Purpose
The City Manager is the applicant for a proposed rezone of one parcel located at 171 NE 42 ST ("the Property").
The Property is located within the historic Buena Vista East District. If approved, the Property would be rezoned
from "T3-O" Sub -Urban Zone to "CS" Civic Space Zone. This Rezone will also trigger an amendment to the
Future Land Use Map. The City Manager is the applicant for a proposed request to amend the Property's FLUM
designation from Medium Density Multifamily Residential to Commercial Recreation.
Background
The Property includes one land parcel and is approximately 5,000 square feet. These Rezone and FLUM
Amendment, if approved, will change the current transect designation from "T3-O" Sub -Urban Zone to "CS"
Civic Space Zone. The FLUM amendment, if approved, will change the designation of the land parcel from
Medium Density Multifamily Residential to Commercial Recreation. The property owner is aware and in
support of moving this application forward. Further analysis will be undertaken as part of the application and
included in the Staff's Recommendation Report.
Timing
The Planning Department anticipates presenting the Rezone and FLUM amendment application to the Planning,
Zoning and Appeals Board (PZAB) in September 2023. This will be followed by consideration and
determination by City Commission.

As the City is the applicant, the Planning Department requests that the City Manager signs both enclosed Online
Application System (OAS) Forms. As noted above, the property owner is aware and in support of the City

As discussed in detail below, the requests are consistent with Miami 21 and the goal, policies and objectives of the
MCNP. The proposed Mini -Park will provide green space and a park amenity for the residents of the Buena Vista East
Historic neighborhood. Further, a rezoning to CS eliminates density and substantially limits intensity and allowable uses.
II. Compliance with Miami 21 and MCNP Correspondence Table
Pursuant to Sec. 7.1.2.8.c.1 of Miami 21, a City -initiated rezoning to "CS" is exempt from the typical minimum size and
frontage requirements. As such, this City -initiated rezoning request to "CS" is consistent with Sec. 7.1.2.8.c.1 of Miami
21. The proposed future land use designation of Commercial Recreation is consistent with CS zoning according to the
MCNP's Correspondence Table. Additionally, as set forth in the discussions below, the proposed Applications are
consistent with goals, policies and objectives of Miami 21 Code and the Comprehensive Plan (MCNP) and is supported
by changing conditions in the neighborhood.

Special Area Plan (IIDD SAP") is located immediately south of
the Property. There is an attractive greenspace and
landscaped buffer between the Design District and Buena
Vista consisting of the ICA sculpture garden, then going east

proposed Mini -Park.

Levels of Service. Currently, the closest park to the Property is the Pullman mini -park more than half
A City of Miami Parks and Recreation survey result study dated September 2022 (the "Survey") found that in
neighborhood parks and mini -parks should be in the City's high priority list considering residents' stated
unmet needs. See Parks and Recreation 2022 Survey, page 9 as PZD-11.

Approval of these Applications increases the levels of service for Recreation and Open Space by adding a Mini -
Park within a 10 minute,'h mile barrier -free walk fora substantial number of existing residents and incoming. We do not
anticipate that the Mini -Park will have any negative effect on the minimal levels of service for Schools, Potable Water,
Sanitary Sewer Transmission and Solid Waste Collection.
Socioeconomic Data. The Property is located within the 33137-zip code. The following socioeconomic data is
available for 33137 on censusreporter.org.3
• Population - approximately 22,768 residents
• Median Age - 35.2 years old
• Households - approximately 10,405 households
• Median Income - approximately $66,225, above the County median income.
• Education Level - approximately 50.1% completed a bachelor's degree; approximately 89.5% completed a high
school degree
The Applications will not strain the levels of service and the resulting Mini -Park would provide an amenity to those who
live in the neighborhood.

Criteria 1: "(a) The relationship of the proposed amendment to the goals, objectives and policies of the
Comprehensive Plan, with appropriate consideration as to whether the proposed change will further the goals,
objectives and policies of the Comprehensive Plan; the Miami 21 Code; and other city regulations. (b) The need and
justification for the proposed change, including changed or changing conditions that make the passage of the
proposed change necessary.
Approval of these Applications is consistent and further implements the following Goals, Policies and Objectives of
the MCNP.
• Goal PR-1: Provide sufficient opportunities for active and passive recreation to all City residents based on access
to parks, recreation and open space, per capita park funding, and regular surveys of residents on park and
recreation needs.
Approval of this Application will enable development of a new mini -park dedicated for public use. This will
increase access to park space for hundreds of residents. Further, a City of Miami Parks and Recreation survey
result study dated September 2022 (the "Survey") found that investment in neighborhood parks and mini -parks
should be in the City's high priority list considering residents' stated wants and unmet needs.
• Objective PR-1.1: The City shall work to achieve a medium -term objective of providing a park within a ten minute
walk of every resident.
This Mini -Park will be a 10-minute barrier -free walk for thousands of existing and forthcoming residents.
• Policy PR-1.1.3: The City will provide areas for safe, passive use in all parks, including those in active recreational
use parks. The passive areas will include usable green space with plantings, shade and seating. 1.1.3.1 The City,
through its land development regulations, will designate a zoning category for parks separate from Civic

Space. That category will permit a variety of areas for passive and/or greater intensity of rec

• Policy PR-1.1.5: The City will review and enact provisions and create a plan to remedy deficiencies for residents
who do not have access to a park within a ten-minute, barrier -free walk, including financing for acquisition to
remedy deficiencies
Approval of these Applications will cure an existing park access deficiency for residents neighboring the
Property.
• Objective PR-1.3: Pursue expanded and new opportunities identified in the 2007 Parks Master Plan (and any
subsequent updates) to share park, recreation and open space resources with the school district, the housing
authority, churches, nonprofit organizations, transportation agencies and other groups that may be able to share
land and programs with the City Parks and Recreation Department.
