AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A
TEMPORARY ACCESS AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE
ATTACHED FORM, WITH 2871 OAK LLC, A FLORIDA LIMITED LIABILITY
COMPANY, TO ACCESS A CERTAIN PORTION OF CITY OF MIAMI ("CITY") OWNED
REAL PROPERTY LOCATED AT 2975 OAK AVENUE, MIAMI, FLORIDA 33133,
COMMONLY KNOWN AS FIRE STATION NO. 8 ("PROPERTY"), AS MORE
PARTICULARLY DESCRIBED IN EXHIBIT "A" OF THE AGREEMENT, SOLELY TO
RESURFACE, PAVE, AND STRIPE THE PARKING APRON AND STALLS, INSTALL
PARKING STOPS, FOR FIRE STATION NO. 8 FOR PURPOSES OF COMPLETING
THE INSTALLATION OF A FLORIDA POWER & LIGHT ("FPL") TRANSFORMER ON
THE PROPERTY; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE ALL NECESSARY DOCUMENTS, INCLUDING AMENDMENTS AND
MODIFICATIONS TO SAID AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY

ATTORNEY.
WHEREAS, the City of Miami ("City") is the fee simple owner of the real property located
at 2975 Oak Avenue, Miami Florida 33133, commonly known as Fire Station No. 8 ("Property"),
as more particularly described in Exhibit "A" of the Temporary Access Agreement
("Agreement"), attached and incorporated; and
WHEREAS, 2871 Oak LLC, a Florida Limited Liability Company ("User"), has requested
that the City grant authorization to the User, to enter upon the Property; and
WHEREAS, the Agreement will be used solely to resurface, pave and stripe the parking
apron and stalls, install parking stops, for Fire Station No. 8 for purposes of completing the
installation of an FPL transformer on the Property ("Intended Purpose");
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The City Manager is authorized to negotiate and execute the Agreement, in
substantially the attached form, with the User, for the Property, as more particularly described in
Exhibit "A" of the Agreement, for the Intended Purpose.
Section 3. The City Manager is further authorized' to negotiate and execute all
necessary documents, including amendments and modifications to said Agreement, in a form
acceptable to the City Attorney.
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and Code provisions.
Section 4. This Resolution shall become effective immediately upon its adoption.
