ACKNOWLEDGEMENT BY APPLICANT
1. The Department of Resilience and Public Works, Transportation, Coordinated Review Committee and other City
and County agencies review zoning public hearing requests and provide input, which may affect the scheduling
and outcome of my hearing. These reviews may require additional hearings before other City and County
boards, which may result in the modification of plans, studies and/or the proffering of agreements to be
recorded. The submission and acceptance of a request for public hearing means that the application is ready to
be scheduled for public hearing. I am also aware that I must comply promptly with any City or County conditions
and notify the Hearing Boards (Hearing Boards) in writing if my public hearing application will be withdrawn.
2. Filing fees may not be the total cost of a hearing. Some requests require notices to be mailed to property
owners up to a mile from the subject property and I am responsible for paying the additional radius mailing
costs. In addition to mailing costs, I am responsible for additional fees related to application changes, plan
revisions, deferrals, re -advertising, etc. that may be incurred. I understand that fees must be paid promptly. The
only fees that will be refunded after the submission and acceptance of an application for public hearing has
occurred will be the surcharge fees related to appeals, as expressly listed in Chapter 62 of the City Code
(Code).
3. Requests for public hearing will be scheduled by the Hearing Boards in accordance with the scheduling timeline
set forth in the Code and the Zoning Ordinance of the City of Miami (Miami 21), as applicable. I must submit any
requests to reschedule, continue or defer my hearing date to the attention of the decision -making body for its
consideration and vote at the public hearing on which my application is scheduled to be heard. I understand that
any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, as per the Code.
4. Applicable Florida Building Code requirements, or other applicable requirements, may affect my ability to obtain
a building permit even if my zoning application is approved; and a building permit will probably be required. I am
responsible for obtaining any required permits and inspections for all structures and additions proposed, or built,
without permits. In addition, a Certificate of Use (C.U.) must be obtained for the use of the property after it has
been approved at a zoning public hearing. Failure to obtain the required permits and/or C.U., Certificates of
Completion (C.C.), or Certificate of Occupancy (C.O.) will result in an enforcement action against any occupant
and owner. Submittal of the zoning public hearing request may not forestall enforcement action against the
property.
5. If my request is denied, deferred, or otherwise not approved, I understand that I will not be reimbursed for any
fees paid.
6. Any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, as per the Code.
7. Any covenant to be voluntarily proffered must be submitted in word format to the Planning Department and to
the Office of the City Attorney through ePlan for review and comments from the Planning Department, Office of
the City Attorney, and any other City departments as deemed necessary. The covenant will be reviewed in
ePlan and the applicant will be notified of any necessary changes, corrections or comments through ePlan.
Once the covenant receives a recommendation of approval from the Planning department and as to legal form,
Hearing Boards staff will extract the approved covenant directly from ePlan to include as part of the agenda.
The applicant is responsible to submit to the Hearing Boards the signed covenant with a current Opinion of Title
no later than two (2) weeks prior to the initial public hearing. I understand that any requests by the applicant to
reschedule, continue or defer the hearing date that are granted shall incur a $1,000.00 fee, per instance, as per
the Code.

financial relationship with the Mayor, any member of the City Commission, any member of a City board, the
City Manager or a member of the City staff before whom he/she lobbies or intends to lobby. Attach separate

Lobbyists, as defined in City Code Section 2-653, shall pay an annual registration fee of $525.00, plus $105.00 for
each principal represented for each issue lobbied on behalf of any one principal. Each issue associated with lobbying
shall be described with as much detail as is practical. The City Clerk, or the City Clerk's designee, shall reject any
registration statement that does not provide a clear description of the specific issue on which such lobbyist has been

Trust ("Ethics Commission"). Lobbyists who have completed the initial ethics course mandated by the preceding
sentence and have continuously registered as a lobbyist thereafter shall be required to complete a refresher ethics
course offered by the Ethics Commission every two (2) years. Each lobbyist who has completed a refresher ethics
course shall submit a certificate of completion within sixty (60) days after registering as a lobbyist.
Lobbyists shall file amendments to their registration forms within fifteen (15) days of any change of information
required to be set forth on their registration forms. (Miami -Dade County Code Section 2-11.1(s)(3)(h))
Each lobbyist shall file a form with the City Clerk within thirty (30) days after ceasing all lobbying activities with a

Dear Mr. Snow:
This law firm represents Comfort Care One LLC (the
"Applicant") with regards to the properties located at 2620, 2610,
and 2600 SW 27 Street in the City of Miami, Florida (collectively,

Property. The Property is made up of three (3) narrow lots located just off the intersection
of SW 27 Avenue, fronting SW 27 Street. The Property is approximately 12,500 square feet in
size and developed with a surface parking lot for the existing Shell Lumber store customers and
two residential structures. However, for many years, the Applicant has wished to use the two
residential structures as much needed supplemental office, storage, and break space for the Shell
Lumber employees.
The Future Land Use Map ("FLUM") of the MCNP provides that the Property is designated
"Medium Density Multifamily Residential." See Figure 1. FLUM Excerpt, below. Additionally, the
Miami 21 GIS Atlas provides that the Property is zoned T4 (General Urban Zone) transect, with
the "R" or "Restricted" designation. See Figure 2. Zoning Map Excerpt, below.

