Two Hundred Sixty -Two Thousand, Three Hundred
and 00/100 Dollars ($262,300.00) and Neighborhood Stabilization program ("NSP") funds in the
amount of Six Hundred Eighty -Nine Thousand, Seven Hundred and 00/100 Dollars
($689,700.00) from the projects specified in Exhibit "A," attached and incorporated, subject to all
federal, state, and local laws that regulate the use of such funds;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated herein as if fully set forth in this Section.
Section 2. The allocation of the Additional ARPA Funds in an amount not to exceed Nine
Hundred Fifty -Two Thousand and 00/100 Dollars ($952,000.00) for the new construction
affordable housing projects specified in Exhibit "A," attached and incorporated, is authorized',
subject to all federal, state, and local laws that regulate the use of such funds.
Section 3. The de -obligation of HOME funds in the amount of Two Hundred Sixty -Two
Thousand, Three Hundred and 00/100 Dollars ($262,300.00) and NSP Funds in the amount of
Six Hundred Eighty -Nine Thousand, Seven Hundred and 00/100 Dollars ($689,700.00) from the

projects specified in Exhibit "A," attached and incorporated, is authorized', subject to all federal,
state, and local laws that regulate the use of such funds.
Section 4. The de -obligated HOME Funds will be allocated and appropriated to eligible
City-wide housing activities and, by separate City action, allocated to an eligible project within
the City, subject to all federal, State, and local laws that regulate the use of such funds and the
receipt of all necessary approvals including, but not limited to, Department and the City's
Housing and Commercial Loan Committee ("HCLC") approvals.
Section 5. The de -obligated NSP Funds will be allocated and appropriated to City-wide
eligible housing activities and, by separate City action, allocated to an eligible project within the
City, subject to all federal, State, and local laws that regulate the use of such funds and the
receipt of all necessary approvals including, but not limited to, Department and HCLC
approvals.
Section 6. The use, allocation, and appropriation of ARPA Funds are subject to written
approval by the City's ARPA consultant, and all federal, State, and local laws that regulate the
use of such funds and the receipt of all necessary approvals, including, but not limited to the
City Attorney.
Section 7. The City Manager is authorized' to negotiate and execute any and all
documents necessary for the purposes stated in this Resolution, including amendments,
extensions, and modifications, all in forms acceptable to the City Attorney, subject to all federal,
state, and local laws that regulate the use of such funds for said purpose.
Section 8. The City Manager is authorized' to make any changes to adjust, amend, and
appropriate the City's Operating Budget, Five -Year Financial Plan, Strategic Plan, and Multi -
Year Capital Plan, as necessary and applicable, pursuant to the provisions of this Resolution.
Section 9. Certain necessary actions by the City Manager and the designated City
departments to update the relevant financial controls, project close-outs, accounting entries, and
computer systems in connection herewith are hereby authorized', ratified, approved, and
confirmed.
Section 10. The City Manager in consultation with the City Attorney, the Chief Financial
Officer, the Finance Director, the Budget Director, the Department Director, and such other
appropriate officers, employees, and agents of the City as the City Manager deems necessary
are hereby authorized' to take such actions as may be necessary to carry out the purposes of
this Resolution.
Section 11. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2