The Property is also located within a Transit Oriented Development Area ("TOD"). See
Figure 3. TOD & Transit Corridors Map Excerpt, below. Article 1, of Miami 21 defines TOD as a
"designation established by the City within the Pedestrian Shed or Bicycle Shed area of
convergence of modes of transit, or a train station." The shed areas are circular areas measured
in travel time, with approximately ten (10) minutes for pedestrian shed and approximately five
(5) minutes for a bicycle shed. This pedestrian friendly area is a barrier -free area interconnected
with sidewalks and crosswalks. The City can support additional density for properties located in
TOD because the MNCP encourages redevelopment to take advantage of mass transit
availability.

The City has seen a significant change in circumstances around the Coconut Grove
Metrorail station. Immediately on the west side of SW 27 Avenue is the newly contrasted Grove
Station Tower, a thirteen (13) story residential building with ground floor retail. Another
prominent example of a recent large development approval in close proximity to the Property is
Grove Central, which includes a twenty-three (23) story mixed -use tower with office, retail, and
parking.
Additionally, although the Property contains two residential type structures, it
immediately abuts the "D" Transect. The "D" Transect is the least regulated transect that
accommodates many industrial uses by right. Several storage facilities have been developed
along SW 28 Lane in the D-1 Transect. This has reduced the station area's potential to redevelop
with new transit -oriented, mixed -use developments. This area lacks a transition to the residential
uses. Therefore, a future land use change of the subject Property is most appropriate to ensure
that there are also transit related uses on the east side of SW 27 Avenue within the TOD and
within walking distance to the Metrorail station.

In order to increase the flexibility of uses and design standards, the Applicant is requesting
a land use change from Medium Density Multifamily Residential to a consistent Restricted
Commercial, and a corresponding rezoning of the Property from T4-R to T4-O.
Applicant Analysis. The proposed future land use change is consistent with and furthers
the goals, objectives and policies of MCNP. Specifically, Policy LU-1.1.7 of the MCNP provides
that the:
"[I]and development regulations and policies will allow for the development and
redevelopment of well -designed mixed -use neighborhoods that provide for the
full range of residential, office, live/work spaces, neighborhood retail, and
community facilities in a walkable area and that are amenable to a variety of
transportation modes, including pedestrianism, bicycles, automobiles, and mass
transit."
The proposed future land use change will foster a better mix of uses that will utilize the
close proximity to mass transit. Additionally, Policy LU-1.1.10 of the MCNP states that the "City's
land development regulations will encourage high density residential development and
redevelopment near Metrorail and Metromover stations." The Property's proposed future land
use change and rezoning helps further this policy as the neighborhood continues to change.
See Exhibit B, Existing Conditions.
Policy TR1.1.5 of the MNCP provides that the "City will encourage new development to
be structured to reinforce a pattern of neighborhoods and urban centers by focusing growth
along transit corridors and around transit nodes and centers." The Restricted Commercial
designation permits residential uses, transitory residential facilities, as well as office uses. The
proposed future land use change would also permit commercial activities that serve the daily
retailing and service needs of the public in this TOD area. The Property, along a major arterial
roadway and in close proximity to a mass transit station, is better suited to provide the wider
range of residential uses and residential friendly commercial activities.
Policy LU-1.3.1.4 of the MNCP provides that the "City will continue to encourage a
development pattern that enhances existing neighborhoods by developing a balanced mix of
uses include areas for employment, shopping, housing, and recreation in close proximity to each
other." This request will accomplish this policy by creating new use opportunities near existing
office and retail uses, and in close proximity to mass transit and major arterial roadways, SW 27
Avenue and US Highway 1. Further, the Restricted Commercial designation is necessary to
address the growing need for redevelopment and employment opportunities in the City.

Property. The Property is made up of three (3) narrow lots located just off
the intersection of SW 27 Avenue, fronting SW 27 Street. The Property is
approximately 12,500 square feet in size and developed with a surface parking lot
for the existing Shell Lumber store customers and two residential structures.
However, for many years, the Applicant has wished to use the two residential
structures as much needed supplemental office, storage, and break space for the
Shell Lumber employees.
The Future Land Use Map ("FLUM") of the MCNP provides that the
Property is designated "Medium Density Multifamily Residential." See Figure 1.
FLUM Excerpt, below. Additionally, the Miami 21 GIS Atlas provides that the
Property is zoned T4 (General Urban Zone) transect, with the "R" or "Restricted"

The Property is also located within a Transit Oriented Development Area
("TOD"). See Figure 3. TOD & Transit Corridors Map Excerpt, below. Article 1,
of Miami 21 defines TOD as a "designation established by the City within the
Pedestrian Shed or Bicycle Shed area of convergence of modes of transit, or a train
station." The shed areas are circular areas measured in travel time, with
approximately ten (10) minutes for pedestrian shed and approximately five (5)
minutes for a bicycle shed. This pedestrian friendly area is a barrier -free area
interconnected with sidewalks and crosswalks. The City can support additional
density for properties located in TOD because the MNCP encourages
redevelopment to take advantage of mass transit availability.

The City has seen a significant change in circumstances around the Coconut
Grove Metrorail station. Immediately on the west side of SW 27 Avenue is the
newly contrasted Grove Station Tower, a thirteen (13) story residential building
with ground floor retail. Another prominent example of a recent large
development approval in close proximity to the Property is Grove Central, which
will include a twenty-three (23) story mixed -use tower with office, retail, and
parking.
Additionally, although the Property contains two residential type
structures, it immediately abuts the "D" Transect. The "D" Transect is the least
regulated transect that accommodates many industrial uses by right. Several
storage facilities have been developed along SW 28 Lane in the D-1 Transect. This
has reduced the station area's potential to redevelop with new transit -oriented,
mixed -use developments. This area lacks a transition to the residential uses.
Therefore, a future land use change of the subject Property is most appropriate to
ensure that there are also transit related uses on the east side of SW 27 Avenue
within the TOD and within walking distance to the Metrorail station.

Applicant Analysis. The proposed future land use change is consistent with
and furthers the goals, objectives and policies of MCNP. Specifically, Policy LU-
1.1.7 of the MCNP provides that the:
"[iland development regulations and policies will allow for
the development and redevelopment of well -designed mixed -use
neighborhoods that provide for the full range of residential, office,
live/work spaces, neighborhood retail, and community facilities in
a walkable area and that are amenable to a variety of transportation
modes, including pedestrianism, bicycles, automobiles, and mass
transit."
The proposed future land use change will foster a better mix of uses that will
utilize the close proximity to mass transit. Additionally, Policy LU-1.1.10 of the
MCNP states that the "City's land development regulations will encourage high
density residential development and redevelopment near Metrorail and
Metromover stations." The Property's proposed future land use change and
rezoning helps further this policy as the neighborhood continues to change. See
Exhibit B, Existing Conditions.
Policy TR1.1.5 of the MNCP provides that the "City will encourage new
development to be structured to reinforce a pattern of neighborhoods and urban
centers by focusing growth along transit corridors and around transit nodes and
centers." The Restricted Commercial designation permits residential uses,
transitory residential facilities, as well as office uses. The proposed future land
use change would also permit commercial activities that serve the daily retailing
and service needs of the public in this TOD area. The Property, along a major
arterial roadway and in close proximity to a mass transit station, is better suited to
provide the wider range of residential uses and residential friendly commercial
activities.
Policy LU-1.3.1.4 of the MNCP provides that the "City will continue to
encourage a development pattern that enhances existing neighborhoods by
developing a balanced mix of uses include areas for employment, shopping,
housing, and recreation in close proximity to each other." This request will

accomplish this policy by creating new use opportunities near existing office and
retail uses, and in close proximity to mass transit and major arterial roadways, SW
27 Avenue and US Highway 1. Further, the Restricted Commercial designation is
necessary to address the growing need for redevelopment and employment
opportunities in the City.
Conclusion. Based on the forgoing, the future land use complies with the
intent of the MNCP. The change proposed will foster a more pedestrian friendly
experience in the TOD area, along a major transit corridor, in close proximity to a
Metrorail station, with more flexible uses and design regulations. Should you

1. Staff encourage the Applicant to explore on the proposed transition, massing and height where abutting T3,
as well as highlight the importance of addressing both sides of a corridor with the same zoning designation.
2. Pursuant to Miami 21 Survey of the property prepared by a State of Florida registered land surveyor within six
(6) months from the date of the application, including acreage and Legal Description.
3. May the Applicant want to provide certain restrictions in uses, a voluntarily proffered Covenant will be the
appropriate mechanism to make it formal. Staff will not consider the Covenant in it's recommendation, but
the boards will.
4. Include in your analysis explanation of why the existing Zoning classification is inappropriate for the subject
properties, and how this request will benefit the immediate neighbohood or the entire city
5. Is the surrounding neighborhood an stable residential area or is a changing area?
6. Staff recommends to reach out the NET Office and the neighbors regarding the proposed rezoning and
provide the city with the feedback received.
7. Explain the relationship of the proposed amendment to the goals, objectives and policies of the
Comprehensive Plan, with appropriate consideration as to whether the proposed change will further the goals,
objectives and policies of the Comprehensive Plan; the Miami 21 Code; and other city regulations
(Sec. 7.1.2.8 f).
8. Elaborate in the need and justification for the proposed change, including changed or changing
conditions that make the passage of the proposed change necessary.
9. If the request involves a Density increase, tha application must contain a School Concurrency form
properly filled and signed by the Applicant.
10. Be sure to comply with the Naming Convention for your application(s), as provided in the attached
Checklists for Comprehensive Plan Amendment and Rezoning.
